bill; which was read twice and referred to the Committee on Environment 
                            and Public Works

                                 A BILL


 
 To amend the Clean Air Act to permit the Governor of a State to waive 
the oxygen content requirement for reformulated gasoline, and for other 
                               purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. WAIVER OF OXYGEN CONTENT REQUIREMENT FOR REFORMULATED 
              GASOLINE.

    Section 211(k)(1) of the Clean Air Act (42 U.S.C. 7545(k)(1)) is 
amended--
            (1) by striking ``Within 1 year after the enactment of the 
        Clean Air Act Amendments of 1990,'' and inserting the 
        following:
                    ``(A) In general.--Not later than November 15, 
                1991,''; and
            (2) by adding at the end the following:
                    ``(B) Waiver of oxygen content requirement.--
                            ``(i) In general.--Notwithstanding any 
                        other provision of this subsection, upon 
                        notification by the Governor of a State to the 
                        Administrator, a Governor may waive paragraphs 
                        (2)(B) and (3)(A)(v) with respect to gasoline 
                        sold or dispensed in the State.
                            ``(ii) Treatment as reformulated 
                        gasoline.--In the case of a State for which the 
                        Governor invokes the waiver described in clause 
                        (i), gasoline that complies with all provisions 
                        of this subsection other than paragraphs (2)(B) 
                        and (3)(A)(v) shall be considered to be 
                        reformulated gasoline for the purposes of this 
                        subsection.''.
