A BILL
Relating to the tariff treatment of pharmaceutical grade phospholipids.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. PHARMACEUTICAL GRADE PHOSPHOLIPIDS.
(a) New Entries.--With respect to eligible goods entered, or
withdrawn from warehouse for consumption, on or after the 15th day
after the date of the enactment of this Act, and before January 1,
1995, such goods shall be liquidated as if chapter 29 of the Harmonized
Tariff Schedule of the United States were amended by striking
subheading 2923.20.00 and inserting the following new subheadings, with
the superior text having the same degree of indentation as the article
description for subheading 2923.10.00:

aminolipids:
2923.20.10 Egg phospholipids, Free 10%
pharmaceutical grade meeting (A,E,IL,J,MX)
requirements of the United 0.8% (CA)
States Food and Drug
Administration for use in
intravenous fat emulsions.... 1.5%

(b) Eligible Goods.--For purposes of this Act, the term ``eligible
goods'' means goods described in subheading 2923.20.10 of the
Harmonized Tariff Schedule of the United States, as set forth in the
amendment described in subsection (a).
SEC. 2. RETROACTIVE APPLICATION.
Notwithstanding section 514 of the Tariff Act of 1930 or any other
provision of law, upon proper request filed with the Customs Service
before the 90th day after the date of the enactment of this Act, any
entry of eligible goods--
(1) that was made after March 29, 1991, and before the 15th
day after the date of the enactment of this Act, and
(2) with respect to which there would have been a lesser
duty if the amendment described in section 1 applied to such
entry,
shall be liquidated or reliquidated as if such amendment applied to
such entry.
