<official-title>To protect the civil rights of victims of gender-motivated violence and to promote public safety, health, and regulate activities affecting interstate commerce by creating employer liability for negligent conduct that results in an individual’s committing a gender-motivated crime of violence against another individual on premises controlled by the employer.</official-title>

<section section-type="section-one" id="HECB5B659B03B45D3B0CD6E2C79BEF504"><enum>1.</enum><header>Negligently allowing gender-motivated violence</header><text display-inline="no-display-inline">An employer—</text> 
<paragraph id="HDEE8E99CF67E46BBB0713C27B1EE2D46"><enum>(1)</enum><text>whose business is in or affects interstate or foreign commerce; and</text></paragraph> 
<paragraph id="HD05972EE46654CFBA66F0094DD2E10D0"><enum>(2)</enum><text>whose negligent conduct results in a person’s (including a person who acts under color of statute, ordinance, regulation, custom, or usage of any State) committing a crime of violence motivated by gender against another person on premises under the control of the employer;</text></paragraph><continuation-text continuation-text-level="section">shall be liable to the party injured, in an action for the recovery of compensatory and punitive damages, injunctive and declaratory relief, and such other relief as a court may deem appropriate.</continuation-text></section> 
<section id="H7B6EC5207CFB4C01B863C5D32B4C2672"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act—</text> 
<paragraph id="HE6165DB781484A7486AFDCCD13F8D2AC"><enum>(1)</enum><text>the term <term>crime of violence motivated by gender</term> means a crime of violence committed because of gender or on the basis of gender; and</text></paragraph> 
<paragraph id="HAFF041987C0D47D7A800F9B9E3008433"><enum>(2)</enum><text>the term <term>crime of violence</term>—</text> 
<subparagraph id="H727D92C663B144D39B209986E7B6C0F3"><enum>(A)</enum><text>means an act or series of acts that would constitute a crime, for which imprisonment of more than one year may be imposed, against the person of another if that crime is a crime of violence as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/16">section 16</external-xref> of title 18, United States Code; and</text></subparagraph> 
<subparagraph id="H0B7F2A1655144B52A81B7451B632E62"><enum>(B)</enum><text>includes any conduct that would constitute a crime described in subparagraph (A) but for the relationship between the person engaging in that conduct and the individual against whom such conduct is directed.</text></subparagraph></paragraph></section> 
<section id="H17F7B2250288495384CB63670A273EB"><enum>3.</enum><header>Limitation and procedure</header> 
<subsection id="H352EDF956AB2477181296E235C70FF7B"><enum>(a)</enum><header>Limitation</header><text>Nothing in this Act entitles a person to a cause of action under section 1 for random acts of violence unrelated to gender or for acts that cannot be demonstrated, by a preponderance of the evidence, to be motivated by gender.</text></subsection> 
<subsection id="H58FF5D1801114067826CED797BA100AE"><enum>(b)</enum><header>No prior criminal action</header><text>Nothing in this section requires a prior criminal complaint, prosecution, or conviction to establish the elements of a cause of action under section 1.</text></subsection> 
<subsection id="H01DACE71A70F42AC8D6F53FAC06344A"><enum>(c)</enum><header>Concurrent jurisdiction</header><text>The Federal and State courts shall have concurrent jurisdiction over actions brought pursuant to this Act.</text></subsection></section> 
<section id="H2A176910C41340A993C14265005F4274"><enum>4.</enum><header>Materials to assist employers</header><text display-inline="no-display-inline">The Equal Employment Opportunity Commission shall create and provide materials to employers regarding personnel policies and safety standards to assist employers in avoiding liability under this Act.</text></section>
