To amend title 49, United States Code, to require background checks for 
    individuals enrolled in flight schools, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Safe Skies Act of 2001''.

SEC. 2. BACKGROUND CHECKS FOR FLIGHT STUDENTS.

    Section 44707 of title 49, United States Code, is amended--
            (1) by inserting ``(a) In General.--'' before ``The 
        Administrator''; and
            (2) by adding at the end the following:
    ``(b) Background Checks for Flight Students.--
            ``(1) In general.--The Administrator shall take such action 
        as may be necessary to ensure that each individual who is 
        enrolled or to be enrolled in a civilian school for instruction 
        in flying a single-engine or multi-engine aircraft or 
        helicopter, or who has commenced flight training (other than 
        ground training) from an authorized flight instructor of such 
        an aircraft or helicopter, is the subject of a background 
        review conducted by the Administrator and paid for by such 
        individual.
            ``(2) Sense of congress.--It is the sense of Congress that 
        the Administrator, the Director of the Federal Bureau of 
        Investigation, and the Director of the Central Intelligence 
        Agency should ensure that backgroud reviews carried out under 
        this section are completed in not more than 28 days after--
                    ``(A) the effective date of this subsection; or
                    ``(B) in the case of an individual to be enrolled 
                for instruction described in paragraph (1) after such 
                effective date, the date of application for such 
                enrollment.
            ``(3) Annual report.--The Administrator of the Federal 
        Aviation Administration shall prepare and transmit to the 
        Committee on Transportation and Infrastructure of the House of 
        Representatives and the Committee on Commerce, Science, and 
        Transportation of the Senate an annual report detailing the 
        number of background reviews performed during the preceding 
        year, number of individuals failing such reviews, and an 
        outline of the reasons for such failures.
            ``(4) Background review defined.--In this section, the term 
        `background review', commonly known as an indices check, means 
        a review of information provided by the Director of Central 
        Intelligence and the Director of the Federal Bureau of 
        Investigation regarding personal background, including 
        information relating to any history of criminal activity or to 
        any evidence of espionage or terrorism.''.

SEC. 3. EFFECTIVE DATE.

    The amendments made by section 2 shall take effect on the 90th day 
following the date of enactment of this Act.
