To require cigarette products to be placed under or behind the counter 
                            in retail sales.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. RETAIL SALES OF CIGARETTE PRODUCTS.

    (a) Product Placement.--Any person engaged in the retail sales of 
cigarette products shall place such products under or behind a counter 
and not out on the floor of the retail sales facility.
    (b) Penalty.--A person who violates subsection (a) shall be 
considered to have engaged in a deceptive act or practice in violation 
of section 5 of the Federal Trade Commission Act (15 U.S.C. 45).
