<official-title>To amend part B of the Individuals with Disabilities Education Act to provide full Federal funding of such part, to provide an exception to the local maintenance of effort requirements, and for other purposes.</official-title>

<section section-type="section-one" id="HEEF076DDC7C344CEA27E437474E4D687"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="HF87009F07B3B49DB85EE2C4C00EF9812"><enum>2.</enum><header>Amendments to IDEA</header> 
<subsection id="H337E6F6830A34835B8ECAC16643F4E80"><enum>(a)</enum><header>Funding</header><text>Section 611(j) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1411">20 U.S.C. 1411(j)</external-xref>) is amended to read as follows:</text>

<subsection id="H342B776A5AF24C04AFACB267918F1177"><enum>(j)</enum><header>Funding</header> 
<paragraph id="HB01E0E3D23304E02BF03183B6EC3F6BE"><enum>(1)</enum><header>In general</header><text>For the purpose of carrying out this part, other than section 619, there are authorized to be appropriated—</text> 
<subparagraph id="HF106563C784848E9BBAEF6AECB29CCC7"><enum>(A)</enum><text>$13,574,398,000, or 25.2 percent of the amount determined under paragraph (2), whichever is less, for fiscal year 2005, and, there are hereby appropriated $4,700,000,000, or 7.6 percent of the amount determined under paragraph (2), whichever is less, for fiscal year 2005, which shall become available for obligation on July 1, 2005, and shall remain available through September 30, 2006;</text></subparagraph> 
<subparagraph id="H555F4E5844E843BE8928C2C3B00F16D"><enum>(B)</enum><text>$15,746,302,000, or 28.3 percent of the amount determined under paragraph (2), whichever is less, for fiscal year 2006, and, there are hereby appropriated $6,871,904,000, or 10.7 percent of the amount determined under paragraph (2), whichever is less, for fiscal year 2006, which shall become available for obligation on July 1, 2006, and shall remain available through September 30, 2007;</text></subparagraph> 
<subparagraph id="H96DD9E28FCCA438099813C65891780C1"><enum>(C)</enum><text>$17,918,205,000, or 31.2 percent of the amount determined under paragraph (2), whichever is less, for fiscal year 2007, and, there are hereby appropriated $9,043,807,000, or 13.6 percent of the amount determined under paragraph (2), whichever is less, for fiscal year 2007, which shall become available for obligation on July 1, 2007, and shall remain available through September 30, 2008;</text></subparagraph> 
<subparagraph id="H540D992BC68D4AC48B401CCCE4050710"><enum>(D)</enum><text>$20,090,109,000, or 28.3 percent of the amount determined under paragraph (2), whichever is less, for fiscal year 2008, and, there are hereby appropriated $11,215,711,000, or 16.3 percent of the amount determined under paragraph (2), whichever is less, for fiscal year 2008, which shall become available for obligation on July 1, 2008, and shall remain available through September 30, 2009;</text></subparagraph> 
<subparagraph id="H7EFD0E16AD1C414589C8780097D81849"><enum>(E)</enum><text>$22,262,307,000, or 36.4 percent of the amount determined under paragraph (2), whichever is less, for fiscal year 2009, and, there are hereby appropriated $13,387,909,000, or 18.8 percent of the amount determined under paragraph (2), whichever is less, for fiscal year 2009, which shall become available for obligation on July 1, 2009, and shall remain available through September 30, 2010;</text></subparagraph> 
<subparagraph id="HF563080A5ABA43D08E3D5E005F9321E3"><enum>(F)</enum><text>$25,198,603,000, or 40 percent of the amount determined under paragraph (2), whichever is less, for fiscal year 2010, and, there are hereby appropriated $16,324,205,000, or 22.4 percent of the amount determined under paragraph (2), whichever is less, for fiscal year 2010, which shall become available for obligation on July 1, 2010, and shall remain available through September 30, 2011; and</text></subparagraph> 
<subparagraph id="H91A35FBC40954476A70057B56B1E900"><enum>(G)</enum><text>40 percent of the amount determined under paragraph (2) for fiscal year 2011 and each subsequent fiscal year, and, there are hereby appropriated 22.4 percent of the amount determined under paragraph (2) for fiscal year 2011 and each subsequent fiscal year, which shall become available for obligation (A) with respect to fiscal year 2011, on July 1, 2011, and shall remain available through September 30, 2012, and (B) with respect to each subsequent fiscal year, on July 1 of that fiscal year and shall remain available through September 30 of the succeeding fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H6E7875ABA4164AD1999B33683D1600AC"><enum>(2)</enum><header>Amount</header><text>The amount referred to in each of subparagraphs (A) through (G) of paragraph (1) is the product of—</text> 
<subparagraph id="H18A8E3CD2DAC4BBFB76B4BF69CA317D4"><enum>(A)</enum><text>the number of children with disabilities in all States who are receiving special education and related services—</text> 
<clause id="H079E99FDCE25473491FAF19F839B0042"><enum>(i)</enum><text>aged 3 through 5 if the State is eligible for a grant under section 619; and</text></clause> 
<clause id="H90DFAA03BB8D48E2886F9414F75B0050"><enum>(ii)</enum><text>aged 6 through 21; and</text></clause></subparagraph> 
<subparagraph id="H29BEC30BC6BC426DB614F71E9475F22B"><enum>(B)</enum><text>the average per-pupil expenditure in public elementary and secondary schools in the United States.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HADB7A371C056485C99CB8FF8F4F05218"><enum>(b)</enum><header>Exception to the local maintenance of effort requirements</header><text>Section 613(a)(2)(B) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1413">20 U.S.C. 1413(a)(2)(B)</external-xref>) is amended to read as follows:</text>

<subparagraph id="H92CEBADB69024D7EA4F8BC64BA37E77C"><enum>(B)</enum><header>Exception</header><text>Notwithstanding the restriction in subparagraph (A)(iii), a local educational agency may reduce the level of expenditures, for 1 fiscal year at a time, if—</text> 
<clause id="HDE84621BE4E040D7A99E81EAEE00AEEB"><enum>(i)</enum><text>the State educational agency determines, and the Secretary agrees, that the local educational agency is in compliance with the requirements of this part during that fiscal year (or, if appropriate, the preceding fiscal year); and</text></clause> 
<clause id="H6774A3923DA14814A24EE0DF0095433F"><enum>(ii)</enum><text>such reduction is—</text> 
<subclause id="H9286D760584F46C789F1D947D0601BA8"><enum>(I)</enum><text>attributable to the voluntary departure, by retirement or otherwise, or departure for just cause, of special education personnel;</text></subclause> 
<subclause id="H28E303E5BECB431400C396FCC1DCB0A9"><enum>(II)</enum><text>attributable to a decrease in the enrollment of children with disabilities;</text></subclause> 
<subclause id="H8CA810ADF33C4E5996BC09088F006500"><enum>(III)</enum><text>attributable to the termination of the obligation of the agency, consistent with this part, to provide a program of special education to a particular child with a disability that is an exceptionally costly program, as determined by the State educational agency, because the child—</text> 
<item id="H1C9DFFCDA04B4EF3A5AD1CAEE31FE9FA"><enum>(aa)</enum><text>has left the jurisdiction of the agency;</text></item> 
<item id="H4E4A181B209A4319BB2C2E8B0179715F"><enum>(bb)</enum><text>has reached the age at which the obligation of the agency to provide a free appropriate public education to the child has terminated; or</text></item> 
<item id="H347B98A2CF6D4EDA8184C529ACC7E3BB"><enum>(cc)</enum><text>no longer needs such program of special education;</text></item></subclause> 
<subclause id="HACEC062C71F943CC8518BDE5B2430515"><enum>(IV)</enum><text>attributable to the termination of costly expenditures for long-term purchases, such as the acquisition of equipment or the construction of school facilities; or</text></subclause> 
<subclause id="HA7F74458EE834E2EA000A194F2776EE5"><enum>(V)</enum><text>equivalent to the amount of Federal funding the local educational agency receives under this part for a fiscal year that exceeds the amount the agency received under this part for the preceding fiscal year, but only if these reduced funds are used for any activity that may be funded under the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H236F34DCCEE240F1937C60C7C2401066"><enum>(c)</enum><header>Repeal</header><text>Section 613(a)(2) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1413">20 U.S.C. 1413(a)(2)</external-xref>) is further amended—</text> 
<paragraph id="HE378D98C232244ADBC8100DF00DB7B2D"><enum>(1)</enum><text>by striking subparagraph (C);</text></paragraph> 
<paragraph id="HB7EABBEFF5724F5A81A6118CF0A818C0"><enum>(2)</enum><text>by redesignating subparagraph (D) as subparagraph (C); and</text></paragraph> 
<paragraph id="H7992333C25794AC285DE6EF0D91606E"><enum>(3)</enum><text>in subparagraph (A)(iii), by striking <quote>paragraphs (B) and (C)</quote> and inserting <quote>paragraph (B)</quote>.</text></paragraph></subsection></section>
