To provide for interim continuation of administration of motor carrier 
            functions by the Federal Highway Administration.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. INTERIM CONTINUATION OF MOTOR CARRIER FUNCTIONS IN FHWA.

    Notwithstanding any other provision of law, all motor carrier 
functions vested in the Secretary of Transportation or the 
Administrator of the Federal Highway Administration under titles 23 and 
49, United States Code, and carried out by the Federal Highway 
Administration as of September 30, 1999, shall be implemented by the 
Administrator, and all funds deducted under section 104(a) of title 23, 
United States Code, to administer such functions shall be available to 
the Administrator to administer such functions, until the enactment of 
authorizing legislation to transfer these responsibilities to a 
separate agency within the Department of Transportation. Such functions 
shall be deemed to have never lapsed as functions of the Administrator.
