<official-title>To amend title 46, United States Code, to provide a monthly monetary benefit to certain individuals who served in the United States merchant marine (including the Army Transport Service and the Naval Transport Service) during World War II.</official-title>

<section id="H4330877DDD38473086939B0060756EA7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Belated Thank You to the Merchant Mariners of World War II Act of 2004</quote>. </text></section> 
<section id="HFAF64BABCB204926826D5B69E4093194"><enum>2.</enum><header>Benefits for World War II merchant mariners and survivors</header> 
<subsection id="H3E59903549464711B91FE426ED1CB49C"><enum>(a)</enum><header>Monthly benefit</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/112">Chapter 112</external-xref> of title 46, United States Code, is amended—</text> 
<paragraph id="H9C65920822FD40C6911D28B8B6D338B8"><enum>(1)</enum><text>by inserting after the table of sections the following new subchapter heading: </text>

<subchapter id="HFB4DCCB0C06B40C099DCE1AC8E3000D0"><enum>I</enum><header>Veterans’ burial and cemetery benefits</header></subchapter><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4E9AE046B6E74BF49924BC1E00FDA73F" indent="up1"><enum>and</enum></paragraph> 
<paragraph id="HAA5790B3005348D6989F4819D8A9DB23"><enum>(2)</enum><text>by adding at the end the following new subchapter:</text>

<subchapter id="HA66C4586EB2C462799685C77593E6475"><enum>II</enum><header>Monthly benefit</header> 
<section id="HFF606B89BC9D450A955EB7CA283047FD"><enum>11205.</enum><header>Monthly benefit</header> 
<subsection id="HAC71F890F0CF4AE6B579BE3500B474B7"><enum>(a)</enum><header>Payment to eligible persons</header><text>The Secretary of Veterans Affairs shall pay to each person eligible for benefits under section 11206 of this title a monthly benefit of $1,000.</text></subsection> 
<subsection id="HF325B4B287E840DDA5AC04A8564F92F8"><enum>(b)</enum><header>Surviving spouses of eligible persons</header><text></text> 
<paragraph id="H413A7F6CD0B645E08D8E36C89EC4A686"><enum>(1)</enum><header>Payment to surviving spouses</header><text>The Secretary of Veterans Affairs shall pay to the surviving spouse of each person eligible for benefits under section 11206 of this title a monthly benefit of $1,000.</text></paragraph> 
<paragraph id="HDE0CCE170FCB41E19FC8D6BA386B9F2"><enum>(2)</enum><header>Exclusion</header><text>No benefit under this subsection shall be paid to a surviving spouse of a person eligible for benefits under section 11206 of this title unless such surviving spouse was married to such eligible person for no less than 1 year.</text></paragraph></subsection> 
<subsection id="H52A43261CB494531BCAD08D7ACA92325"><enum>(c)</enum><header>Children of eligible persons</header><text>If there is no surviving spouse entitled to benefits under this section, the Secretary of Veterans Affairs shall pay to the children of each person eligible for benefits under section 11206 of this title a monthly benefit of $1,000, equally divided.</text></subsection> 
<subsection id="H7AA392AA6F674DF200003D0004C23BD0"><enum>(d)</enum><header>Exemption from taxation</header><text>Payments of benefits under this section are exempt from taxation as provided in <external-xref legal-doc="usc" parsable-cite="usc/38/5301">section 5301(a)</external-xref> of title 38.</text></subsection></section> 
<section id="H92DC345D39974348B2616F8BD27FD3E2"><enum>11206.</enum><header>Eligibility for benefit</header> 
<subsection id="H8D45E0F748E24B9F977E6D63354ED8AC"><enum>(a)</enum><header>Eligible persons</header><text>A person referred to in subsection (b) who has performed qualified service as specified under subsection (c) shall be eligible for benefits under section 11205(a) of this title.</text></subsection> 
<subsection id="HE26D4983C9444C13A5116B7845F92238"><enum>(b)</enum><header>Covered persons</header><text>Subsection (a) applies to a person who receives an honorable service certificate under section 11207 of this title.</text></subsection> 
<subsection id="H345F7FC94B354F6A87E1064B50193310"><enum>(c)</enum><header>Qualified Service</header><text>A person shall be considered to have engaged in qualified service if, between December 7, 1941, and December 31, 1946—</text> 
<paragraph id="HA9639DC4728249CD8578F448B672A2FC"><enum>(1)</enum><text>the person—</text> 
<subparagraph id="H60B2B941D4F548FBB81DE34F7D044793"><enum>(A)</enum><text>was a member of the United States merchant marine (including the Army Transport Service and the Naval Transport Service) serving as a crewmember of a vessel that was—</text> 
<clause id="H7A77EAD7E30E44AAB6FD4651B9FA528B"><enum>(i)</enum><text>operated by the War Shipping Administration or the Office of Defense Transportation (or an agent of the Administration or Office);</text></clause> 
<clause id="HD43DF6370DFF4B4793C70804903CECA"><enum>(ii)</enum><text>operated in waters other than inland waters, the Great Lakes, and other lakes, bays, and harbors of the United States;</text></clause> 
<clause id="H1356DD81A8284E4BB018FF5CE4125BFD"><enum>(iii)</enum><text>under contract or charter to, or property of, the Government of the United States; and</text></clause> 
<clause id="H2B5F3AEA5C4D49F5B86BD8A1FD26EC16"><enum>(iv)</enum><text>serving the Armed Forces; and</text></clause></subparagraph> 
<subparagraph id="HC6FFF984FEF74DF091FDBBE2D70C796"><enum>(B)</enum><text>while so serving, was licensed or otherwise documented for service as a crewmember of such a vessel by an officer or employee of the United States authorized to license or document the person for such service; or</text></subparagraph></paragraph> 
<paragraph id="H2D3534D0EEC74B96BA00E8C2ADBC176F"><enum>(2)</enum><text>while performing service under paragraph (1), the person was forcibly detained or interned by an enemy government or hostile force as a result of action against a vessel under paragraph (1)(A).</text></paragraph></subsection></section> 
<section id="HE87697D932BE468DA2DC7150BCC58D9F"><enum>11207.</enum><header>Documentation of qualified service</header> 
<subsection id="HF52CD24939BC4282BCEB149D5F9E285C"><enum>(a)</enum><header>Application for service certificate</header><text>A person seeking benefits under section 11205 of this title shall submit an application for a service certificate to the Secretary of Transportation, or in the case of personnel of the Army Transport Service or the Naval Transport Service, the Secretary of Defense.</text></subsection> 
<subsection id="H009742612EDC4520A923E24C1D803E42"><enum>(b)</enum><header>Issuance of service certificate</header><text>The Secretary who receives an application under subsection (a) shall issue a certificate of honorable service to the applicant if, as determined by that Secretary, the person engaged in qualified service under section 11206(c) of this title.</text></subsection> 
<subsection id="H02235DD726834BE1AE4D3FEB825E916E"><enum>(c)</enum><header>Timing of documentation</header><text>A Secretary receiving an application under subsection (a) shall act on the application not later than 1 year after the date of that receipt.</text></subsection> 
<subsection id="HFEFDFAB326A949FCB11FA600ADC171A8"><enum>(d)</enum><header>Standards relating to service</header><text>In making a determination under subsection (b), the Secretary acting on the application shall apply the same standards relating to the nature and duration of service that apply to the issuance of honorable discharges under section 401(a)(1)(B) of the GI Bill Improvement Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/38/106">38 U.S.C. 106</external-xref> note).</text></subsection></section> 
<section id="HE02715DBB92E4E168EC00E592A3FDFF"><enum>11208.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter, the terms <quote>surviving spouse</quote> and <quote>child</quote> have the meanings given those terms in paragraphs (3) and (4), respectively, of <external-xref legal-doc="usc" parsable-cite="usc/38/101">section 101</external-xref> of title 38, except that in applying those meanings in this subchapter, the term <quote>veteran</quote> shall include a person who performed qualified service as specified in section 11206(c) of this title.</text> </section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H36D830FC7B6D4B309651ECE4EAED073"><enum>(b)</enum><header>Conforming amendments</header><text>Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/46/11201">section 11201</external-xref> of title 46, United States Code, is amended—</text> 
<paragraph id="H90AC905D35324E839704245FAAB82BC2"><enum>(1)</enum><text>in paragraph (1), by striking <quote>chapter</quote> and inserting <quote>subchapter</quote>; and</text></paragraph> 
<paragraph id="H359E9E6F7F21446CABDD9157369129FD"><enum>(2)</enum><text>in paragraph (2), by striking <quote>chapter</quote> the second place it appears and inserting <quote>subchapter</quote>. </text></paragraph></subsection> 
<subsection id="H93998C1D953A4DB3A990189F88FB9464"><enum>(c)</enum><header>Clerical amendments</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/112">chapter 112</external-xref> of title 46, United States Code, is amended—</text>

<subsection id="HC6BDE35C43C5485884E3F6B8AAE35E15"><enum>(d)</enum><header>Effective date</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/11205">Section 11205</external-xref> of title 46, United States Code, as added by subsection (a) of this section, shall take effect with respect to payments for periods beginning on or after the date of the enactment of this Act, regardless of the date of application for benefits.</text></subsection></section> 
<section id="HE74985616C2544BC9B73EEC9738FA98E"><enum>3.</enum><header>Authorization of appropriation</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Department of Veterans Affairs such sums as are necessary to carry out this Act.</text></section>
