<section id="H220169983E4743929ECE78CDFEF86B7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Wallowa Lake Dam Rehabilitation and Water Management Act of 2004</quote>.</text></section>
<section id="HDA286362878E4716A2B932DDCCCC1476"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H003097CF8E314DC0802982C77E35D5DC"><enum>(1)</enum><header>Associated ditch companies, incorporated</header><text>The term <term>Associated Ditch Companies, Incorporated</term> means the non-profit corporation by that name (as established under the laws of the State of Oregon) that operates Wallowa Lake Dam.</text></paragraph>
<paragraph id="H5180231728AF4A0FB0AE216C6589B859"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Commissioner of Reclamation.</text></paragraph>
<paragraph id="HE968B88736E34F34A244575EA450A0D9"><enum>(3)</enum><header>Wallowa lake dam rehabilitation program</header><text>The term <term>Wallowa Lake Dam Rehabilitation Program</term> means the program for the rehabilitation of the Wallowa Lake Dam in Oregon, as contained in the engineering document entitled, <quote>Phase I Dam Assessment and Preliminary Engineering Design</quote>, dated October 2001, and on file with the Bureau of Reclamation.</text></paragraph>
<paragraph id="HF076FD19CD3E401199DF1EC3CC94421"><enum>(4)</enum><header>Wallowa valley water management plan</header><text>The term <term>Wallowa Valley Water Management Plan</term> means the program developed for the Wallowa River watershed, as contained in the document entitled <quote>Wallowa Lake Dam Rehabilitation and Water Management Plan Vision Statement</quote>, dated February 2001, and on file with the Bureau of Reclamation.</text></paragraph></section>
<section id="HDE07701F7BB545919B8B7378004E1FB8"><enum>3.</enum><header>Authorization to participate in program</header>
<subsection id="HE6FE2B8158D343649DC8CC683044B280"><enum>(a)</enum><header>Authorization</header><text>The Secretary—</text>
<paragraph id="H28916187879A4F798F3387F7F4266F5C"><enum>(1)</enum><text>may provide funding to the Associated Ditch Companies, Incorporated, in order for the Associated Ditch Companies, Incorporated, to plan, design and construct facilities needed to implement the Wallowa Lake Dam Rehabilitation Program; and</text></paragraph>
<paragraph id="HAA5444C3BF504642B064D5CBC5FB383"><enum>(2)</enum><text>in cooperation with tribal, State and local governmental entities, may participate in planning, design and construction of facilities needed to implement the Wallowa Valley Water Management Plan.</text></paragraph></subsection>
<subsection id="HF68BA73CB193470F81BCB7BF003640"><enum>(b)</enum><header>Cost sharing</header>
<paragraph id="H50C754020877485795B4B426AA40711D"><enum>(1)</enum><header>In general</header><text>The Federal share of the costs of activities authorized under this Act shall not exceed 80 percent.</text></paragraph>
<paragraph id="H35778E8F449543CD8850758B5897CC17"><enum>(2)</enum><header>Exclusions from federal share</header><text>There shall not be credited against the Federal share of such costs—</text>
<subparagraph id="HA7D489A391C04548A433F68C15BA859D"><enum>(A)</enum><text>any expenditure by the Bonneville Power Administration in the Wallowa River watershed; and</text></subparagraph>
<subparagraph id="HADB4CCB80A2C40A9AE9010E3BC84454"><enum>(B)</enum><text>expenditures made by individual farmers in any Federal farm or conservation program.</text></subparagraph></paragraph></subsection>
<subsection id="HC12A48B7A1B34245A8002BC3A0D76BCD"><enum>(c)</enum><header>Compliance with state law</header><text>The Secretary, in carrying out this Act, shall comply with otherwise applicable State water law.</text></subsection>
<subsection id="H8FACCA548D7349A5A9C56192C495B06C"><enum>(d)</enum><header>Prohibition on holding title</header><text>The Federal Government shall not hold title to any facility rehabilitated or constructed under this Act.</text></subsection>
<subsection id="HE5EB296669084C11B98E6000FBA613CF"><enum>(e)</enum><header>Prohibition on operation and maintenance</header><text>The Federal Government shall not be responsible for the operation and maintenance of any facility constructed or rehabilitated under this Act.</text></subsection>
<subsection id="HE7D05ABDFA194EE3A6669B6B984D5488"><enum>(f)</enum><header>Ownership and operation of fish passage facility</header><text>Any facility located at Wallowa Lake Dam for trapping and transportation of migratory adult salmon may be owned and operated only by the Nez Perce Tribe.</text></subsection></section>
<section id="HA15A9238AAC1416C0080F989AFC23E8"><enum>4.</enum><header>Relationship to other law</header><text display-inline="no-display-inline">Activities funded under this Act shall not be considered a supplemental or additional benefit under the Act of June 17, 1902 (32 Stat. 388), and all Acts amendatory thereof or supplementary thereto.</text></section>
<section id="H95FDD389729E4A33A865F9CF5DA8DCD6"><enum>5.</enum><header>Appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Secretary $32,000,000 for the Federal share of the costs of activities authorized under this Act.</text></section>
