Amending the Rules of the House of Representatives to provide that the
gift rule covers Members-elect.

Mr. Graham (for himself, Mr. Sensenbrenner, Mr. Smith of Texas, and Mr.
Flake) submitted the following resolution; which was referred to the
Committee on Rules

RESOLUTION
Amending the Rules of the House of Representatives to provide that the
gift rule covers Members-elect.
Resolved, That (a) clause 5 of rule XXV of the Rules of the House
of Representatives is amended by adding at the end the following new
paragraph:
``(g) (1) Any Member, Delegate, or Resident Commissioner who, while
a Member-elect, engaged in conduct which would be in violation of this
clause if such individual were, at the time of such conduct a Member,
shall be subject to the provisions of this clause.
``(2) As used in this paragraph, the term `Member-elect' means an
individual who is elected in a general or special election as a Member
of, or Delegate or Resident Commissioner to, the Congress, but who has
not taken the oath of office.''.
(b) (1) The amendment made by subsection (a) shall apply to any
individual who becomes a Member-elect after the date of adoption of
this resolution.
(2) As used in paragraph (1), the term ``Member-elect'' has the
meaning given such term in clause 5(g)(2) of rule XXV of the Rules of
the House of Representatives.
