To amend title 10, United States Code, to expand the program under
which State and local governments may procure law enforcement equipment
through the Department of Defense to include the procurement of
counter-terrorism equipment.

A BILL
To amend title 10, United States Code, to expand the program under
which State and local governments may procure law enforcement equipment
through the Department of Defense to include the procurement of
counter-terrorism equipment.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. EXPANSION OF PROGRAM FOR STATE AND LOCAL GOVERNMENT
PROCUREMENT OF CERTAIN LAW ENFORCEMENT EQUIPMENT THROUGH
THE DEPARTMENT OF DEFENSE.
(a) Procurement of Equipment Suitable for Counter-Terrorism
Activities.--Section 381 of title 10, United States Code, is amended--
(1) by inserting ``or counter-terrorism'' after ``counter-
drug'' each place it appears in the first sentence of
subsection (a)(1), subsection (a)(1)(A), subsection (c), and
subsection (d)(3); and
(2) in subsection (d)(3), by inserting after the first
sentence the following new sentence: ``Equipment suitable for
counter-terrorism activities includes equipment suitable for
use to respond to and manage the consequences of an act of
terrorism.''.
(b) Clerical Amendments.--(1) The heading of such section is
amended to read as follows:
``Sec. 381. Procurement by State and local governments of law
enforcement equipment through the Department of
Defense''.
(2) The table of sections at the beginning of chapter 18 of such
title is amended by striking the item relating to section 381 and
inserting the following new item:
``381. Procurement by State and local governments of law enforcement
equipment through the Department of
Defense.''.
