A BILL
To amend title 38, United States Code, to provide that retired members
of the Armed Forces shall be eligible for priority health care from the
Department of Veterans Affairs on the same basis as former prisoners of
war.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Military Retiree Veterans Health
Care Eligibility Act''.
SEC. 2. PRIORITY CATEGORY FOR MILITARY RETIREES IN DEPARTMENT OF
VETERANS AFFAIRS MEDICAL SYSTEM.
(a) Priority of Care.--(1) Section 1705(a)(3) of title 38, United
States Code, is amended--
(A) by striking ``who are'' and all that follows through
``, veterans''; and
(B) by striking ``subparagraphs (B) and (C)'' and inserting
``subparagraphs (B), (C), and (D)''.
(2) Section 1710(a)(2)(D) of such title is amended by inserting
after ``former prisoner of war'' the following: ``, who is entitled to
retired or retainer pay (or would be entitled to retired pay under
chapter 1223 of title 10 but for being under age 60),''.
(b) Effective Date.--The amendments made by this section shall
apply with respect to hospital care and medical services provided by
the Secretary of Veterans Affairs on or after January 1, 2002.
