<official-title>To authorize improvements in the operations of the government of the District of Columbia, and for other purposes.</official-title>

<section section-type="section-one" id="H8E27E9EA82F443A1BBB1108E1067586F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H516D603708D74EC08FD66665F17150C7"><enum>2.</enum><header>Requiring submission of plan by school Board for allocation of funds under mayor’s proposed budget</header> <text display-inline="no-display-inline">Section 452 of the District of Columbia Home Rule Act (sec. 1–204.52, D.C. Official Code) is amended—</text> 
<paragraph id="H1BB878FDF28043B187522207BFCB8D49"><enum>(1)</enum><text>in the first sentence, by striking <quote>With respect to</quote> and inserting <quote>(a) <header-in-text level="subsection">Role of Mayor and Council.—</header-in-text>With respect to</quote>;</text></paragraph> 
<paragraph id="H202ED39125BA470DB7C563B7025ADF1"><enum>(2)</enum><text>in the second sentence, by striking <quote>This section</quote> and inserting <quote>This subsection</quote>; and</text> </paragraph> 
<paragraph id="HACA893F9A1DB40D0B7CCA4BEECED7953"><enum>(3)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="HD0AB896627FF4644853079289EEF95D9"><enum>(b)</enum><header>Plan for allocation of funds under proposed budget</header> 
<paragraph id="HE75C5C20505D4D17A55830E4CA1F168E"><enum>(1)</enum><header>Submission of plan to Council</header><text>Not later than March 1 of each year or the date on which the Mayor makes the proposed annual budget for a year available under section 442 (whichever occurs later), the Board of Education shall submit to the Council a plan for the allocation of the Mayor’s proposed budget among various object classes and responsibility centers (as defined under regulations of the Board).</text></paragraph> 
<paragraph id="H5EE94F2225054B1E8EE6965C2711F55"><enum>(2)</enum><header>Contents</header><text>The plan submitted under this subsection shall include a detailed presentation of how much money will be allocated to each school, including—</text> 
<subparagraph id="HCC1F837817EC43EAA5B24E76B92BFB5B"><enum>(A)</enum><text>a specific description of the amount of funds available to the school for which spending decisions are under the control of the school; and</text></subparagraph> 
<subparagraph id="HC46C5522DB214DF184001C723552E2DD"><enum>(B)</enum><text>a specific description of other responsibility center funds which will be spent in a manner directly benefiting the school, including funds which will be spent for personnel, equipment and supplies, property maintenance, and student services.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H03349E4C57674C56B9D10020F8F33539" section-type="subsequent-section"><enum>3.</enum><header>Multiyear contracting authority and leasing agreements for District of Columbia courts</header> 
<subsection id="H7E39A1FAE0EC47FDA7F570673ECBF6A"><enum>(a)</enum><header>Authority</header><text>Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/11/17">chapter 17</external-xref> of title 11, District of Columbia Code, is amended by inserting after section 11-1742 the following new section:</text>

<section id="HBD909DC7FB7F420700CAB03751DAE37E"><enum>11-1742a.</enum><header>Multiyear contracting authority and leasing agreements</header> 
<subsection id="HA2D0B4088E384D7FBB71D0E9B19DAF08"><enum>(a)</enum><header>Severable services contracts for periods crossing fiscal years</header><text>The Executive Officer may enter into a contract for procurement of severable services in the same manner and to the same extent as the head of an executive agency may enter into such a contract under section 303L of title III of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/253l">41 U.S.C. 253l</external-xref>).</text></subsection> 
<subsection id="H0CC6EE20B74141C4986132F61E5F305D"><enum>(b)</enum><header>Multiyear leasing agreements</header><text></text> 
<paragraph id="H4AF7CF0B36674A1993F19F08ABE85844"><enum>(1)</enum><header>Authority</header><text>The Executive Officer may enter into a lease agreement for the accommodation of the District of Columbia courts in a building which is in existence or being erected by the lessor to accommodate the District of Columbia courts.</text></paragraph> 
<paragraph id="H3FD6EE5888444A38B7D435D37E7DBA28"><enum>(2)</enum><header>Terms</header><text>A lease agreement under this subsection shall be on terms the Executive Officer considers to be in the interest of the Federal Government and the District of Columbia and necessary for the accommodation of the District of Columbia courts. However, the lease agreement may not bind the District of Columbia courts for more than 10 years and the obligation of amounts for a lease under this subsection is limited to the current fiscal year for which payments are due without regard to <external-xref legal-doc="usc" parsable-cite="usc/31/1341">section 1341(a)(1)(B)</external-xref> of title 31, United States Code.</text></paragraph></subsection> 
<subsection id="H502FB76F78104C9096F9B7EA8029CD83"><enum>(c)</enum><header>Multiyear contracts</header> 
<paragraph id="HCD53A9C0D5964EB5A03439E13D9116D3"><enum>(1)</enum><header>Authority</header><text>The Executive Officer may enter into a multiyear contract for the acquisition of property or services in the same manner and to the same extent as an executive agency may enter into such a contract under section 304B of title III of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/254c">41 U.S.C. 254c</external-xref>). In applying such authority—</text> 
<subparagraph id="H178F0A5BF85A455BA8DF52BF2164D221"><enum>(A)</enum><text>in section 304B(a)(2)(B)—</text> 
<clause id="HE403373A85F0441BA812FC78CF00C422"><enum>(i)</enum><text><quote>the best interests of the District of Columbia and the Federal Government</quote> shall be substituted for <quote>the best interests of the United States</quote>; and</text></clause> 
<clause id="H5763125F29604E829000FE83A5888C4"><enum>(ii)</enum><text><quote>the courts’ programs</quote> shall be substituted for <quote>the agency’s programs</quote>; </text></clause></subparagraph> 
<subparagraph id="HC7DBEC3DF4574B99835F4D7BCF559D47"><enum>(B)</enum><text>the second sentence of section 304B(b), and subsection (e), shall not apply; and</text></subparagraph> 
<subparagraph id="H1F18EC387F704EF9A364C79459FC093D"><enum>(C)</enum><text>in section 304B(c), <quote>$5,000,000</quote> shall be substituted for <quote>$10,000,000</quote>.</text></subparagraph></paragraph> 
<paragraph id="H637EDD7592E74461B7AF413896472B4D"><enum>(2)</enum><header>Cancellation or termination for insufficient funding after first year</header><text>In the event that funds are not made available for the continuation of a multiyear contract for services into a subsequent fiscal year, the contract shall be canceled or terminated, and the costs of cancellation or termination may be paid from—</text> 
<subparagraph id="H6F83D93A8BEE4E8E99BC3E59998772A8"><enum>(A)</enum><text>appropriations originally available for the performance of the contract concerned;</text></subparagraph> 
<subparagraph id="H06920BC1A8454E23ABC521D475798079"><enum>(B)</enum><text>appropriations currently available for procurement of the type of services concerned, and not otherwise obligated; or</text></subparagraph> 
<subparagraph id="H8409077DA81D4948B258D9F647C1CEE4"><enum>(C)</enum><text>funds appropriated for those payments.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8D77D35934354B41B79EECD7388295E4"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of sections for subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/11/17">chapter 17</external-xref> of title 11, District of Columbia Code, is amended by inserting after the item relating to section 11-1742 the following new item:</text>

<section id="H545A13668FC3495F9937D300B400FC65"><enum>4.</enum><header>Establishment of academic year as fiscal year for District of Columbia schools</header><text display-inline="no-display-inline">Section 441 of the District of Columbia Home Rule Act (sec. 1–204.41, D.C. Official Code) is amended—</text> 
<paragraph id="HBADF450CF30F47E4B2A8CE42F009FDF"><enum>(1)</enum><text>in the first sentence, by striking <quote>The fiscal year</quote> and inserting <quote>(a) <header-in-text level="subsection">In General.—</header-in-text>Except as provided in subsection (b), the fiscal year</quote>;</text></paragraph> 
<paragraph id="HB04184B65D3742C79E66EDF16D60F781"><enum>(2)</enum><text>by striking the third sentence; and</text></paragraph> 
<paragraph id="H9EC1DBF07CF54BE6A8E47326C096045C"><enum>(3)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H5FE60CFBA4BA4958BFCC7DB1D4037697"><enum>(b)</enum><header>Exceptions</header> 
<paragraph id="H3F817F8CBA7E4380A2A443F3CA35D704"><enum>(1)</enum><header>Armory Board</header><text>The fiscal year for the Armory Board shall begin on the first day of January and shall end on the thirty-first day of December of each calendar year.</text></paragraph> 
<paragraph id="H20C0097DA66E42BA8B2804B3852080CF"><enum>(2)</enum><header>Schools</header><text>Effective with respect to fiscal year 2007 and each succeeding fiscal year, the fiscal year for the District of Columbia Public Schools (including public charter schools) and the University of the District of Columbia shall begin on the first day of July and end on the thirtieth day of June of each calendar year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H09634E5820AD48D2B0688B79005BAE5B"><enum>5.</enum><header>Extension of deadline for Council to adopt budget to account for days of recess</header><text display-inline="no-display-inline">Section 446(a) of the District of Columbia Home Rule Act (sec. 1–204.46(a), D.C. Official Code), as amended by section 101(a), is amended by striking <quote>50 calendar days</quote> and inserting <quote>56 calendar days</quote>.</text></section> 
<section id="H6D5FDF42CED44FE0BB75332E6C3CB862"><enum>6.</enum><header>Exemption of District government employees on compressed schedule from Federal overtime requirements</header> 
<subsection id="HFAD312FFD1DB43AC80AC8B1C2EDE00FC"><enum>(a)</enum><header>In general</header><text>Section 7 of the Fair Labor Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/29/207">29 U.S.C. 207</external-xref>) shall not apply to the hours of an employee of the District of Columbia government which constitute a compressed schedule.</text></subsection> 
<subsection id="H8CE7E17A4A1B45F5B2F4247B3F594D56"><enum>(b)</enum><header>Compressed schedule defined</header><text>In this section, the term <term>compressed schedule</term> means—</text> 
<paragraph id="HD17641E096FE4DBEA65848DBC1F2D86"><enum>(1)</enum><text>in the case of a full-time employee, an 80-hour biweekly basic work requirement which is scheduled for less than 10 workdays, and</text></paragraph> 
<paragraph id="H917C46426A40486D993B3BA97D85DBF0"><enum>(2)</enum><text>in the case of a part-time employee, a biweekly basic work requirement of less than 80 hours which is scheduled for less than 10 workdays.</text></paragraph></subsection> 
<subsection id="H417FD23B54BE4ED5BFF21864561F82C4"><enum>(c)</enum><header>Effective Date</header><text>This section shall apply with respect to hours occurring on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="HE03EA0533B404ADAB2D83127DDB891B4"><enum>7.</enum><header>Availability of Enforced Annual Leave or Enforced Leave Without Pay as Disciplinary Action For Corporation Counsel Attorneys</header> 
<subsection id="H162A3C1F069542A8865359A85E007615"><enum>(a)</enum><header>In General</header><text>Section 856(a) of the District of Columbia Government Comprehensive Merit Personnel Act of 1978 (sec. 1–608.56(a), D.C. Official Code) is amended by striking <quote>or reduction in grade,</quote> and inserting <quote>reduction in grade, or the placing of such attorney on enforced annual leave or enforced leave without pay,</quote>.</text></subsection> 
<subsection id="H34693E39AE5548D1B49C41643D6234DA"><enum>(b)</enum><header>Effective Date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act.</text></subsection></section>

<paragraph display-inline="yes-display-inline" id="H752CBE84D5A84550B3EAF21F71192DC"><enum>(1)</enum><text>Section 3 of the <act-name parsable-cite="FDIA">Federal Deposit Insurance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>) is amended—</text>

<subsection id="HA72A60D36C5E4A2D80C804B4017E3E0"><enum>(h)</enum><header><act-name parsable-cite="FRA">Federal Reserve Act</act-name></header><text>The last sentence of the 3rd undesignated paragraph of section 9 of the <act-name parsable-cite="FRA">Federal Reserve Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/321">12 U.S.C. 321</external-xref>) is amended by striking <quote>(except within the District of Columbia)</quote>.</text></subsection> 
<subsection id="H10B66973812F4670AD00E23E1C7BBECF"><enum>(i)</enum><header>Effective Date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act.</text></subsection></section> 
<section id="H9E8150D6283A41DDA1983567A6F0C0D0"><enum>9.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as otherwise provided, this Act and the amendments made by this Act shall apply with respect to fiscal year 2005 and each succeeding fiscal year.</text></section>
