To amend title 10, United States Code, to enhance the ability of States 
 and local governments to participate in projects conducted under the 
   alternative authority of the Department of Defense to acquire and 
                       improve military housing.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. PRIORITY FOR STATE AND LOCAL GOVERNMENT PARTICIPATION IN 
              PROJECTS UNDER ALTERNATIVE AUTHORITY FOR ACQUISITION AND 
              IMPROVEMENT OF MILITARY HOUSING.

    Section 2872 of title 10, United States Code, is amended--
            (1) by inserting ``(a) Availability of Alternative 
        Authority.--'' before ``In addition''; and
            (2) by adding at the end the following new subsection:
    ``(b) Priority for Participation of State and Local Governments.--
(1) Whenever the Secretary concerned elects to carry out a project 
using any authority or combination of authorities provided under this 
subchapter for the acquisition or construction of military family 
housing or military unaccompanied housing for a military installation, 
the Secretary shall give the State in which the installation is located 
and local governments in the vicinity of the installation a right-of-
first refusal to participate in the project.
    ``(2) The Secretary concerned shall give States and local 
governments a 30-day period in which to express an interest in 
participating in a proposed project under this subchapter. If no 
expression of interest is received within that period, the Secretary 
concerned may extend the solicitation to other eligible entities.
    ``(3) If one or more governmental entities express an interest in 
participating in a proposed project under this subchapter, the 
Secretary shall provide a 120-day period for the interested 
governmental entities to submit project proposals to the Secretary, 
which the Secretary shall use as the basis for selecting participants 
in the project. A project proposal shall include a description of 
proposed private sector involvement in the proposed project, as well as 
the purpose for which the project cash flow would be used during both 
the development of the project and the operation of the project.
    ``(4) In this section, the terms `State' and `local government' 
include any housing authority, housing finance agency, or redevelopment 
agency established or recognized by a State or local government.''.
                                 <all>
