Reform, and in addition to the Committee on Agriculture, for a period
to be subsequently determined by the Speaker, in each case for
consideration of such provisions as fall within the jurisdiction of the
committee concerned

A BILL
To provide consistent treatment of overtime, night, and holiday
inspection and quarantine services performed by employees of the
Department of Agriculture.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Department of Agriculture Inspection
and Quarantine Services Payment Act''.
SEC. 2. PAYMENT FOR OVERTIME, NIGHT, AND HOLIDAY INSPECTION AND
QUARANTINE SERVICES UNDER DEPARTMENT OF AGRICULTURE
INSPECTION LAWS.
(a) Consistent Payment Authority.--The Secretary of Agriculture may
pay employees of the Department of Agriculture employed in
establishments subject to the Poultry Products Inspection Act (21
U.S.C. 451 et seq.), the Federal Meat Inspection Act (21 U.S.C. 601 et
seq.), the Egg Products Inspection Act (21 U.S.C. 1031 et seq.), or any
other law regarding the inspection or quarantine of agricultural
products for all overtime, night, and holiday work performed at such
establishments, at such rates as the Secretary may determine.
(b) Reimbursement.--The Secretary may require the persons for whom
overtime, night, or holiday work described in subsection (a) is
performed to reimburse the Secretary for the amounts paid out by the
Secretary for such work. Amounts received by the Secretary as
reimbursement shall be available to the Secretary, without further
appropriation and until expended, to make payments for such overtime,
night, and holiday work.
(c) Conforming Amendments.--(1) The second paragraph under the
heading ``Meat Inspection, Bureau of Animal Industry:'' in the Act of
July 24, 1919 (7 U.S.C. 394), is repealed.
(2) Section 25 of the Poultry Products Inspection Act (21 U.S.C.
468) is amended by striking ``overtime and holiday'' and all that
follows through the period at the end of the section and inserting
``overtime, night, and holiday work covered by section 2 of the
Department of Agriculture Inspection and Quarantine Services Payment
Act.''.
(3) The Act of June 5, 1948 (21 U.S.C. 695), is amended by striking
``overtime pursuant to the Act of July 24, 1919 (7 U.S.C. 394)'' and
inserting ``overtime, night, and holiday work covered by section 2 of
the Department of Agriculture Inspection and Quarantine Services
Payment Act''.
