<section id="d533e90" identifier="/us/pl/119/90/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>EXTENSION OF TIME TO COMMENCE CONSTRUCTION OF CERTAIN HYDROPOWER PROJECTS.</heading><subsection class="firstIndent0 fontsize10" id="y9a0044da-52d0-11f1-8881-4b76bc008a6a" identifier="/us/pl/119/90/s1/a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definition of Covered Project</inline>.—</heading><content>In this section, the term “<term>covered project</term>” means a hydropower project with respect to which the Federal Energy Regulatory Commission issued a license before March 13, 2020.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9a0044db-52d0-11f1-8881-4b76bc008a6a" identifier="/us/pl/119/90/s1/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Extension</inline>.—</heading><content>Notwithstanding section 13 of the Federal Power Act (<ref href="/us/usc/t16/s806">16 U.S.C. 806</ref>), on the request of a licensee of a covered project, the Federal Energy Regulatory Commission may, after reasonable notice and for good cause shown, extend in accordance with subsection (c) the period during which the licensee is required to commence construction of the covered project for not more than an additional 6 years beyond the 8 years authorized by that section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9a0044dc-52d0-11f1-8881-4b76bc008a6a" identifier="/us/pl/119/90/s1/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Period of Extension</inline>.—</heading><chapeau>An extension of time to commence construction of a covered project under subsection (b) shall—</chapeau><paragraph class="fontsize10" id="y9a0044dd-52d0-11f1-8881-4b76bc008a6a" identifier="/us/pl/119/90/s1/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>consist of not more than 3 consecutive 2-year periods;</content></paragraph>
<paragraph class="fontsize10" id="y9a0044de-52d0-11f1-8881-4b76bc008a6a" identifier="/us/pl/119/90/s1/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>begin on the date on which the final extension of the period for commencement of construction granted to the licensee under section 13 of the Federal Power Act (<ref href="/us/usc/t16/s806">16 U.S.C. 806</ref>) expires; and</content></paragraph>
<paragraph class="fontsize10" id="y9a0044df-52d0-11f1-8881-4b76bc008a6a" identifier="/us/pl/119/90/s1/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>end on the date that is not more than 6 years after the latest date to which the Federal Energy Regulatory Commission is authorized to extend the period for commencement of construction under that section.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9a0044e0-52d0-11f1-8881-4b76bc008a6a" identifier="/us/pl/119/90/s1/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Reinstatement of Expired License</inline>.—</heading><chapeau>If the time period required under section 13 of the Federal Power Act (<ref href="/us/usc/t16/s806">16 U.S.C. 806</ref>) to commence construction of a covered project expires after December 31, 2023, and before the date of enactment of this Act—</chapeau><paragraph class="fontsize10" id="y9a0044e1-52d0-11f1-8881-4b76bc008a6a" identifier="/us/pl/119/90/s1/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Federal Energy Regulatory Commission may reinstate the license for the applicable project effective as of the date of expiration of the license; and<page identifier="/us/stat/140/821">140 STAT. 821</page></content></paragraph>
<paragraph class="fontsize10" id="y9a006bf2-52d0-11f1-8881-4b76bc008a6a" identifier="/us/pl/119/90/s1/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the extension authorized under subsection (b) shall take effect on the date of that expiration.</content></paragraph>
