A BILL
To amend the Fair Debt Collection Practices Act to clarify the
relationship between such Act and rules of civil procedure, and for
other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Fair Debt Collection Practices
Technical Amendment Act of 2001''.
SEC. 2. TECHNICAL AMENDMENT TO REMEDY THE CONFLICT BETWEEN FEDERAL LAW
AND JUDICIAL RULES.
Section 803(2) of the Fair Debt Collection Practices Act (15 U.S.C.
1692a(2)) is amended to read as follows:
``(2) The term `communication'--
``(A) means the conveying of information regarding
a debt directly or indirectly to any person through any
medium; and
``(B) does not include actions taken pursuant to
the Federal Rules of Civil Procedure or, in the case of
a proceeding in a State court, the rules of civil
procedure applicable in the courts of such State.''.
