A BILL
To amend the Poultry Products Inspection Act to allow States to
regulate the use of the term ``fresh'' in the labeling of poultry.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. AUTHORIZATION OF STATE REGULATIONS REGARDING LABELING OF
POULTRY AS FRESH.
Section 23 of the Poultry Products Inspection Act (7 U.S.C. 467e)
is amended in the second sentence by striking ``Act, but'' and
inserting the following: ``Act. However, a State or Territory or the
District of Columbia may impose requirements regarding the use of the
term `fresh' on the labeling of any poultry, poultry part, or edible
portion of the poultry or part, in addition to any labeling
requirements imposed under this Act. In addition,''.
