A BILL
To amend the Federal Water Pollution Control Act to authorize
appropriations for fiscal years 2002 through 2006 for the municipal
construction grant program, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Water Infrastructure Improvement Act
of 2001''.
SEC. 2. ELIGIBLE PROJECTS.
Section 201(g)(1) of the Federal Water Pollution Control Act (33
U.S.C. 1281(g)(1)) is amended by striking the period at the end of the
first sentence and all that follows through the period at the end of
the last sentence and inserting the following: ``and for any purpose
for which a grant may be made under sections 319(h) and 319(i) of this
Act (including any innovative and alternative approaches for the
control of nonpoint sources of pollution).''.
SEC. 3. ALLOTMENT.
(a) Formula.--Section 205(c) of the Federal Water Pollution Control
Act (33 U.S.C. 1285(c)) is amended by adding at the end the following:
``(4) Fiscal years 2002 through 2006.--Sums authorized to
be appropriated pursuant to section 207 for each of fiscal
years 2002 through 2006 shall be allotted by the Administrator
not later than the 10th day which begins after the date of
enactment of this paragraph among the States in accordance with
regulations issued by the Administrator in the ratio that the
estimated cost of construction of all needed publicly owned
treatment works in each State bears to the estimated cost of
construction of all needed publicly owned treatment works in
all of the States.''.
(b) Minimum Percentage.--Section 205(e) of such Act (33 U.S.C.
1285(e)) is amended by striking ``and 1990'' each place it appears and
inserting ``1990, 2002, 2003, 2004, 2005, and 2006''.
(c) Set-Aside for Innovative and Alternative Projects.--Section
205(i) of such Act (33 U.S.C. 1285(i)) is amended by striking ``1990''
each place it appears and inserting ``2006''.
(d) Marine Estuary Reservation.--Section 205(l)(1) of such Act (33
U.S.C. 1285(l)(1)) is amended by adding at the end the following:
``(D) Fiscal years 2002 through 2006.--For each of
fiscal years 2002 through 2006, the reservation shall
be 1\1/2\ percent of the funds appropriated pursuant to
section 207 for such fiscal year.''.
(e) Discretionary Deposits.--Section 205(m)(1) of such Act (33
U.S.C. 1285(m)(1)) is amended by inserting ``and ending before October
1, 2001,'' after ``1986,''.
SEC. 4. AUTHORIZATION OF APPROPRIATIONS.
Section 207 of the Federal Water Pollution Control Act (33 U.S.C.
1287) is amended by inserting before the period at the end the
following: ``; and $5,400,000,000 for each of fiscal years 2002 through
2006.''.
