A BILL
For the relief of Otto Orenstein.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. FINDINGS.
The Congress finds that--
(1) Otto Orenstein was born in Austria in July of 1921, but
was not recognized as an Austrian citizen as a result of his
Jewish heritage;
(2) Mr. Orenstein arrived in the United States in 1940 and
proceeded to Hawaii;
(3) Mr. Orenstein filed his declaration to become an
American citizen in 1940;
(4) Mr. Orenstein was arrested as an alien enemy on
December 8, 1941;
(5) the Board of Officers and Civilians found no evidence
discrediting Otto Orenstein's loyalty to the United States or
connecting him with subversive activities;
(6) the Military Intelligence Bureau did not concur with
the findings of the Board of Officers and Civilians and ordered
that Otto Orenstein be interned;
(7) Mr. Orenstein was confined to the Sand Island Detention
Camp until April 4, 1942, whereupon he was released on parole;
(8) Mr. Orenstein was released from parole on November 24,
1943; and
(9) as compensation for being interned by the United States
Government at the Sand Island Detention Camp between 1941 and
1942, and subject to conditions of parole between 1942 and
1943, Mr. Orenstein should receive the same amount of
compensation that eligible interns of Japanese descent are
awarded under section 105 of the Civil Liberties Act of 1988
(50 U.S.C. App. 1989b-4).
SEC. 2. SATISFACTION OF CLAIM AGAINST THE UNITED STATES.
(a) Payment.--The Secretary of the Treasury shall pay, out of any
money in the Treasury not otherwise appropriated, the sum of $20,000 to
Otto Orenstein.
(b) Basis.--The payment required by subsection (a) shall be in full
compensation for any physical, psychological, and economic injuries
sustained by Otto Orenstein as a result of being--
(1) involuntarily detained at the Sand Island Detention
Camp between 1941 and 1942; and
(2) subject to conditions of parole between 1942 and 1943.
SEC. 3. LIMITATION ON ATTORNEY'S AND AGENT'S FEES.
Not more than 10 percent of the payment specified in section 2 may
be paid to or received by any agent or attorney as consideration for
any services rendered in connection with this Act, notwithstanding any
contract which provides otherwise. Violation of this section shall be
deemed a misdemeanor punishable by a fine of not more than $1,000.
