<section id="d317e88" identifier="/us/pl/119/12/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x80a14407-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s609">47 USC 609 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks Act</shortTitle>” or the “<shortTitle role="act">TAKE IT DOWN Act</shortTitle>”.</content></section>
<section id="d317e106" identifier="/us/pl/119/12/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>CRIMINAL PROHIBITION ON INTENTIONAL DISCLOSURE OF NONCONSENSUAL INTIMATE VISUAL DEPICTIONS.</heading><subsection class="firstIndent0 fontsize10" id="y80ac1978-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10 smallCaps">In General<inline class="noSmallCaps">.—</inline></heading><chapeau>Section 223 of the Communications Act of 1934 (<ref href="/us/usc/t47/s223">47 U.S.C. 223</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y80ac1979-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (h) as subsection (i); and</content></paragraph><paragraph class="fontsize10" id="y80ac197a-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (g) the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y80afea0b-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10 smallCaps">Intentional Disclosure of Nonconsensual Intimate Visual Depictions<inline class="noSmallCaps">.—</inline></heading><paragraph class="fontsize10" id="y80afea0c-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10 smallCaps">Definitions<inline class="noSmallCaps">.—</inline></heading><chapeau>In this subsection:</chapeau><subparagraph class="fontsize10" id="y80afea0d-4785-11f0-b5cf-9995b70dcd9b" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10 smallCaps">Consent<inline class="noSmallCaps">.—</inline></heading><content>The term ‘<term>consent</term>’ means an affirmative, conscious, and voluntary authorization made by an individual free from force, fraud, duress, misrepresentation, or coercion.</content></subparagraph><subparagraph class="fontsize10" id="y80afea0e-4785-11f0-b5cf-9995b70dcd9b" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10 smallCaps">Digital forgery<inline class="noSmallCaps">.—</inline></heading><content>The term ‘<term>digital forgery</term>’ means any intimate visual depiction of an identifiable individual created through the use of software, machine learning, artificial intelligence, or any other computer-generated or technological means, including by adapting, modifying, manipulating, or altering an authentic visual depiction, that, when viewed as a whole by a reasonable person, is indistinguishable from an authentic visual depiction of the individual.</content></subparagraph><subparagraph class="fontsize10" id="y80afea0f-4785-11f0-b5cf-9995b70dcd9b" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10 smallCaps">Identifiable individual<inline class="noSmallCaps">.—</inline></heading><chapeau>The term ‘<term>identifiable individual</term>’ means an individual—</chapeau><clause class="fontsize10" id="y80afea10-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>who appears in whole or in part in an intimate visual depiction; and</content></clause><clause class="fontsize10" id="y80afea11-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>whose face, likeness, or other distinguishing characteristic (including a unique birthmark or other recognizable feature) is displayed in connection with such intimate visual depiction.</content></clause></subparagraph><subparagraph class="fontsize10" id="y80afea12-4785-11f0-b5cf-9995b70dcd9b" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10 smallCaps">Interactive computer service<inline class="noSmallCaps">.—</inline></heading><content>The term ‘<term>interactive computer service</term>’ has the meaning given the term in section 230.<page identifier="/us/stat/139/56">139 STAT. 56</page></content></subparagraph><subparagraph class="fontsize10" id="y80b01123-4785-11f0-b5cf-9995b70dcd9b" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><heading class="fontsize10 smallCaps">Intimate visual depiction<inline class="noSmallCaps">.—</inline></heading><content>The term ‘<term>intimate visual depiction</term>’ has the meaning given such term in section 1309 of the Consolidated Appropriations Act, 2022 (<ref href="/us/usc/t15/s6851">15 U.S.C. 6851</ref>).</content></subparagraph><subparagraph class="fontsize10" id="y80b01124-4785-11f0-b5cf-9995b70dcd9b" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><heading class="fontsize10 smallCaps">Minor<inline class="noSmallCaps">.—</inline></heading><content>The term ‘<term>minor</term>’ means any individual under the age of 18 years.</content></subparagraph></paragraph><paragraph class="fontsize10" id="y80b01125-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10 smallCaps">Offense involving authentic intimate visual depictions<inline class="noSmallCaps">.—</inline></heading><subparagraph class="fontsize10" id="y80b01126-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10 smallCaps">Involving adults<inline class="noSmallCaps">.—</inline></heading><chapeau>Except as provided in subparagraph (C), it shall be unlawful for any person, in interstate or foreign commerce, to use an interactive computer service to knowingly publish an intimate visual depiction of an identifiable individual who is not a minor if—</chapeau><clause class="fontsize10" id="y80b01127-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the intimate visual depiction was obtained or created under circumstances in which the person knew or reasonably should have known the identifiable individual had a reasonable expectation of privacy;</content></clause><clause class="fontsize10" id="y80b01128-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>what is depicted was not voluntarily exposed by the identifiable individual in a public or commercial setting;</content></clause><clause class="fontsize10" id="y80b01129-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>what is depicted is not a matter of public concern; and</content></clause><clause class="fontsize10" id="y80b0112a-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><chapeau>publication of the intimate visual depiction—</chapeau><subclause class="fontsize10" id="y80b0112b-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>is intended to cause harm; or</content></subclause><subclause class="fontsize10" id="y80b0112c-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>causes harm, including psychological, financial, or reputational harm, to the identifiable individual.</content></subclause></clause></subparagraph><subparagraph class="fontsize10" id="y80b0112d-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10 smallCaps">Involving minors<inline class="noSmallCaps">.—</inline></heading><chapeau>Except as provided in subparagraph (C), it shall be unlawful for any person, in interstate or foreign commerce, to use an interactive computer service to knowingly publish an intimate visual depiction of an identifiable individual who is a minor with intent to—</chapeau><clause class="fontsize10" id="y80b0112e-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>abuse, humiliate, harass, or degrade the minor; or</content></clause><clause class="fontsize10" id="y80b0112f-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>arouse or gratify the sexual desire of any person.</content></clause></subparagraph><subparagraph class="fontsize10" id="y80b03840-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10 smallCaps">Exceptions<inline class="noSmallCaps">.—</inline></heading><chapeau>Subparagraphs (A) and (B) shall not apply to—</chapeau><clause class="fontsize10" id="y80b03841-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>a lawfully authorized investigative, protective, or intelligence activity of—</chapeau><subclause class="fontsize10" id="y80b03842-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>a law enforcement agency of the United States, a State, or a political subdivision of a State; or</content></subclause><subclause class="fontsize10" id="y80b03843-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>an intelligence agency of the United States;</content></subclause></clause><clause class="fontsize10" id="y80b03844-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>a disclosure made reasonably and in good faith—</chapeau><subclause class="fontsize10" id="y80b03845-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>to a law enforcement officer or agency;</content></subclause><subclause class="fontsize10" id="y80b03846-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>as part of a document production or filing associated with a legal proceeding;</content></subclause><subclause class="fontsize10" id="y80b03847-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>as part of medical education, diagnosis, or treatment or for a legitimate medical, scientific, or education purpose;</content></subclause><subclause class="fontsize10" id="y80b03848-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>in the reporting of unlawful content or unsolicited or unwelcome conduct or in pursuance <page identifier="/us/stat/139/57">139 STAT. 57</page>
of a legal, professional, or other lawful obligation; or</content></subclause><subclause class="fontsize10" id="y80b03849-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><content>to seek support or help with respect to the receipt of an unsolicited intimate visual depiction;</content></subclause></clause><clause class="fontsize10" id="y80b0384a-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>a disclosure reasonably intended to assist the identifiable individual;</content></clause><clause class="fontsize10" id="y80b0384b-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>a person who possesses or publishes an intimate visual depiction of himself or herself engaged in nudity or sexually explicit conduct (as that term is defined in <ref href="/us/usc/t18/s2256/2/A">section 2256(2)(A) of title 18, United States Code</ref>); or</content></clause><clause class="fontsize10" id="y80b0384c-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><chapeau>the publication of an intimate visual depiction that constitutes—</chapeau><subclause class="fontsize10" id="y80b0384d-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>child pornography (as that term is defined in <ref href="/us/usc/t18/s2256">section 2256 of title 18, United States Code</ref>); or</content></subclause><subclause class="fontsize10" id="y80b0384e-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>a visual depiction described in subsection (a) or (b) of <ref href="/us/usc/t18/s1466A">section 1466A of title 18, United States Code</ref> (relating to obscene visual representations of the sexual abuse of children).</content></subclause></clause></subparagraph></paragraph><paragraph class="fontsize10" id="y80b0384f-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10 smallCaps">Offense involving digital forgeries<inline class="noSmallCaps">.—</inline></heading><subparagraph class="fontsize10" id="y80b03850-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10 smallCaps">Involving adults<inline class="noSmallCaps">.—</inline></heading><chapeau>Except as provided in subparagraph (C), it shall be unlawful for any person, in interstate or foreign commerce, to use an interactive computer service to knowingly publish a digital forgery of an identifiable individual who is not a minor if—</chapeau><clause class="fontsize10" id="y80b03851-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the digital forgery was published without the consent of the identifiable individual;</content></clause><clause class="fontsize10" id="y80b05f62-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>what is depicted was not voluntarily exposed by the identifiable individual in a public or commercial setting;</content></clause><clause class="fontsize10" id="y80b05f63-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>what is depicted is not a matter of public concern; and</content></clause><clause class="fontsize10" id="y80b05f64-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><chapeau>publication of the digital forgery—</chapeau><subclause class="fontsize10" id="y80b05f65-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>is intended to cause harm; or</content></subclause><subclause class="fontsize10" id="y80b05f66-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>causes harm, including psychological, financial, or reputational harm, to the identifiable individual.</content></subclause></clause></subparagraph><subparagraph class="fontsize10" id="y80b05f67-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10 smallCaps">Involving minors<inline class="noSmallCaps">.—</inline></heading><chapeau>Except as provided in subparagraph (C), it shall be unlawful for any person, in interstate or foreign commerce, to use an interactive computer service to knowingly publish a digital forgery of an identifiable individual who is a minor with intent to—</chapeau><clause class="fontsize10" id="y80b05f68-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>abuse, humiliate, harass, or degrade the minor; or</content></clause><clause class="fontsize10" id="y80b05f69-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>arouse or gratify the sexual desire of any person.</content></clause></subparagraph><subparagraph class="fontsize10" id="y80b05f6a-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10 smallCaps">Exceptions<inline class="noSmallCaps">.—</inline></heading><chapeau>Subparagraphs (A) and (B) shall not apply to—</chapeau><clause class="fontsize10" id="y80b05f6b-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>a lawfully authorized investigative, protective, or intelligence activity of—</chapeau><subclause class="fontsize10" id="y80b05f6c-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>a law enforcement agency of the United States, a State, or a political subdivision of a State; or<page identifier="/us/stat/139/58">139 STAT. 58</page></content></subclause><subclause class="fontsize10" id="y80b05f6d-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>an intelligence agency of the United States;</content></subclause></clause><clause class="fontsize10" id="y80b05f6e-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>a disclosure made reasonably and in good faith—</chapeau><subclause class="fontsize10" id="y80b05f6f-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>to a law enforcement officer or agency;</content></subclause><subclause class="fontsize10" id="y80b05f70-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>as part of a document production or filing associated with a legal proceeding;</content></subclause><subclause class="fontsize10" id="y80b08581-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>as part of medical education, diagnosis, or treatment or for a legitimate medical, scientific, or education purpose;</content></subclause><subclause class="fontsize10" id="y80b08582-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>in the reporting of unlawful content or unsolicited or unwelcome conduct or in pursuance of a legal, professional, or other lawful obligation; or</content></subclause><subclause class="fontsize10" id="y80b08583-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><content>to seek support or help with respect to the receipt of an unsolicited intimate visual depiction;</content></subclause></clause><clause class="fontsize10" id="y80b08584-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>a disclosure reasonably intended to assist the identifiable individual;</content></clause><clause class="fontsize10" id="y80b08585-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>a person who possesses or publishes a digital forgery of himself or herself engaged in nudity or sexually explicit conduct (as that term is defined in <ref href="/us/usc/t18/s2256/2/A">section 2256(2)(A) of title 18, United States Code</ref>); or</content></clause><clause class="fontsize10" id="y80b08586-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><chapeau>the publication of an intimate visual depiction that constitutes—</chapeau><subclause class="fontsize10" id="y80b08587-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>child pornography (as that term is defined in <ref href="/us/usc/t18/s2256">section 2256 of title 18, United States Code</ref>); or</content></subclause><subclause class="fontsize10" id="y80b08588-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>a visual depiction described in subsection (a) or (b) of <ref href="/us/usc/t18/s1466A">section 1466A of title 18, United States Code</ref> (relating to obscene visual representations of the sexual abuse of children).</content></subclause></clause></subparagraph></paragraph><paragraph class="fontsize10" id="y80b08589-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10 smallCaps">Penalties<inline class="noSmallCaps">.—</inline></heading><subparagraph class="fontsize10" id="y80b0858a-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10 smallCaps">Offenses involving adults<inline class="noSmallCaps">.—</inline></heading><content>Any person who violates paragraph (2)(A) or (3)(A) shall be fined under <ref href="/us/usc/t18">title 18, United States Code</ref>, imprisoned not more than 2 years, or both.</content></subparagraph><subparagraph class="fontsize10" id="y80b0858b-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10 smallCaps">Offenses involving minors<inline class="noSmallCaps">.—</inline></heading><content>Any person who violates paragraph (2)(B) or (3)(B) shall be fined under <ref href="/us/usc/t18">title 18, United States Code</ref>, imprisoned not more than 3 years, or both.</content></subparagraph></paragraph><paragraph class="fontsize10" id="y80b0858c-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10 smallCaps">Rules of construction<inline class="noSmallCaps">.—</inline></heading><chapeau>For purposes of paragraphs (2) and (3)—</chapeau><subparagraph class="fontsize10" id="y80b0858d-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the fact that the identifiable individual provided consent for the creation of the intimate visual depiction shall not establish that the individual provided consent for the publication of the intimate visual depiction; and</content></subparagraph><subparagraph class="fontsize10" id="y80b0858e-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the fact that the identifiable individual disclosed the intimate visual depiction to another individual shall not establish that the identifiable individual provided consent for the publication of the intimate visual depiction by the person alleged to have violated paragraph (2) or (3), respectively.</content></subparagraph></paragraph><paragraph class="fontsize10" id="y80b0ac9f-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10 smallCaps">Threats<inline class="noSmallCaps">.—</inline></heading><subparagraph class="fontsize10" id="y80b0aca0-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10 smallCaps">Threats involving authentic intimate visual depictions<inline class="noSmallCaps">.—</inline></heading><content>Any person who intentionally threatens to commit an offense under paragraph (2) for the purpose <page identifier="/us/stat/139/59">139 STAT. 59</page>

style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>notify the covered platform of an intimate visual depiction published on the covered platform that—</chapeau><subclause class="fontsize10" id="y80b2cf99-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/1/A/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>includes a depiction of the identifiable individual; and</content></subclause><subclause class="fontsize10" id="y80b2cf9a-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/1/A/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>was published without the consent of the identifiable individual; and</content></subclause></clause><clause class="fontsize10" id="y80b2cf9b-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>submit a request for the covered platform to remove such intimate visual depiction.</content></clause></subparagraph><subparagraph class="fontsize10" id="y80b2cf9c-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10 smallCaps">Requirements<inline class="noSmallCaps">.—</inline></heading><chapeau>A notification and request for removal of an intimate visual depiction submitted under the process established under subparagraph (A) shall include, in writing—</chapeau><clause class="fontsize10" id="y80b2cf9d-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>a physical or electronic signature of the identifiable individual (or an authorized person acting on behalf of such individual);</content></clause><clause class="fontsize10" id="y80b2cf9e-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>an identification of, and information reasonably sufficient for the covered platform to locate, the intimate visual depiction of the identifiable individual;</content></clause><clause class="fontsize10" id="y80b2f6af-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/1/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>a brief statement that the identifiable individual has a good faith belief that any intimate visual depiction identified under clause (ii) is not consensual, including any relevant information for the covered platform to determine the intimate visual depiction was published without the consent of the identifiable individual; and</content></clause><clause class="fontsize10" id="y80b2f6b0-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/1/B/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>information sufficient to enable the covered platform to contact the identifiable individual (or an authorized person acting on behalf of such individual).</content></clause></subparagraph></paragraph><paragraph class="fontsize10" id="y80b2f6b1-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10 smallCaps">Notice of process<inline class="noSmallCaps">.—</inline></heading><chapeau>A covered platform shall provide on the platform a clear and conspicuous notice, which may be provided through a clear and conspicuous link to another web page or disclosure, of the notice and removal process established under paragraph (1)(A) that—</chapeau><subparagraph class="fontsize10" id="y80b2f6b2-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is easy to read and in plain language; and</content></subparagraph><subparagraph class="fontsize10" id="y80b2f6b3-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>provides information regarding the responsibilities of the covered platform under this section, including a description of how an individual can submit a notification and request for removal.</content></subparagraph></paragraph><paragraph class="fontsize10" id="y80b2f6b4-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10 smallCaps">Removal of nonconsensual intimate visual depictions<inline class="noSmallCaps">.—</inline></heading><chapeau>Upon<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x80b2f6b5-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658180">Deadline.</p></sidenote> receiving a valid removal request from an identifiable individual (or an authorized person acting on behalf of such individual) using the process described in paragraph (1)(A)(ii), a covered platform shall, as soon as possible, but not later than 48 hours after receiving such request—</chapeau><subparagraph class="fontsize10" id="y80b2f6b6-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>remove the intimate visual depiction; and</content></subparagraph><subparagraph class="fontsize10" id="y80b2f6b7-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>make reasonable efforts to identify and remove any known identical copies of such depiction.</content></subparagraph></paragraph><paragraph class="fontsize10" id="y80b2f6b8-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10 smallCaps">Limitation on liability<inline class="noSmallCaps">.—</inline></heading><content>A covered platform shall not be liable for any claim based on the covered platform’s good faith disabling of access to, or removal of, material claimed to be a nonconsensual intimate visual depiction based on facts or circumstances from which the unlawful publishing of an intimate visual depiction is apparent, regardless of whether the intimate visual depiction is ultimately determined to be unlawful or not.<page identifier="/us/stat/139/61">139 STAT. 61</page></content></paragraph></subsection><subsection class="firstIndent0 fontsize10" id="y80b2f6b9-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10 smallCaps">Enforcement by the Commission<inline class="noSmallCaps">.—</inline></heading><paragraph class="fontsize10" id="y80b2f6ba-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10 smallCaps">Unfair or deceptive acts or practices<inline class="noSmallCaps">.—</inline></heading><content>A failure to reasonably comply with the notice and takedown obligations under subsection (a) shall be treated as a violation of a rule defining an unfair or a deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<ref href="/us/usc/t15/s57a/a/1/B">15 U.S.C. 57a(a)(1)(B)</ref>).</content></paragraph><paragraph class="fontsize10" id="y80b2f6bb-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10 smallCaps">Powers of the commission<inline class="noSmallCaps">.—</inline></heading><subparagraph class="fontsize10" id="y80b2f6bc-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10 smallCaps">In general<inline class="noSmallCaps">.—</inline></heading><content>Except as provided in subparagraph (D), the Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<ref href="/us/usc/t15/s41/etseq">15 U.S.C. 41 et seq.</ref>) were incorporated into and made a part of this section.</content></subparagraph><subparagraph class="fontsize10" id="y80b2f6bd-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10 smallCaps">Privileges and immunities<inline class="noSmallCaps">.—</inline></heading><content>Any person who violates this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<ref href="/us/usc/t15/s41/etseq">15 U.S.C. 41 et seq.</ref>).</content></subparagraph><subparagraph class="fontsize10" id="y80b31dce-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10 smallCaps">Authority preserved<inline class="noSmallCaps">.—</inline></heading><content>Nothing in this Act shall be construed to limit the authority of the Federal Trade Commission under any other provision of law.</content></subparagraph><subparagraph class="fontsize10" id="y80b31dcf-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s3/b/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10 smallCaps">Scope of jurisdiction<inline class="noSmallCaps">.—</inline></heading><content>Notwithstanding sections 4, 5(a)(2), or 6 of the Federal Trade Commission Act (<ref href="/us/usc/t15/s44">15 U.S.C. 44</ref>, 45(a)(2), 46), or any jurisdictional limitation of the Commission, the Commission shall also enforce this section in the same manner provided in subparagraph (A), with respect to organizations that are not organized to carry on business for their own profit or that of their members.</content></subparagraph></paragraph></subsection></section>
<section id="d317e905" identifier="/us/pl/119/12/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x80b31dd0-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s223a">47 USC 223a note</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x80b3e121-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y80b40832-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10 smallCaps">Commission<inline class="noSmallCaps">.—</inline></heading><content>The term “<term>Commission</term>” means the Federal Trade Commission.</content></paragraph><paragraph class="fontsize10" id="y80b40833-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10 smallCaps">Consent; digital forgery; identifiable individual; intimate visual depiction<inline class="noSmallCaps">.—</inline></heading><content>The terms “consent”, “digital forgery”, “identifiable individual”, “intimate visual depiction”, and “minor” have the meaning given such terms in section 223(h) of the Communications Act of 1934 (<ref href="/us/usc/t47/s223">47 U.S.C. 223</ref>), as added by section 2.</content></paragraph><paragraph class="fontsize10" id="y80b40834-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10 smallCaps">Covered platform<inline class="noSmallCaps">.—</inline></heading><subparagraph class="fontsize10" id="y80b40835-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/3/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10 smallCaps">In general<inline class="noSmallCaps">.—</inline></heading><chapeau>The term “<term>covered platform</term>” means a website, online service, online application, or mobile application—</chapeau><clause class="fontsize10" id="y80b40836-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>that serves the public; and</content></clause><clause class="fontsize10" id="y80b40837-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii)</num><subclause class="inline" id="y80b40838-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/3/A/ii/I"><num value="I">(I) </num><content>that primarily provides a forum for user-generated content, including messages, videos, images, games, and audio files; or</content></subclause><subclause class="indentUp0 fontsize10" id="y80b40839-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/3/A/ii/II" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>for which it is in the regular course of trade or business of the website, online service, online application, or mobile application to publish, curate, host, or make available content of nonconsensual intimate visual depictions.</content></subclause></clause></subparagraph><subparagraph class="fontsize10" id="y80b4083a-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/3/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10 smallCaps">Exclusions<inline class="noSmallCaps">.—</inline></heading><chapeau>The term “<term>covered platform</term>” shall not include the following:<page identifier="/us/stat/139/62">139 STAT. 62</page></chapeau><clause class="fontsize10" id="y80b4083b-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/3/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>A provider of broadband internet access service (as described in <ref href="/us/cfr/t47/s8.1/b">section 8.1(b) of title 47, Code of Federal Regulations</ref>, or successor regulation).</content></clause><clause class="fontsize10" id="y80b4083c-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/3/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>Electronic mail.</content></clause><clause class="fontsize10" id="y80b4083d-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/3/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><chapeau>Except as provided in subparagraph (A)(ii)(II), an online service, application, or website—</chapeau><subclause class="fontsize10" id="y80b4083e-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/3/B/iii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>that consists primarily of content that is not user generated but is preselected by the provider of such online service, application, or website; and</content></subclause><subclause class="fontsize10" id="y80b4083f-4785-11f0-b5cf-9995b70dcd9b" identifier="/us/pl/119/12/s4/3/B/iii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>for which any chat, comment, or interactive functionality is incidental to, directly related to, or dependent on the provision of the content described in subclause (I).</content></subclause></clause></subparagraph></paragraph></section>
<section id="d317e1002" identifier="/us/pl/119/12/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x80b42f50-4785-11f0-b5cf-9995b70dcd9b" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s223">47 USC 223 note</ref>.</p></sidenote><heading>SEVERABILITY.</heading><content style="-uslm-lc:I658120">  If any provision of this Act, or an amendment made by this Act, is determined to be unenforceable or invalid, the remaining provisions of this Act and the amendments made by this Act shall not be affected.</content></section>
