A BILL
To amend the Food Security Act of 1985 to limit farm program payments
to producers who earn less than $100,000 annually from off-farm
sources.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. INCOME LIMITATIONS ON RECEIPT OF FARM PROGRAM PAYMENTS.
(a) Income Limitations on Receipt of Payments.--Section 1001 of the
Food Security Act of 1985 (7 U.S.C. 1308) is amended by adding at the
end the following new paragraph:
``(8) Adjusted gross income limitation.--(A) A person who has an
adjusted gross income of $100,000 or more from off-farm sources
annually shall not be eligible to receive deficiency payments and land
diversion payments described in paragraph (1) or other payments
described in paragraph (2)(B).
``(B) For purposes of this paragraph:
``(i) The term `adjusted gross income' has the meaning
given that term in section 62 of the Internal Revenue Code of
1986 (26 U.S.C. 62).
``(ii) The term `off-farm sources' means sources of income
for a person unrelated to the production and sale of a
agricultural commodity by the person. Such term shall not
include interest or dividend income resulting from savings
derived from revenues from the production and sale of a
agricultural commodity.''.
(b) Application.--The amendment made by subsection (a) shall apply
to crop years beginning after the date of the enactment of this Act.
