A BILL
To direct the Secretary of the Interior to make certain modifications
with respect to a water contract with the City of Kingman, Arizona, and
for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. WATER CONTRACTS WITH THE CITY OF KINGMAN, ARIZONA.
(a) Extension of Term of Contract.--The Secretary shall amend the
Contract to extend the term thereof to December 31, 2001.
(b) Assignment of Contract.--Upon request by the City, the
Secretary shall--
(1) approve the assignment of the Contract from the City to
a municipal corporation in Mohave County, Arizona, organized
pursuant to Chapter 54, Laws, State of Arizona, Forty-first
Legislature, Second Regular Session, 1994; and
(2) after such assignment, amend the Contract so as to make
water deliverable under the Contract available for permanent
service in a manner consistent with the City's ``Plan to Put to
Beneficial Use Outside Kingman 18,500 Acre-feet Per Year of
Colorado River Water'', which was submitted by the City to the
United States Bureau of Reclamation on June 29, 1994.
(c) Contract Not Terminable for Nonuse of Water.--The Contract
shall not be terminable for nonuse of water before December 31, 2001,
and thereafter only in accordance with the terms of the Contract as
amended pursuant to subsection (b)(2).
(d) Consent of United States to Suit.--Authorization is hereby
granted to join the United States as a party to any suit brought for
the purpose of enforcing the Secretary's obligations to perform the
provisions of this Act. Any claim by the United States to sovereign
immunity from such suit is hereby waived.
(e) Definitions.--For the purposes of this section:
(1) the term ``Secretary'' means the Secretary of the
Interior.
(2) The term ``City'' means the City of Kingman, Arizona.
(3) The term ``Contract'' means Contract No. 14-06-W-202
between the United States of America and the City of Kingman,
Arizona, dated November 14, 1968, as amended October 4, 1993,
and December 15, 1994.
