 To amend title 38, United States Code, to establish a minimum pension 
                       rate for certain veterans.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. MINIMUM PENSION RATE.

    (a) In General.--(1) Subchapter II of chapter 15 of title 38, 
United States Code is amended by adding at the end the following new 
section:
``Sec. 1526. Minimum pension rate
    ``(a) Application of Minimum Pension Rate.--If, in any year, the 
maximum annual rate of pension for a veteran entitled to receive a 
pension under this subchapter is less than the applicable baseline 
income level for that veteran, the Secretary shall apply that 
applicable baseline income level in lieu of the maximum annual rate of 
pension in determining the annual rate of pension paid to that veteran.
    ``(b) Applicable Baseline Income Level.--In this section the term 
`applicable baseline income level' means, with respect to a veteran, an 
amount equal to 125 percent of the poverty income level, as published 
by the Secretary of Health and Human Services, based on the residence 
and number of dependents of that veteran.''.
    (2) Section 1521(a) of such title is amended by striking the period 
at the end and inserting ``and subject to the minimum pension rate 
established by section 1526 of this title.''.
    (b) Conforming Amendment.--The table of sections at the beginning 
of chapter 15 of such title is amended by inserting after the item 
relating to section 1525 the following new item:

``1526. Minimum pension rate.''.
