which was read twice and referred to the Committee on Health,

A BILL
To provide funding to improve the security of the American people by
protecting against the threat of bioterrorism.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. PROVISION OF AMOUNTS.
The following sums shall be made available for fiscal year 2002
from the amounts appropriated under the 2001 Emergency Supplemental
Appropriations Act for Recovery from and Response to Terrorist Attacks
on the United States (Public Law 107-38):
(1) Department of health and human services public health
and social services emergency fund.--For an additional amount
for emergency expenses necessary to support activities to
respond to the September 11, 2001 terrorist attacks on the
United States and to protect Americans from potential acts of
bioterrorism and improve public health, $3,375,000,000, to
remain available until expended, to be deposited into the
Public Health and Social Services Emergency Fund, of which--
(A) $1,150,000,000 shall be for the Centers for
Disease Control and Prevention for improving the
capacity of State and local public agencies, including
improved training of health professionals, improved
surveillance, improved public health laboratory
capacity and security and expansion of the Health Alert
Network;
(B) $165,000,000 shall be for grants to hospitals,
in collaboration with local governments, to improve
bioterrorism response capacity;
(C) $185,000,000 shall be for upgrading laboratory
and research capacity at the Centers for Disease
Control and Prevention;
(D) $879,000,000 shall be for the purchase,
administration, and related costs of the smallpox
vaccine;
(E) $10,000,000 shall be for the Centers for
Disease Control and Prevention to establish and operate
a national system to track biological pathogens;
(F) $73,000,000 shall be for improving the security
of laboratories at the Centers for Disease Control and
Prevention and the National Institutes of Health;
(G) $95,000,000 shall be for improving disaster
response teams and systems within the Office of the
Secretary;
(H) $125,000,000 shall be for the National
Institute of Allergy and Infectious Diseases for
expanded bioterrorism-related research and development
and other related needs;
(I) $593,000,000 shall be for the National
Pharmaceutical Stockpile;
(J) $96,000,000 shall be for the construction of
laboratories and related infrastructure needs at the
National Institute of Allergy and Infectious Diseases;
and
(K) $4,000,000 shall be for training and education
regarding effective workplace responses to
bioterrorism.
At the discretion of the Secretary of Health and Human
Services, amounts described in subparagraphs (A) through (L)
may be transferred between such subparagraphs subject to
applicable reprogramming procedures.
(2) Food and drug administration salaries and expenses.--
For an additional amount for emergency expenses necessary to
expand food safety inspection capacity, $250,000,000 to be made
available to the Food and Drug Administration.
(3) Department of agriculture.--
(A) Office of the secretary.--For an additional
amount for emergency expenses necessary to improve the
food safety inspection capacity of the Department of
Agriculture, $144,000,000 to be made available to the
Office of the Secretary of Agriculture.
(B) Agricultural research service.--For an
additional amount for emergency expenses necessary to
upgrade and modernize existing biosecurity buildings
and facilities, $180,000,000 to be made available to
the Agricultural Research Service, of which--
(i) $100,000,000 shall be used for
renovation, updating and expansion of Biosafety
Level 3 laboratory and animal research
facilities at the Plum Island Animal Disease
Center; and
(ii) $80,000,000 shall be used to modernize
animal disease facilities at the Agricultural
Research Service/Animal and Plant Health
Inspection Service Facility at Ames, Iowa.
