<official-title>To extinguish the reversionary interests and use restrictions relating to industrial use purposes for certain deeds in Nez Perce County, Idaho.</official-title>

<section id="H183848DA90F94A14A8C15DD19F61383E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Port of Lewiston Development Act of 2004</short-title></quote>.</text> </section> 
<section id="HD15410E3D7564BD1AAC7D899457CCD13"><enum>2.</enum> <header>Extinguishment of reversionary interests and use restrictions</header> 
<subsection id="HFD388A231D3E411E8F8515002CB3538"><enum>(a)</enum> <header>In general</header><text>With respect to each deed listed in subsection (b)—</text> 
<paragraph id="H7937FB3888BE48EAA9492BB13B75C3F5"><enum>(1)</enum><text>the reversionary interests and use restrictions relating to industrial use purposes are extinguished;</text></paragraph> 
<paragraph id="H4571D28F29B440EEAE049FBB4C082F23"><enum>(2)</enum><text>the restriction that no activity shall be permitted that will compete with services and facilities offered by public marinas is extinguished;</text></paragraph> 
<paragraph id="HC6F27F5E17354E52852391F0FEB99EC6"><enum>(3)</enum><text>the human habitation or other building structure use restriction is extinguished in each area in which the elevation is above the standard project flood elevation; and</text></paragraph> 
<paragraph id="H73FB84C21DAB4B01BCE720E7004312DC"><enum>(4)</enum><text>the use of fill material to raise low areas above the standard project flood elevation is authorized, except in any low area constituting wetland for which a permit under section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) is required.</text> </paragraph></subsection> 
<subsection id="H31FA346F89D94493001F413F57686FA5"><enum>(b)</enum> <header>Affected deeds</header><text>The deeds referred to in subsection (a) are as follows:</text> 
<paragraph id="H6DA00866E8CE42B2B4ED2BEE82F2AFF"><enum>(1)</enum> <text>Auditor's Instrument No. 399218 of Nez Perce County, Idaho—2.07 acres.</text> </paragraph> 
<paragraph id="HE7D4C1C30AE640C2B1F691C16311AC60"><enum>(2)</enum> <text>Auditor's Instrument No. 487437 and 399341 of Nez Perce County, Idaho—7.32 acres.</text> </paragraph> </subsection> 
<subsection id="H3E28D6A07D5D4CFFA32B25C76DFC08C5"><enum>(c)</enum> <header>No effect of other rights</header><text>Nothing in this section affects the remaining rights and interests of the Corps of Engineers for authorized project purposes.</text> </subsection> </section>
