A BILL
To prohibit assistance for Afghanistan unless the national government
of Afghanistan undertakes efforts to control illegal drugs in
Afghanistan, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Afghanistan Illegal Drug Eradication
Act''.
SEC. 2. PROHIBITIONS ON ASSISTANCE FOR AFGHANISTAN.
(a) General Prohibition.--Beginning on and after the date of the
enactment of this Act, United States assistance may not be provided for
Afghanistan unless the President determines and certifies to Congress
that the national government of Afghanistan meets the following
requirements:
(1) The government does not engage in the cultivation of
poppies or drug trafficking or otherwise facilitate the
cultivation, production, transportation, or distribution of
illegal drugs.
(2) The government has destroyed all illegal drugs held in
storage at locations owned, operated, controlled, or seized by
the government.
(3) The government has established and is implementing
appropriate institutional mechanisms to prohibit the
cultivation, production, transportation, and distribution of
illegal drugs, including appropriate enforcement mechanisms.
(b) Specific Prohibition.--
(1) In general.--Beginning on and after the date of the
enactment of this Act, United States assistance may not be
provided for an individual or entity in Afghanistan that
cultivates, produces, transports, or distributes illegal drugs.
(2) Mandate to report.--Any officer or employee of a
Federal department or agency having knowledge of facts or
circumstances that reasonably indicate that any individual or
entity in Afghanistan that receives United States assistance is
involved in the cultivation, production, transportation, or
distribution of illegal drugs shall, notwithstanding any
memorandum of understanding or other agreement to the contrary,
report such knowledge or facts to the appropriate official.
(c) Definitions.--In this section:
(1) Appropriate official.--The term ``appropriate
official'' means the Attorney General, the Inspector General of
the Federal department or agency involved, or the head of such
department or agency.
(2) Illegal drugs.--The term ``illegal drugs'' means
controlled substances, as that term is defined in section
102(6) of the Controlled Substances Act (21 U.S.C. 802(6)), in
particular opium poppy and poppy straw included in subsection
(a)(3) of schedule II under part B of title II of such Act.
(3) United states assistance.--The term ``United States
assistance'' means funds made available to carry out any
program, project, or activity under any provision of law,
except that such term does not include funds made available to
provide humanitarian assistance through private voluntary
organizations.
