A BILL
To amend the Air Transportation Safety and System Stabilization Act to
provide compensation to victims of terrorist-related anthrax infections
following the terrorist-related aircraft crashes of September 11, 2001.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Anthrax Victims Compensation Act''.
SEC. 2. AMENDMENTS TO SEPTEMBER 11 VICTIM COMPENSATION FUND OF 2001.
(a) Definitions.--Section 402 of the Air Transportation Safety and
System Stabilization Act (Public Law 107-42) is amended--
(1) in paragraph (4) by inserting before the period at the
end the following: ``, or to a death resulting from a
terrorist-related anthrax infection following such crashes'';
and
(2) by adding at the end the following:
``(9) Terrorism.--The term `terrorism' has the meaning the
term `act of terrorism' has in section 3077 of title 18, United
States Code.''.
(b) Purpose.--Section 403 of such Act is amended by inserting after
``September 11, 2001'' the following: ``, or killed as a result of a
terrorist-related anthrax infection following such crashes''.
(c) Contents of Claim Form.--Section 405(a)(2)(B) of such Act is
amended--
(1) in clause (i) by inserting before the semicolon at the
end the following: ``, or as a result of a terrorist-related
anthrax infection following such crashes''; and
(2) in each of clauses (ii) and (iii) by inserting ``or as
a result of such infection'' after ``such crashes''.
(d) Filing Deadline.--Section 405(a)(3) of such Act is amended by
inserting before the period at the end ``or, in the case of a death
resulting from a terrorist-related anthrax infection, the date of such
death''.
(e) Collateral of Compensation.--Section 405(b)(6) of such Act is
amended by inserting before the period at the end the following: ``, or
as a result of a terrorist-related anthrax infection following such
crashes''.
(f) Eligibility.--Section 405(c)(2) of such Act is amended--
(1) by striking ``or'' at the end of subparagraph (B);
(2) by redesignating subparagraph (C) as subparagraph (D);
(3) by inserting after subparagraph (B) the following:
``(C) an individual who suffers after September 11,
2001, death as a result of a terrorist-related anthrax
infection following such crashes; or''; and
(4) in subparagraph (D), as redesignated by paragraph (2)
of this subsection, by striking ``or (B)'' and inserting ``,
(B), or (C)''.
(g) Limitation on Civil Action.--Section 405(c)(3)(B)(i) of such
Act is amended by inserting before the period at the end of the first
sentence the following: ``, or as a result of a terrorist-related
anthrax infection following such crashes''.
(h) Federal Causes of Action.--Section 408 of such Act is amended--
(1) by striking the subsection heading for subsection (b)
and inserting ``Federal Cause of Action for Hijackings and
Subsequent Crashes'';
(2) by redesignating subsection (c) as subsection (d); and
(3) by inserting after subsection (b) the following:
``(c) Federal Jurisdiction for Terrorist-Related Anthrax Deaths.--
The United States district court in which a person who died as a result
of a terrorist-related anthrax infection following hijacking and
subsequent crashes of American Airlines flights 11 and 77, and United
Airlines flights 93 and 175 on September 11, 2001, resided shall have
original and exclusive jurisdiction over all Federal causes of actions
brought for any claim resulting from or relating to such death.''.
