<official-title>To increase the penalties for violations by television and radio broadcasters of the prohibitions against transmission of obscene, indecent, and profane language.</official-title>

<section id="HF2650E5E4138487893E1E45CD6815FFD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title> of 2004</quote>.</text></section> 
<section id="HEB9BBC5F70294DEF99A3D232773175BE"><enum>2.</enum><header>Increase in penalties for obscene, indecent, and profane broadcasts</header><text display-inline="no-display-inline">Section 503(b)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/503">47 U.S.C. 503(b)(2)</external-xref>) is amended—</text> 
<paragraph display-inline="no-display-inline" id="H5EFBF0C2BA574F9FABC4520285E24B90"><enum>(1)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (D) and (E), respectively;</text></paragraph> 
<paragraph id="H534FC51756B2417A9F29B000B1463084"><enum>(2)</enum><text>by inserting after subparagraph (B) the following new subparagraph:</text> 
<quoted-block style="OLC" id="HBEAD70AA205244C7BD52C3441534764E" display-inline="no-display-inline"> 
<subparagraph id="H0BD05C548A494D7990135005F671649D" indent="up2"><enum>(C)</enum><text>Notwithstanding subparagraph (A), if the violator is (i) a broadcast station licensee or permittee, or (ii) an applicant for any broadcast license, permit, certificate, or other instrument or authorization issued by the Commission, and the violator is determined by the Commission under paragraph (1) to have broadcast obscene, indecent, or profane language, the amount of any forfeiture penalty determined under this section shall not exceed $275,000 for each violation or each day of a continuing violation, except that the amount assessed for any continuing violation shall not exceed a total of $3,000,000 for any single act or failure to act.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5966766BA2674F77A2643231E89250EF"><enum>(3)</enum><text>in subparagraph (D), as redesignated by <internal-xref idref="H5EFBF0C2BA574F9FABC4520285E24B90" legis-path="2.(1)">paragraph (1)</internal-xref>, by striking <quote>subparagraph (A) or (B)</quote> and inserting <quote>subparagraph (A), (B), or (C)</quote>. </text></paragraph> </section>
