<official-title>To authorize the extension of nondiscriminatory treatment (normal trade relations treatment) to the products of Kazakhstan.</official-title>

<section section-type="section-one" id="H850075CB5A6F46EE9E804C2FF839E2AB"><enum>1.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> 
<paragraph id="HBF54E37005F4409884C97FA8A800FCAB"><enum>(1)</enum><text>Kazakhstan has been found to be in full compliance with the freedom of emigration requirements under title IV of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name>.</text></paragraph> 
<paragraph id="H281D2B28CB994EC8B85DB9D17016A38F"><enum>(2)</enum><text>Since its independence from the Soviet Union in 1991, Kazakhstan has made progress toward creating a free-market economy system.</text></paragraph> 
<paragraph id="H42BF620BC5F14C608894C44EC4C36F1"><enum>(3)</enum><text> The Department of Commerce granted Kazakhstan <quote>market economy status</quote>, the first such designation of any independent state of the former Soviet Union, effective October 1, 2001.</text></paragraph> 
<paragraph id="H9CE08CAD062E49ABA1B8243EAB5342EC"><enum>(4)</enum><text>Kazakhstan concluded a bilateral investment treaty with the United States in 1992.</text></paragraph> 
<paragraph id="H052D5A73931B45D8AE1FDFD2C4FCBAA9"><enum>(5)</enum><text>Kazakhstan has demonstrated a strong desire to build a friendly and cooperative relationship with the United States.</text></paragraph> 
<paragraph id="H6ABDAF1FF36148A3B2F16FC4A5961000"><enum>(6)</enum><text>Kazakhstan is providing firm support in the ongoing allied campaign in Afghanistan by allowing coalition forces to use the air space of Kazakhstan and the country’s largest airport in Almaty.</text></paragraph> 
<paragraph id="H53270F8819A841DDB188421B2EFEE7CD"><enum>(7)</enum><text>Kazakhstan has taken an active role in the reconstruction of Iraq and is the only country in the region of Central Asia to send a military contingent of combat engineers, who have neutralized more than 300,000 explosive devices in Iraq, thereby saving thousands of lives.</text></paragraph> 
<paragraph id="H623ACA6AD8F744C9B700F00397B5B909"><enum>(8)</enum><text>The extension of unconditional normal trade relations treatment to the products of Kazakhstan will enable the United States to avail itself of all rights under the World Trade Organization with respect to Kazakhstan.</text></paragraph></section> 
<section id="HA739ECF8223146CEA8698BF7321CA5DA"><enum>2.</enum><header>Termination of application of title IV of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> to Kazakhstan</header> 
<subsection id="H16A656DAA4074C949BFE99D7A00891F8"><enum>(a)</enum><header>Presidential determinations and extensions of nondiscriminatory treatment</header><text>Notwithstanding any provision of title IV of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2431">19 U.S.C. 2431 et seq.</external-xref>), the President may—</text> 
<paragraph id="H8B6246179CDB4DAEBC90E608B1D8642E"><enum>(1)</enum><text>determine that such title should no longer apply to Kazakhstan; and</text></paragraph> 
<paragraph id="HE8E94E3E070E40EFB3A94EAF498518E7"><enum>(2)</enum><text>after making a determination under paragraph (1) with respect to Kazakhstan, proclaim the extension of nondiscriminatory treatment (normal trade relations treatment) to the products of that country.</text></paragraph></subsection> 
<subsection id="HE969CA4E7BCD4593BEE214FD173BFE34"><enum>(b)</enum><header>Termination of application of title IV</header><text>On and after the effective date of the extension under subsection (a)(2) of nondiscriminatory treatment to the products of Kazakhstan, title IV of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> shall cease to apply to that country.</text></subsection></section>
