   To amend title 49, United States Code, to permit an individual to 
operate a commercial motor vehicle solely within the borders of a State 
  if the individual meets certain minimum standards prescribed by the 
                     State, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Commercial Driver's License 
Devolution Act of 2001''.

SEC. 2. INTRASTATE OPERATION OF COMMERCIAL MOTOR VEHICLES.

    (a) In General.--Section 31305 of title 49, United States Code, is 
amended by adding at the end the following:
    ``(c) Intrastate Operations.--Notwithstanding any other provision 
of this section, any individual may operate a commercial motor vehicle 
solely within the borders of a State if--
            ``(1) the individual meets such minimum standards for 
        testing and ensuring the fitness of an individual operating a 
        commercial motor vehicle as may be prescribed by the State; and
            ``(2) the individual has passed written and driving tests 
        to operate the vehicle that meet such minimum standards as may 
        be prescribed by the State.''.
    (b) Requirements for State Participation.--Section 31311(a) of such 
title is amended in each of paragraphs (1) and (2) by striking ``The 
State'' and inserting ``Subject to section 31305(c), the State''.
