the American Battle Monuments Commission of a memorial park in Nairobi, 
Kenya, honoring the persons killed by the bombing of the United States 
                                Embassy.

 To amend title 36, United States Code, to provide for maintenance by 
the American Battle Monuments Commission of a memorial park in Nairobi, 
Kenya, honoring the persons killed by the bombing of the United States 
                                Embassy.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. FINDINGS.

    The Congress finds that--
            (1) the United States Embassy in Nairobi, Kenya, was the 
        target of terrorist activity on August 7, 1998, when a small 
        truck exploded in very close proximity to the rear corner of 
        the embassy;
            (2) the mid-morning explosion killed 213 people and 
        severely damaged the Embassy;
            (3) this unconscionable act of terrorism resulted in the 
        tragic loss of life of United States Foreign Service officers, 
        Department of Defense personnel, military personnel, a family 
        member of an employee of the Centers for Disease Control and 
        Prevention, Kenyan personnel working at the Embassy, and a 
        large number of Kenyan citizens who happened to be near the 
        Embassy;
            (4) twelve United States citizens, including Foreign 
        Service Officers and military personnel, were killed in this 
        bombing explosion, and 5,000 people were injured; and
            (5) a memorial trust, named the ``August 7th Memorial 
        Trust'', has been established with ex officio representation by 
        the United States Embassy and in cooperation with the Kenyan 
        Government, to turn the former site of the United States 
        Embassy into a memorial park to commemorate those who were 
        killed and wounded in the bomb blast.

SEC. 2. MEMORIAL PARK.

    (a) In General.--Chapter 21 of title 36, United States Code, is 
amended by adding at the end the following new section:
``Sec.  2115. Kenyan Embassy Memorial Park
    ``(a) In General.--After an agreement is made between the United 
States Government and the Government of Kenya, the American Battle 
Monuments Commission shall maintain the memorial park at the site of 
the former United States Embassy in Nairobi, Kenya, honoring the 
persons killed by the bombing of the embassy on August 7, 1998.
    ``(b) Personnel.--The Commission may employ necessary personnel to 
carry out this section.
    ``(c) Authority To Solicit Contributions.--To carry out this 
section, the Commission may solicit and accept private contributions 
and shall deposit the contributions in the fund established by 
subsection (d).
    ``(d) Fund.--
            ``(1) Establishment.--There is established a fund in the 
        Treasury that shall be available to the Commission without 
        further appropriation to carry out this section. The fund 
        consists of amounts described in paragraphs (2) and (3).
            ``(2) Contributions and appropriations.--The Commission 
        shall deposit into the fund the amounts that are accepted under 
        subsection (c) and any amounts appropriated under subsection 
        (e).
            ``(3) Interest from investments.--The Secretary of the 
        Treasury shall invest any part of the fund that the Commission 
        determines is not required to meet current expenses. Each 
        investment shall be made in an interest-bearing obligation of 
        the United States Government, or an obligation that has its 
        principal and interest guaranteed by the Government, that the 
        Commission decides has a maturity suitable for the fund. The 
        Secretary of the Treasury shall credit to the fund the interest 
        on, and the proceeds from the sale or redemption of, 
        obligations held in the fund.
            ``(4) Amounts not expended.--Amounts in the fund exceeding 
        the cost of carrying out this section, as decided by the 
        Commission, shall be deposited in the Treasury as miscellaneous 
        receipts to reimburse the United States Government for amounts 
        appropriated under subsection (e).
    ``(e) Authorization of Appropriations.--There are authorized to be 
appropriated to the Commission such sums as may be necessary for 
carrying out this section.''.
    (b) Table of Contents.--The table of sections at the beginning of 
such chapter is amended by adding at the end the following new item:

``2115. Kenyan Embassy Memorial Park.''.
