<official-title>To direct the Secretary of Transportation to establish a pilot program to facilitate the use of natural gas buses at public airports through grants for energy demonstration and commercial application of energy technology, and for other purposes.</official-title>

<section id="H0FED7B0F3E064DB183A7F1D96893A468" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Clean Airport Bus Act of 2003</quote>.</text> </section> 
<section id="HEE5ABC5288FE4E45A63399089E5D5700"><enum>2.</enum><header>Establishment of pilot program</header> 
<subsection id="H4E20742044E743FA001F8BE0D1F0EC96"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Transportation shall establish a pilot program for awarding grants on a competitive basis to eligible entities for facilitating the use of natural gas buses at public airports through airport bus replacement and fleet expansion programs under this section.</text></subsection> 
<subsection id="H99D4B4B3889E47F89832F00151B15B"><enum>(b)</enum><header>Requirements</header><text>Not later than 3 months after the date of enactment of this Act, the Secretary shall establish and publish in the Federal Register grant requirements on eligibility for assistance, and on management, transfer, and ultimate disposition of buses, including certification requirements to ensure compliance with this Act.</text></subsection> 
<subsection id="H3F09C3DD07CB4489BD063BE8D1B86E8"><enum>(c)</enum><header>Solicitation</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary shall solicit proposals for grants under this section.</text></subsection> 
<subsection id="H8A3CE3227CED4E44ADDF6221B1CF6088"><enum>(d)</enum><header>Eligible recipients</header><text>A grant shall be awarded under this section only to a public agency responsible for bus service at a public airport.</text></subsection> 
<subsection id="H6E6DF41537674C90AB295158F010824B"><enum>(e)</enum><header>Types of Grants</header><text></text> 
<paragraph id="HD254D4AA913F499CA733BD049236177F"><enum>(1)</enum><header>In general</header><text>Grants under this section may be for the purposes described in paragraph (2), paragraph (3), or both.</text></paragraph> 
<paragraph id="HED3E092A347F491D938868B5E9D8B8FD"><enum>(2)</enum><header>Replacement bus grants</header><text>A grant under this section may be used for the acquisition of replacement buses pursuant to subsection (f).</text></paragraph> 
<paragraph id="HD5C1BE27C8C14A988E10D6BBE4CBC0DD"><enum>(3)</enum><header>Fleet expansion bus grants</header><text>A grant under this section may be used for the acquisition of not more than 10 buses to expand a fleet of airport buses at any single airport.</text></paragraph></subsection> 
<subsection id="H4D2F1888B15C4C05A1FE7504FC7518AC"><enum>(f)</enum><header>Replacement Bus Grants</header><text></text> 
<paragraph id="HAC67DBCEB38A497B95092020B2648728"><enum>(1)</enum><header>Replacement</header><text>For each bus acquired under a replacement bus grant, 1 older model year bus shall be retired from active service and crushed as provided in paragraph (2).</text></paragraph> 
<paragraph id="HCBF49498EBC04771B6DC695544EDADE3"><enum>(2)</enum><header>Bus acquisition</header><text>Buses acquired under a replacement bus grant shall be acquired in the following order:</text> 
<subparagraph id="H9D5DE58B024A4C11BBE0B8694BD2EA1E"><enum>(A)</enum><text>First, new buses will replace buses manufactured before model year 1977, and the older buses replaced shall be crushed.</text></subparagraph> 
<subparagraph id="HCC4702B4E5E343AB95EF15F6568746DA"><enum>(B)</enum><text>If all buses manufactured before model year 1977 owned or operated by the grant recipient have been replaced, additional new buses will replace diesel-powered buses manufactured before model year 1991, which shall either—</text> 
<clause id="H0FA375D3A43147FAA9E4FFA0131FFC"><enum>(i)</enum><text>be crushed; or</text></clause> 
<clause id="H5E6846B8133849E2B2D600575034F670" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">be exchanged by the grant recipient for buses manufactured before model year 1977 from another bus fleet, with that bus then being crushed. </text></clause><continuation-text continuation-text-level="subparagraph">Exchanges made under subparagraph (B)(ii) shall be made without profit or other economic benefit to the grant recipient.</continuation-text></subparagraph></paragraph> 
<paragraph id="H25516131CDCB44AE0003FCC0900C1D0"><enum>(3)</enum><header>Priority of grant applications</header><text>The Secretary shall give priority to awarding grants to applicants emphasizing the replacement of buses manufactured before model year 1977.</text></paragraph></subsection> 
<subsection id="HCB2889198CBE43979FE5253100E854CF"><enum>(g)</enum><header>Conditions of grant</header><text>A grant provided under this section shall include the following conditions:</text> 
<paragraph id="H21C460F153164BDA8CBDA3A318BCB971"><enum>(1)</enum><text>All buses acquired with funds provided under the grant shall be operated as part of the airport bus fleet for which the grant was made for a minimum of 5 years.</text></paragraph> 
<paragraph id="HD26D4AE685DA4107889FE7F3ABCE65C"><enum>(2)</enum><text>Funds provided under the grant may only be used—</text> 
<subparagraph id="HE613559D90C64BF888F3288D00808D6D"><enum>(A)</enum><text>to pay the cost, except as provided in paragraph (3), of new natural gas airport buses, including State taxes and contract fees; and</text></subparagraph> 
<subparagraph id="H978DBF1781904DD3B542EF7FDE6760A3"><enum>(B)</enum><text>to provide—</text> 
<clause id="H01381CBBDBA04FECB5D51F6B143CEC31"><enum>(i)</enum><text>up to 10 percent of the price of the natural gas buses acquired, for necessary natural gas infrastructure if the infrastructure will only be available to the grant recipient; and</text></clause> 
<clause id="HB72C030F3FC14DBEA1B795B05041F4A2"><enum>(ii)</enum><text>up to 15 percent of the price of the natural gas buses acquired, for necessary natural gas infrastructure if the infrastructure will be available to the grant recipient and to other bus fleets.</text></clause></subparagraph></paragraph> 
<paragraph id="HBB69B25A5A734E9383021214D11073D8"><enum>(3)</enum><text>The grant recipient shall be required to provide—</text> 
<subparagraph id="H33BA36C7626149489F29D8EB580814A7"><enum>(A)</enum><text>in the case of a replacement bus acquired as described in subsection (f)(2)(A) to replace a bus manufactured before model year 1977, 10 percent of the total cost of the bus, but not more than $10,000;</text></subparagraph> 
<subparagraph id="H727C6A4C27B74BEBAE61DD004E5E18D2"><enum>(B)</enum><text>in the case of a replacement bus acquired as described in subsection (f)(2)(B)(ii) to replace a diesel-powered bus manufactured before model year 1991 for exchange for a bus manufactured before model year 1977, 10 percent of the total cost of the bus, but not more than $10,000; and</text></subparagraph> 
<subparagraph id="H095143227BD843108201BC7450C31712"><enum>(C)</enum><text>in the case of a replacement bus acquired as described in subsection (f)(2)(B)(i) to replace a diesel-powered bus manufactured before model year 1991, 25 percent of the total cost of the bus, but not more than $25,000.</text></subparagraph></paragraph></subsection> 
<subsection id="HFFB3B219AC2A415AA48500FC31B143B3"><enum>(h)</enum><header>Buses</header><text>Funding under a grant made under this section may be used to acquire only new airport buses—</text> 
<paragraph id="H36E905DC2D8B457D954C8988EA97445C"><enum>(1)</enum><text>with a gross vehicle weight of greater than 14,000 pounds;</text></paragraph> 
<paragraph id="H53E5CFAC55964483B5002300F417B37"><enum>(2)</enum><text>that are powered by a heavy duty engine;</text></paragraph> 
<paragraph id="H9276204BDAB2487300679EDF82C48B27"><enum>(3)</enum><text>that emit not more than—</text> 
<subparagraph id="H863F8274C8B74D2E914EE867541F8D3"><enum>(A)</enum><text>for buses manufactured in model years 2001 and 2002, 2.5 grams per brake horsepower-hour of nonmethane hydrocarbons and oxides of nitrogen and .01 grams per brake horsepower-hour of particulate matter; and</text></subparagraph> 
<subparagraph id="HE0DA0590FC604C9DAEDC8DEA6FD89BB3"><enum>(B)</enum><text>for buses manufactured in model years 2003 through 2006, 1.8 grams per brake horsepower-hour of nonmethane hydrocarbons and oxides of nitrogen and .01 grams per brake horsepower-hour of particulate matter; and</text></subparagraph></paragraph> 
<paragraph id="HE318FB75B03048AA9E48D655C385F5A6"><enum>(4)</enum><text>that are powered substantially by electricity (including electricity supplied by a fuel cell), or by liquefied natural gas, compressed natural gas, liquefied petroleum gas, hydrogen, propane, or methanol or ethanol at no less than 85 percent by volume.</text></paragraph></subsection> 
<subsection id="H96861EFAF62A4DD9B277640632D3DC67"><enum>(i)</enum><header>Deployment and distribution</header><text>The Secretary shall seek to the maximum extent practicable to achieve nationwide deployment of natural gas airport buses through the program under this section, and shall ensure a broad geographic distribution of grant awards, with a goal of no State receiving more than 10 percent of the grant funding made available under this section for a fiscal year.</text></subsection></section> 
<section id="H5C113814E56F496F8CAF3C3F6C20D1E8"><enum>3.</enum><header>Fuel cell bus development and demonstration program</header> 
<subsection id="HB97B59DC670A4BE992416EDCC3550905"><enum>(a)</enum><header>Establishment of program</header><text>The Secretary of Transportation shall establish a program for entering into cooperative agreements with private sector fuel cell bus developers for the development of fuel cell-powered airport buses, and subsequently with not less than 2 public agencies using natural gas-powered airport buses and such private sector fuel cell bus developers to demonstrate the use of fuel cell-powered airport buses.</text></subsection> 
<subsection id="H6B1858C94D654B048F3B44A68D10A0E4"><enum>(b)</enum><header>Cost Sharing</header><text>The non-Federal contribution for activities funded under this section shall be not less than—</text> 
<paragraph id="H94FB9614F69A40F7BF54372103156EE2"><enum>(1)</enum><text>20 percent for fuel infrastructure development activities; and</text></paragraph> 
<paragraph id="H674EE9D72C124442BD79B1FEC9DC2C30"><enum>(2)</enum><text>50 percent for demonstration activities and for development activities not described in paragraph (1).</text></paragraph></subsection> 
<subsection id="HC3FD62104821450DA2CD5F96714350B4"><enum>(c)</enum><header>Funding</header><text>No more than $25,000,000 of the amounts authorized under section 5 may be used for carrying out this section for the period encompassing fiscal years 2004 through 2008.</text></subsection> 
<subsection id="HFC0C650A9CEE44B4BBB9440099C892BC"><enum>(d)</enum><header>Reports to Congress</header><text></text> 
<paragraph id="H72B68DF9EEA3481E002C6600E1B2EDFD"><enum>(1)</enum><header>Initial report</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall transmit to Congress a report that—</text> 
<subparagraph id="H7B59113666D449E3BE424100B7CFD4FA"><enum>(A)</enum><text>evaluates the process of converting natural gas infrastructure to accommodate fuel cell-powered airport buses; and</text></subparagraph> 
<subparagraph id="H929C9D0226B94AD48409E0C4E70B018"><enum>(B)</enum><text>assesses the results of the development and demonstration program under this section.</text></subparagraph></paragraph> 
<paragraph id="H114D02A1636048D98F3D65DD5DCFE43D"><enum>(2)</enum><header>Updated report</header><text>Not later than October 1, 2006, the Secretary shall transmit to Congress a updated version of the report transmitted under paragraph (1).</text></paragraph></subsection></section> 
<section id="HFDFDB76AE5304C2B85F6A1E267741B2"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline"> In this Act, the following definitions apply:</text> 
<paragraph id="H89A8CE04ED534B97AA0056264B6D4F3E"><enum>(1)</enum><header>Airport bus</header><text>The term <quote>airport bus</quote> means a bus operated by a public agency to provide transportation between the facilities of a public airport.</text></paragraph> 
<paragraph id="H4FD75CE7376145C68447818E4309E200"><enum>(2)</enum><header>Public airport</header><text>The term <quote>public airport</quote> has the meaning such term has under <external-xref legal-doc="usc" parsable-cite="usc/49/47102">section 47102</external-xref> of title 49, United States Code.</text></paragraph></section> 
<section id="HA86209BD8656470FA32CEE7B00FA008E"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline"> There are authorized to be appropriated to the Secretary of Transportation for carrying out this Act—</text> 
<paragraph id="H4A0A554ABC9A418583EF6110CF8D00F0"><enum>(1)</enum><text>$40,000,000 for fiscal year 2004;</text></paragraph> 
<paragraph id="HDFC41D8BC93C4235A781121774C2F3E5"><enum>(2)</enum><text>$50,000,000 for fiscal year 2005;</text></paragraph> 
<paragraph id="H8FE674365CBA422AB8C63FBADE6DC678"><enum>(3)</enum><text>$60,000,000 for fiscal year 2006;</text></paragraph> 
<paragraph id="H3CE7A8C8FFB044FEAA48C754373FAA4E"><enum>(4)</enum><text>$70,000,000 for fiscal year 2007; and</text></paragraph> 
<paragraph id="H9EC9470913E541239D5F726B64A00F"><enum>(5)</enum><text>$80,000,000 for fiscal year 2008.</text></paragraph></section>
