<section id="d159e88" identifier="/us/pl/119/36/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x66bc0edc-948f-11f0-9cf9-53c89b32b968" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s1601">15 USC 1601 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Homebuyers Privacy Protection Act</shortTitle>”.</content></section>
<section id="d159e103" identifier="/us/pl/119/36/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>TREATMENT OF PRESCREENING REPORT REQUESTS.</heading><subsection class="firstIndent0 fontsize10" id="y66bcd22d-948f-11f0-9cf9-53c89b32b968" identifier="/us/pl/119/36/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10 smallCaps">In General<inline class="noSmallCaps">.—</inline></heading><content>Section 604(c) of the Fair Credit Reporting Act (<ref href="/us/usc/t15/s1681b/c">15 U.S.C. 1681b(c)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="fontsize10" id="y66be58ce-948f-11f0-9cf9-53c89b32b968" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10 smallCaps">Treatment of prescreening report requests<inline class="noSmallCaps">.—</inline></heading><subparagraph class="fontsize10" id="y66be58cf-948f-11f0-9cf9-53c89b32b968" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10 smallCaps">Definitions<inline class="noSmallCaps">.—</inline></heading><chapeau>In this paragraph:</chapeau><clause class="fontsize10" id="y66be58d0-948f-11f0-9cf9-53c89b32b968" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10 smallCaps">Credit union<inline class="noSmallCaps">.—</inline></heading><content>The term ‘<term>credit union</term>’ means a Federal credit union or a State credit union, as those terms are defined, respectively, in section 101 of the Federal Credit Union Act (<ref href="/us/usc/t12/s1752">12 U.S.C. 1752</ref>).</content></clause><clause class="fontsize10" id="y66be58d1-948f-11f0-9cf9-53c89b32b968" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10 smallCaps">Insured depository institution<inline class="noSmallCaps">.—</inline></heading><content>The term ‘<term>insured depository institution</term>’ has the meaning given the term in section 3 of the Federal Deposit Insurance Act (<ref href="/us/usc/t12/s1813/c">12 U.S.C. 1813(c)</ref>).</content></clause><clause class="fontsize10" id="y66be58d2-948f-11f0-9cf9-53c89b32b968" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10 smallCaps">Residential mortgage loan<inline class="noSmallCaps">.—</inline></heading><content>The term ‘<term>residential mortgage loan</term>’ has the meaning given the term in section 1503 of the S.A.F.E. Mortgage Licensing Act of 2008 (<ref href="/us/usc/t12/s5102">12 U.S.C. 5102</ref>).</content></clause><clause class="fontsize10" id="y66be58d3-948f-11f0-9cf9-53c89b32b968" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><heading class="fontsize10 smallCaps">Servicer<inline class="noSmallCaps">.—</inline></heading><content>The term ‘<term>servicer</term>’ has the meaning given the term in section 6(i) of the Real Estate Settlement Procedures Act of 1974 (<ref href="/us/usc/t12/s2605/i">12 U.S.C. 2605(i)</ref>).</content></clause></subparagraph><subparagraph class="fontsize10" id="y66be58d4-948f-11f0-9cf9-53c89b32b968" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10 smallCaps">Limitation<inline class="noSmallCaps">.—</inline></heading><chapeau>If a person requests a consumer report from a consumer reporting agency in connection with a credit transaction involving a residential mortgage loan, that agency may not, based in whole or in part on that request, furnish a consumer report to another person under this subsection unless—</chapeau><clause class="fontsize10" id="y66be58d5-948f-11f0-9cf9-53c89b32b968" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the transaction consists of a firm offer of credit or insurance; and</content></clause><clause class="fontsize10" id="y66be58d6-948f-11f0-9cf9-53c89b32b968" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>that other person—</chapeau><subclause class="fontsize10" id="y66be58d7-948f-11f0-9cf9-53c89b32b968" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>has submitted documentation to that agency certifying that such other person has, pursuant to paragraph (1)(A), the authorization <page identifier="/us/stat/139/494">139 STAT. 494</page>
of the consumer to whom the consumer report relates; or</content></subclause><subclause class="fontsize10" id="y66be58d8-948f-11f0-9cf9-53c89b32b968" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II)</num><item class="inline" id="y66be58d9-948f-11f0-9cf9-53c89b32b968"><num value="aa">(aa) </num><content>has originated a current residential mortgage loan of the consumer to whom the consumer report relates;</content></item><item class="indentUp0 fontsize10" id="y66be7fea-948f-11f0-9cf9-53c89b32b968" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>is the servicer of a current residential mortgage loan of the consumer to whom the consumer report relates; or</content></item><item class="indentUp0 fontsize10" id="y66be7feb-948f-11f0-9cf9-53c89b32b968" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">“(cc)</num><subitem class="inline" id="y66be7fec-948f-11f0-9cf9-53c89b32b968"><num value="AA">(AA) </num><content>is an insured depository institution or credit union; and</content></subitem><subitem class="indentUp0 fontsize10" id="y66be7fed-948f-11f0-9cf9-53c89b32b968" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="BB">“(BB) </num><content>holds a current account for the consumer to whom the consumer report relates.”</content></subitem></item></subclause></clause></subparagraph></paragraph></quotedContent>.</content></subsection></section>
<section id="d159e237" identifier="/us/pl/119/36/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x66bea6fe-948f-11f0-9cf9-53c89b32b968" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s1681b">15 USC 1681b note</ref>.</p></sidenote><heading>EFFECTIVE DATE.</heading><content style="-uslm-lc:I658120">  This Act, and the amendments made by this Act, shall take effect on the date that is 180 days after the date of enactment of this Act.</content></section>
<section id="d159e250" identifier="/us/pl/119/36/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>GAO STUDY.</heading><subsection class="firstIndent0 fontsize10" id="y66bf1c2f-948f-11f0-9cf9-53c89b32b968" identifier="/us/pl/119/36/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10 smallCaps">In General<inline class="noSmallCaps">.—</inline></heading><content>The Comptroller General of the United States shall carry out a study on the value of trigger leads received by text message that includes input from State regulatory agencies, mortgage lenders, depository institutions (as defined in section 3 of the Federal Deposit Insurance Act (<ref href="/us/usc/t12/s1813">12 U.S.C. 1813</ref>)), consumer reporting agencies (as defined in section 603 of the Fair Credit Reporting Act (<ref href="/us/usc/t15/s1681a">15 U.S.C. 1681a</ref>)), and consumers.</content></subsection><subsection class="firstIndent0 fontsize10" id="y66bf1c30-948f-11f0-9cf9-53c89b32b968" identifier="/us/pl/119/36/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10 smallCaps">Report<inline class="noSmallCaps">.—</inline></heading><content>Not later than the end of the 12-month period beginning on the date of enactment of this Act, the Comptroller General shall submit to Congress a report containing any findings and determinations made in the study required by subsection (a).</content></subsection></section>
