<official-title>To amend title XVIII of the Social Security Act to deliver a meaningful benefit and lower prescription drug prices under the Medicare Program.</official-title>

<section section-type="section-one" id="HD2A36293B33C41338F06E374E25EC651"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="HA1054B4BB9C042A886C631D713AB6CE2"><enum>2.</enum><header>Establishment of Medicare operated prescription drug plan option</header> 
<subsection id="HB49C930688AA45F18DF38ECAA5CF5E5E"><enum>(a)</enum><header>In general</header><text>Subpart 2 of part D of the <act-name parsable-cite="SSA">Social Security Act</act-name>, as added by section 101 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>), is amended by inserting after section 1860D–11 the following new section:</text> 
<quoted-block style="traditional" act-name="Social Security Act" id="HB5B059AB2E2C4231BA00999D94C14F1D"> 
<section id="HF1C5091A82BC4966ABF9890010E4001C"><enum>1860D–11A.</enum><header>Medicare operated prescription drug plan option</header> 
<subsection display-inline="yes-display-inline" id="H8FF541764FDC4974A09DEA2DE095BAF2"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of this part, for each year (beginning with 2006), in addition to any plans offered under section 1860D–11, the Secretary shall offer one or more medicare operated prescription drug plans (as defined in subsection (c)) with a service area that consists of the entire United States and shall enter into negotiations with pharmaceutical manufacturers to reduce the purchase cost of covered part D drugs for eligible part D individuals in accordance with subsection (b).</text></subsection> 
<subsection id="H14FCD3F518B24BB7B92581B83091094E"><enum>(b)</enum><header>Negotiations</header><text>Notwithstanding section 1860D–11(i), for purposes of offering a medicare operated prescription drug plan under this section, the Secretary shall negotiate with pharmaceutical manufacturers with respect to the purchase price of covered part D drugs and shall encourage the use of more affordable therapeutic equivalents to the extent such practices do not override medical necessity as determined by the prescribing physician. To the extent practicable and consistent with the previous sentence, the Secretary shall implement strategies similar to those used by other Federal purchasers of prescription drugs, and other strategies, to reduce the purchase cost of covered part D drugs.</text></subsection> 
<subsection id="H4925DF9DAECA491F98D829600068254C"><enum>(c)</enum><header>Medicare operated prescription drug plan defined</header><text>For purposes of this part, the term <term>medicare operated prescription drug plan</term> means a prescription drug plan that offers qualified prescription drug coverage and access to negotiated prices described in section 1860D–2(a)(1)(A). Such a plan may offer supplemental prescription drug coverage in the same manner as other qualified prescription drug coverage offered by other prescription drug plans.</text></subsection> 
<subsection id="H0F1CC3FC96F841FAA39049EF8365C92"><enum>(d)</enum><header>Monthly beneficiary premium</header> 
<paragraph id="HD2A0CF0CB0404E5DAAD900381F07E6FB"><enum>(1)</enum><header>Qualified prescription drug coverage</header><text>The monthly beneficiary premium for qualified prescription drug coverage and access to negotiated prices described in section 1860D–2(a)(1)(A) to be charged under a medicare operated prescription drug plan shall be uniform nationally. Such premium for months in 2006 shall be $35 and for months in succeeding years shall be based on the average monthly per capita actuarial cost of offering the medicare operated prescription drug plan for the year involved, including administrative expenses.</text></paragraph> 
<paragraph id="H6964E15714A24F36BA00596C8116CCFE"><enum>(2)</enum><header>Supplemental prescription drug coverage</header><text>Insofar as a medicare operated prescription drug plan offers supplemental prescription drug coverage, the Secretary may adjust the amount of the premium charged under paragraph (1).</text></paragraph> 
<paragraph id="H9533C574AAE54263A119FA02991B3B19"><enum>(3)</enum><header>Requirement for at least one plan with a <enum-in-header>$35</enum-in-header> premium in <enum-in-header>2006</enum-in-header></header><text>The Secretary shall ensure that at least one medicare operated prescription drug plan offered in 2006 has a monthly premium of $35. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4B282EBE2B7E42039376EEDA600CAC3"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="H57A564387BE54755959E68D592F9082B"><enum>(1)</enum><text>Section 1860D–3(a) of the <act-name parsable-cite="SSA">Social Security Act</act-name>, as added by section 101 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003, is amended by adding at the end the following new paragraph:</text>

<paragraph id="H75E53F256ABB4FE8BFC902EE8C764D4"><enum>(4)</enum><header>Availability of the medicare operated prescription drug plan</header> 
<subparagraph id="HCB4F69E81CFD45EA9521033D755DAD7D"><enum>(A)</enum><header>In general</header><text>A medicare operated prescription drug plan (as defined in section 1860D–11A(c)) shall be offered nationally in accordance with section 1860D–11A.</text></subparagraph> 
<subparagraph id="H9E2BA8DFE7A24BEDBC57D52C06CD6404"><enum>(B)</enum><header>Relationship to other plans</header> 
<clause id="H0347FF5B4A9E45168B23DCFC284EF96E"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), a medicare operated prescription drug plan shall be offered in addition to any qualifying plan or fallback prescription drug plan offered in a PDP region and shall not be considered to be such a plan purposes of meeting the requirements of this subsection.</text></clause> 
<clause id="HFB0F39A785044B2990FAE19174EF80"><enum>(ii)</enum><header>Designation as a fallback plan</header><text>Notwithstanding any other provision of this part, the Secretary may designate the medicare operated prescription drug plan as the fallback prescription drug plan for any fallback service area (as defined in section 1860D–11(g)(3)) determined to be appropriate by the Secretary.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF8479B1612174FB98E783D0859966E40"><enum>(2)</enum><text>Section 1860D–13(c)(3) of such Act, as added by such section, is amended—</text> 
<subparagraph id="HC07C0D9320B546EDBEACD12782023A9"><enum>(A)</enum><text>in the heading, by inserting <quote>and medicare operated prescription drug plans</quote> after <quote>Fallback plans</quote>; and</text></subparagraph> 
<subparagraph id="H989CE462841342E68746729E6B9EE9F6"><enum>(B)</enum><text>by inserting <quote>or a medicare operated prescription drug plan</quote> after <quote>a fallback prescription drug plan</quote>.</text></subparagraph></paragraph> 
<paragraph id="HB1065A523A974A8BBBF697209C2F958"><enum>(3)</enum><text>Section 1860D–16(b)(1) of such Act, as added by such section, is amended—</text> 
<subparagraph id="H88B22F16EF53493292F7F55D71A32505"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>and</quote> after the semicolon at the end;</text></subparagraph> 
<subparagraph id="H10E91A987832429D93B164DDBD1D90E2"><enum>(B)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text> 
<quoted-block id="H2286609950A144F3A8CCF8414E64F100"> 
<subparagraph id="H0360B0166042440483E300F14243F963"><enum>(E)</enum><text>payments for expenses incurred with respect to the operation of medicare operated prescription drug plans under section 1860D–11A.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H912CDE635DBB4500976CF69B29B4BFB0"><enum>(4)</enum><text>Section 1860D–41(a) of such Act, as added by such section, is amended by adding at the end the following new paragraph:</text>

<paragraph id="H72EC81DA05D44E8489F3D3A232997C56"><enum>(19)</enum><header>Medicare operated prescription drug plan</header><text>The term <term>medicare operated prescription drug plan</term> has the meaning given such term in section 1860D–11A(c).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6B5DBD42C0D044BD9D09C0A9B3E61706"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as if included in the enactment of section 101 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003.</text></subsection></section>
