<official-title>To promote the development of the emerging commercial human space flight industry, to extend the liability indemnification regime for the commercial space transportation industry, to authorize appropriations for the Office of the Associate Administrator for Commercial Space Transportation, and for other purposes.</official-title>

<section id="HA2FA87B8A53340FFADB1CD60C1D61282" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text> </section> 
<section id="H2E64B502363C416398184C7D878C0011"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text> 
<paragraph id="H3CC733A79D61442B9C72A2B604479913"><enum>(1)</enum><text>the goal of opening space to the American people and their private commercial, scientific, and cultural enterprises should guide Federal space investments, policies, and regulations;</text></paragraph> 
<paragraph id="H0EFC9012514D4432B4E583584E7B32FA"><enum>(2)</enum><text>private industry has begun to develop commercial launch vehicles capable of carrying human beings into space, and greater private investment in these efforts will stimulate the Nation’s commercial space transportation industry as a whole;</text></paragraph> 
<paragraph id="H3B0B82F14E174C0387977D067F6FE6CF"><enum>(3)</enum><text>space transportation is inherently risky;</text></paragraph> 
<paragraph id="H16B69E663E344FEB95F2BCB22216FF2E"><enum>(4)</enum><text>a critical area of responsibility for the Office of the Associate Administrator for Commercial Space Transportation is to regulate the emerging commercial human space flight industry; and</text></paragraph> 
<paragraph id="H0350FA8C3D3D472FB8A1D4E5DDFEA9A3"><enum>(5)</enum><text>the public interest is served by creating a clear legal and regulatory regime for commercial human space flight.</text></paragraph></section> 
<section id="H7A101F0C4E9B4C7F897C595FA7295B25"><enum>3.</enum><header>Amendments</header> 
<subsection id="HA51C7F91C7C34A30AAFCEBC0A531A83"><enum>(a)</enum><header>Findings and purposes</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/70101">Section 70101</external-xref> of title 49, United States Code, is amended—</text> 
<paragraph id="HA1DDA00419B4425AA4987F4148C4361C"><enum>(1)</enum><text>in subsection (a)(3), by inserting <quote>human space flight,</quote> after <quote>microgravity research,</quote>; and</text></paragraph> 
<paragraph id="H727BF4A3384D40D9A214E326E4360035"><enum>(2)</enum><text>in subsection (a)(4)—</text> 
<subparagraph id="H1E9C962DB7694386AFCABB17CEFF19D2"><enum>(A)</enum><text>by striking <quote>satellite</quote>; and</text></subparagraph> 
<subparagraph id="H29F38A45B46C477AAD496E6E2CBF4290"><enum>(B)</enum><text>by striking <quote>services now available from</quote> and inserting <quote>capabilities of</quote>.</text></subparagraph></paragraph> </subsection> 
<subsection id="H34D8F4C3A5FC49F383964C31415039F9"><enum>(b)</enum><header>Definitions</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/70102">Section 70102</external-xref> of title 49, United States Code, is amended—</text> 
<paragraph id="H1CD487E026D24942BAFF2E23DF470027"><enum>(1)</enum><text>by redesignating paragraphs (2) through (17) as paragraphs (3), (4), (5), (6), (7), (8), (9), (10), (12), (13), (14), (15), (16), (18), (21), and (22), respectively;</text></paragraph> 
<paragraph id="H43A681658AC647BDAF6D404C30918CBE"><enum>(2)</enum><text>by inserting after paragraph (1) the following new paragraph:</text> 
<quoted-block id="H06EB1543F80B40968100FC54CE307605" style="OLC"> 
<paragraph id="H6D6877613B064BAFBED0BF512E47FA8F"><enum>(2)</enum><text><quote>crew</quote> means any employee of a licensee or transferee, or of a contractor or subcontractor of a licensee or transferee, who performs activities in the course of that employment directly relating to the launch, reentry, or other operation of or in a launch vehicle or reentry vehicle that carries human beings.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HCEF6B366CEAD4D1882936DCF44E3B41"><enum>(3)</enum><text>in paragraph (4), as so redesignated by paragraph (1) of this subsection, by inserting <quote>, crew, or space flight participant</quote> after <quote>any payload</quote>; </text></paragraph> 
<paragraph id="H3ABA4078561D44A8B0F200978DC72500"><enum>(4)</enum><text>in paragraph (6)(A), as so redesignated by paragraph (1) of this subsection, by striking <quote>and payload</quote> and inserting <quote>, payload, crew (including crew training), or space flight participant</quote>;</text></paragraph>

<paragraph id="HE7757160038141E8B3C41B421CD416CB"><enum>(7)</enum><text>in paragraph (13), as so redesignated by paragraph (1) of this subsection, by inserting <quote>crew, or space flight participants,</quote> after <quote>and its payload,</quote>; </text></paragraph> 
<paragraph id="H6E430F769632415DAB00062252206F29"><enum>(8)</enum><text>in paragraph (14)(A), as so redesignated by paragraph (1) of this subsection, by striking <quote>and its payload</quote> inserting <quote>and payload, crew (including crew training), or space flight participant</quote>; </text></paragraph>

<paragraph id="HD14168FDBCE840B8B74392221EF3D846"><enum>(17)</enum><text><quote>space flight participant</quote> means an individual, who is not crew, carried within a launch vehicle or reentry vehicle.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HDCB318FE5FC44880ABF976095BD7A9DC"><enum>(10)</enum><text>by inserting after paragraph (18), as so redesignated by paragraph (1) of this subsection, the following new paragraphs:</text> 
<quoted-block id="HD48CD095F8D54D0D9F00FD0B7529871" style="OLC"> 
<paragraph id="H75E5BC9383D0438EBE0781951192A173"><enum>(19)</enum><text><quote>suborbital rocket</quote> means a rocket-propelled vehicle intended for flight on a suborbital trajectory whose thrust is greater than its lift for the majority of the powered portion of its flight.</text></paragraph> 
<paragraph id="HB8835DE5FA1D49CAA53D00C556F5291"><enum>(20)</enum><text><quote>suborbital trajectory</quote> means the intentional flight path of a launch vehicle, reentry vehicle, or any portion thereof, whose vacuum instantaneous impact point does not leave the surface of the Earth.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H013D6FA39D44445E9014E6ED691B57D4"><enum>(11)</enum><text>in paragraph (21), as so redesignated by paragraph (1) of this subsection—</text> 
<subparagraph id="H712D919FC07E4C56984F6F00C78F00FA"><enum>(A)</enum><text>by striking <quote>or</quote> at the end of subparagraph (C);</text></subparagraph> 
<subparagraph id="HC5402A362BD146C3996BE891ECB6D1B"><enum>(B)</enum><text>by striking the period at the end of subparagraph (D) and inserting <quote>; or</quote>; and</text></subparagraph>

<subsection id="H5C917A2B1E0D4EAABE83DCE04B8204CB"><enum>(c)</enum><header>Commercial human space flight</header> 
<paragraph id="H70FDEE2137714A718C523BA80088922C" display-inline="yes-display-inline"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/49/70103">Section 70103(a)</external-xref> of title 49, United States Code, is amended by inserting <quote>, through the Associate Administrator for Commercial Space Transportation,</quote> after <quote>Secretary of Transportation</quote>.</text></paragraph> 
<paragraph id="H645BFE3F698C4B10AB8FC16979AF3ED2" indent="up1"><enum>(2)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/49/70103">Section 70103(b)(1)</external-xref> of title 49, United States Code, is amended by inserting <quote>, including those involving space flight participants</quote> after <quote>private sector</quote>.</text></paragraph> 
<paragraph id="H41F921FA0E534148801FE7B5B4DDFEDE" indent="up1"><enum>(3)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/49/70104">Section 70104(a)</external-xref> of title 49, United States Code, is amended—</text> 
<subparagraph id="HE81A7326B20E48429E2693BC015B1704"><enum>(A)</enum><text>by striking <quote><header-in-text level="subsection">License Requirement.—</header-in-text>A license issued or transferred under this chapter</quote> and inserting <quote><header-in-text level="subsection">Requirement.—</header-in-text>A license issued or transferred under this chapter, or a permit,</quote>; and</text></subparagraph> 
<subparagraph id="HEBB3A52D1C6C4FBBACB2A8AF3021B49F"><enum>(B)</enum><text>by inserting after paragraph (4) the following:</text> 
<quoted-block style="OLC" id="HEA50964B8CB9487A812E5EF3842DB3F" display-inline="no-display-inline"><quoted-block-continuation-text quoted-block-continuation-text-level="section">Notwithstanding this subsection, a permit shall not authorize a person to operate a launch site or reentry site.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H0821908614D1458193CFE2C0E68C7619" indent="up1"><enum>(4)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/49/70104">Section 70104(b)</external-xref> of title 49, United States Code, is amended by inserting <quote>or permit</quote> after <quote>holder of a license</quote>.</text></paragraph> 
<paragraph id="HABCAA841EA644430B158B5B5E0C47827" indent="up1"><enum>(5)</enum><text>The section heading of <external-xref legal-doc="usc" parsable-cite="usc/49/70105">section 70105</external-xref> of title 49, United States Code, is amended by striking <quote><header-in-text level="subsection">License applications</header-in-text></quote> and inserting <quote><header-in-text level="subsection">Applications</header-in-text></quote>, and the item relating to that section in the table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/701">chapter 701</external-xref> of title 49, United States Code, is amended accordingly.</text></paragraph> 
<paragraph id="H04C79AD8ACA84292B1595024BE2BFFA4" indent="up1"><enum>(6)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/49/70105">Section 70105(a)</external-xref> of title 49, United States Code, is amended—</text> 
<subparagraph id="H8CEE8D9C2BFF42BB95DAA61784D13BB"><enum>(A)</enum><text>by striking <quote><header-in-text level="subsection">Applications.— </header-in-text></quote> and inserting <quote><header-in-text level="subsection">Licenses.—</header-in-text></quote>;</text></subparagraph> 
<subparagraph id="HF275E8D2539348FBB2813736AD9166B8"><enum>(B)</enum><text>in paragraph (1), by striking <quote>subsection (b)(2)(D)</quote> both places it appears and inserting <quote>subsection (c)(2)(D)</quote>; and</text> </subparagraph> 
<subparagraph id="H7693849AD7B94563B8D7B6007DBFF7E5"><enum>(C)</enum><text>in paragraph (2), by inserting <quote>, including crews,</quote> after <quote>or personnel</quote>.</text></subparagraph></paragraph> 
<paragraph id="H3BB13848C6484890BED3871498CC879B" indent="up1"><enum>(7)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/49/70105">Section 70105</external-xref> of title 49, United States Code, is amended by redesignating subsections (b) and (c) as subsections (c) and (d), respectively, and by inserting after subsection (a) the following new subsection:</text> 
<quoted-block style="OLC" id="H5EF6C76EC05745A0ABAE49E4CCA46688" display-inline="no-display-inline"> 
<subsection id="H6A8FD7840E0E4D7284016FF85800834B"><enum>(b)</enum><header>Experimental permits</header> 
<paragraph id="H02AA8BA1B8304CAB9716D359A8A01500" display-inline="yes-display-inline"><enum>(1)</enum><text>A person may apply to the Secretary of Transportation for an experimental permit under this subsection in the form and manner the Secretary prescribes. Consistent with the public health and safety, safety of property, and national security and foreign policy interests of the United States, the Secretary, not later than 90 days after receiving an application pursuant to this subsection, shall issue a permit if the Secretary decides in writing that the applicant complies, and will continue to comply, with this chapter and regulations prescribed under this chapter. The Secretary shall inform the applicant of any pending issue and action required to resolve the issue if the Secretary has not made a decision not later than 60 days after receiving an application. The Secretary shall transmit to the Committee on Science of the House of Representatives and Committee on Commerce, Science, and Transportation of the Senate a written notice not later than 15 days after any occurrence when a permit is not issued within the deadline established by this subsection.</text></paragraph> 
<paragraph id="H6DF9E2E673DF4A3899DECAC1F1A471B4" indent="up1"><enum>(2)</enum><text>In carrying out paragraph (1), the Secretary may establish procedures for safety approvals of launch vehicles, reentry vehicles, safety systems, processes, services, or personnel, including crews, that may be used in conducting commercial space launch or reentry activities pursuant to a permit.</text></paragraph> 
<paragraph id="HBA55DDE68A564C0D9E42B9153D620062" indent="up1"><enum>(3)</enum><text>In order to encourage the development of a commercial space flight industry, the Secretary, to the greatest extent practicable, shall when issuing permits use the authority granted under subsection (c)(2)(C).</text></paragraph> 
<paragraph id="H72124259B67140AE9805FEC6E9322E12" indent="up1"><enum>(4)</enum><text>The Secretary may issue a permit only for reusable suborbital rockets that will be launched or reentered solely for—</text> 
<subparagraph id="H60894D40B5ED427AA9E998F850353F1F"><enum>(A)</enum><text>research and development to test new design concepts, new equipment, or new operating techniques;</text></subparagraph> 
<subparagraph id="H20D6A0C8B5A449CDBAF2B0785CBFFA78"><enum>(B)</enum><text>showing compliance with requirements as part of the process for obtaining a license under this chapter; or</text></subparagraph> 
<subparagraph id="HFA38F5CD63EC41D58BA7B37D62CEB24F"><enum>(C)</enum><text>crew training prior to obtaining a license for a launch or reentry using the design of the rocket for which the permit would be issued.</text></subparagraph></paragraph> 
<paragraph id="H8813AF5469A54FB8B0D6ACA3697900B3" indent="up1"><enum>(5)</enum><text>Permits issued under this subsection shall—</text> 
<subparagraph id="HD257D9BA6D5B42498508AF303B69893E"><enum>(A)</enum><text>authorize an unlimited number of launches and reentries for a particular suborbital rocket design for the uses described in paragraph (4); and</text></subparagraph> 
<subparagraph id="H149A531F71F6493DA921D4BD12DA28"><enum>(B)</enum><text>specify the modifications that may be made to the suborbital rocket without changing the design to an extent that would invalidate the permit.</text></subparagraph></paragraph> 
<paragraph id="H8396DA2566014DD88C4219F41BBE7F54" indent="up1"><enum>(6)</enum><text>Permits shall not be transferable.</text></paragraph> 
<paragraph id="H7B6392BC31C04D80A64980B6C4E934D4" indent="up1"><enum>(7)</enum><text>A permit may not be issued for, and a permit that has already been issued shall cease to be valid for, a particular design for a reusable suborbital rocket after a license has been issued for the launch or reentry of a rocket of that design.</text></paragraph> 
<paragraph id="HF94402C32F6E4283A0498DA1178567C5" indent="up1"><enum>(8)</enum><text>No person may operate a reusable suborbital rocket under a permit for carrying any property or human being for compensation or hire.</text></paragraph> 
<paragraph id="H6C99B6F639EF47B4BD2904F230CE3841" indent="up1"><enum>(9)</enum><text>For the purposes of sections 70106, 70107, 70108, 70109, 70110, 70112, 70115, 70116, 70117, and 70121 of this chapter—</text> 
<subparagraph id="HE98C492165324D33923F07FE6D5593B6"><enum>(A)</enum><text>a permit shall be considered a license;</text></subparagraph> 
<subparagraph id="H77DDC6C039094ACC8189AD5E31413D00"><enum>(B)</enum><text>the holder of a permit shall be considered a licensee;</text></subparagraph> 
<subparagraph id="H0B06A23A06504AA18634AE048C40801B"><enum>(C)</enum><text>a vehicle operating under a permit shall be considered to be licensed; and</text></subparagraph> 
<subparagraph id="HFA617F401C2F41B39D002CBFE3575702"><enum>(D)</enum><text>the issuance of a permit shall be considered licensing.</text></subparagraph><continuation-text continuation-text-level="paragraph">This paragraph shall not be construed to allow the transfer of a permit.</continuation-text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H33582D7F6E40493ABF4C1346F9412357" indent="up1"><enum>(8)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/49/70105">Section 70105(c)(1)</external-xref> of title 49, United States Code, as so redesignated by paragraph (7) of this subsection, is amended by inserting <quote>or permit</quote> after <quote>for a license</quote>. </text> </paragraph> 
<paragraph id="HC47913F49E9E4C80807DA31E00E7BB4B" indent="up1"><enum>(9)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/49/70105">Section 70105(c)(2)(B)</external-xref> of title 49, United States Code, as so redesignated by paragraph (7) of this subsection, is amended by striking <quote>an additional requirement</quote> and inserting <quote>any additional requirement</quote>.</text> </paragraph> 
<paragraph id="H18F0AFE9F1524E89A9B209E05EFBAE" indent="up1"><enum>(10)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/49/70105">Section 70105(c)(2)(C)</external-xref> of title 49, United States Code, as so redesignated by paragraph (7) of this subsection, is amended by inserting <quote>or permit</quote> after <quote>for a license</quote>.</text> </paragraph> 
<paragraph id="H30083DE815444A9D8D512889995FC4C0" indent="up1"><enum>(11)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/49/70105">Section 70105(c)(2)(D)</external-xref> of title 49, United States Code, as so redesignated by paragraph (7) of this subsection, is amended by inserting <quote>or permit</quote> after <quote>for a license</quote>.</text></paragraph> 
<paragraph id="HBA0E315CE43E4BD69953E3F8623188C5" indent="up1"><enum>(12)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/49/70105">Section 70105(c)(3)</external-xref> of title 49, United States Code, as so redesignated by paragraph (7) of this subsection, is amended—</text> 
<subparagraph id="H95C1F302D2354D348B27A7C9F3BC4577"><enum>(A)</enum><text>by striking <quote>, including the requirement to obtain a license,</quote>; and</text></subparagraph> 
<subparagraph id="H96867F8A85064194A85000FE1703848D"><enum>(B)</enum><text>by adding at the end the following: <quote>Nothing in this paragraph shall be construed to allow the launch or reentry of a launch vehicle or a reentry vehicle without a license or permit if a human being will be on board.</quote>.</text></subparagraph> </paragraph> 
<paragraph id="H6B004760D035431D80D81D1048438043" display-inline="no-display-inline" indent="up1"><enum>(13)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/49/70105">Section 70105(c)</external-xref> of title 49, United States Code, as so redesignated by paragraph (7) of this subsection, is amended by adding at the end the following new paragraphs:</text> 
<quoted-block id="HF566D4EC767F4B498958F3B1E4D1475" style="OLC"> 
<paragraph id="H7297DF1B91144A28A282183F113EF771" indent="up1"><enum>(4)</enum><text>The holder of a license or a permit under this chapter may launch or reenter crew only if—</text> 
<subparagraph id="HB3DC64449E154B15AEED146D654E0145"><enum>(A)</enum><text>the crew has received training and has satisfied medical or other standards specified in the license or permit in accordance with regulations promulgated by the Secretary; and</text></subparagraph> 
<subparagraph id="H1980ECA1E9FA4CE79C25B23BD47D00AB"><enum>(B)</enum><text>the holder of the license or permit and crew have complied with all requirements of the laws of the United States that apply to crew.</text></subparagraph></paragraph> 
<paragraph id="H34781A7AEC7F453AA8E8678411F3253" indent="up1"><enum>(5)</enum><text>The holder of a license or a permit under this chapter may launch or reenter a space flight participant only if—</text> 
<subparagraph id="H6731CCB2C6414592BD942BC064F78868"><enum>(A)</enum><text>in accordance with regulations promulgated by the Secretary, the holder of the license or permit has informed the space flight participant in writing about the risks of the launch or reentry, including the safety record of the launch or reentry vehicle type, and the space flight participant has provided written informed consent to participation in the launch or reentry; and</text></subparagraph> 
<subparagraph id="H7DAC8419B1F84DEEB2800008142557F3"><enum>(B)</enum><text>the holder of the license or permit and space flight participant have complied with all requirements of the laws of the United States related to launching or reentering a space flight participant.</text></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<subsection id="HEC2541B291774B5D94798389C891D744"><enum>(c)</enum><header>Amendments</header><text>Not later than 12 months after the date of enactment of the Commercial Space Launch Amendments Act of 2004, the Secretary shall publish proposed regulations to carry out that Act, including regulations relating to crew, space flight participants, and permits for launch or reentry of reusable suborbital rockets. Not later than 18 months after such date of enactment, the Secretary shall issue final regulations.</text></subsection> 
<subsection id="HD9D4C0CD3F8D41B680C4701C1197FAF"><enum>(d)</enum><header>Effective date</header><text></text> 
<paragraph id="H44CAA905CDB24EDD002BE394DCEB1C37" display-inline="yes-display-inline"><enum>(1)</enum><text>Licenses for the launch or reentry of launch vehicles or reentry vehicles with human beings on board and permits may be issued by the Secretary prior to the issuance of the regulations described in subsection (c). </text></paragraph> 
<paragraph id="H5964B2A7EB3E4002B05921A505DBDF81" indent="up1"><enum>(2)</enum><text>As soon as practicable after the date of enactment of the Commercial Space Launch Amendments Act of 2004, the Secretary shall issue guidelines or advisory circulars to guide the implementation of that Act until regulations are issued. </text></paragraph> 
<paragraph id="H917F26EBF7A84619978EFE33F446965B" indent="up1"><enum>(3)</enum><text>Notwithstanding paragraphs (1) and (2), no licenses for the launch or reentry of launch vehicles or reentry vehicles with human beings on board or permits may be issued starting three years after the date of enactment of the Commercial Space Launch Amendments Act of 2004 unless the final regulations described in subsection (c) have been issued.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HC287FFEB0C2D41B8BDCD336CB88435C6"><enum>4.</enum><header>Study on the gradual elimination of commercial space transportation liability risk sharing regime</header><text display-inline="no-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of Transportation shall enter into an appropriate arrangement with the National Academy of Public Administration to conduct a study of how best to gradually eliminate the liability risk sharing regime in the United States for commercial space transportation under <external-xref legal-doc="usc" parsable-cite="usc/49/70113">section 70113</external-xref> of title 49, United States Code. The study shall assess methods by which the liability risk sharing regime could be eliminated by 2008 or as soon as possible thereafter and the impact those methods would be likely to have on the commercial space transportation industry. The methods examined shall include incremental approaches.</text></section> 
<section id="H0EEF1F92E13A4327B57C11FE3D5D7352"><enum>5.</enum><header>Technical amendment</header><text display-inline="no-display-inline">Section 102(c) of the Commercial Space Act of 1998 is repealed.</text></section>
