<section id="d1432e94" identifier="/us/pl/118/98/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Customs Trade Partnership Against Terrorism Pilot Program Act of 2023</shortTitle>” or the “<shortTitle role="act">CTPAT Pilot Program Act of 2023</shortTitle>”.</content></section>
<section id="d1432e107" identifier="/us/pl/118/98/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x8b20d652-e809-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y8b20d653-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees</inline>.—</heading><chapeau>The term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="fontsize10" id="y8b20d654-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Homeland Security and Governmental Affairs and the Committee on Finance of the Senate; and</content></subparagraph>
<subparagraph class="fontsize10" id="y8b20d655-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Homeland Security and the Committee on Ways and Means of the House of Representatives.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y8b20d656-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">CTPAT</inline>.—</heading><content>The term “<term>CTPAT</term>” means the Customs Trade Partnership Against Terrorism established under subtitle B of title II of the Security and Accountability for Every Port Act (<ref href="/us/usc/t6/s961/etseq">6 U.S.C. 961 et seq.</ref>).</content></paragraph>
</section>
<section id="d1432e146" identifier="/us/pl/118/98/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>PILOT PROGRAM ON PARTICIPATION OF THIRD-PARTY LOGISTICS PROVIDERS IN CTPAT.</heading><subsection class="firstIndent0 fontsize10" id="y8b2199a7-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><paragraph class="fontsize10" id="y8b2199a8-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary of Homeland Security shall carry out a pilot program to assess whether allowing entities described in subsection (b) to participate in CTPAT would enhance port security, combat terrorism, prevent supply chain security breaches, or otherwise meet the goals of CTPAT.</content></paragraph>
<paragraph class="fontsize10" id="y8b2199a9-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8b2199aa-e809-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><inline class="smallCaps">Federal register notice</inline>.—</heading><content>Not later than one year after the date of the enactment of this Act, the Secretary shall publish in the Federal Register a notice specifying the requirements for the pilot program required by paragraph (1).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8b2199ab-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Entities Described</inline>.—</heading><chapeau>An entity described in this subsection is—</chapeau><paragraph class="fontsize10" id="y8b2199ac-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>a non-asset-based third-party logistics provider that—</chapeau><subparagraph class="fontsize10" id="y8b2199ad-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>arranges international transportation of freight and is licensed by the Department of Transportation; and</content></subparagraph>
<subparagraph class="fontsize10" id="y8b2199ae-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>meets such other requirements as the Secretary specifies in the Federal Register notice required by subsection (a)(2); or<page identifier="/us/stat/138/1576">138 STAT. 1576</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y8b2199af-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>an asset-based third-party logistics provider that—</chapeau><subparagraph class="fontsize10" id="y8b2199b0-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>facilitates cross border activity and is licensed or bonded by the Federal Maritime Commission, the Transportation Security Administration, U.S. Customs and Border Protection, or the Department of Transportation;</content></subparagraph>
<subparagraph class="fontsize10" id="y8b2199b1-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>manages and executes logistics services using its own warehousing assets and resources on behalf of its customers; and</content></subparagraph>
<subparagraph class="fontsize10" id="y8b2199b2-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>meets such other requirements as the Secretary specifies in the Federal Register notice required by subsection (a)(2).</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8b2199b3-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8b2199b4-e809-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>In carrying out the pilot program required by subsection (a)(1), the Secretary shall—</chapeau><paragraph class="fontsize10" id="y8b21c0c5-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>ensure that—</chapeau><subparagraph class="fontsize10" id="y8b21c0c6-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>not more than 10 entities described in paragraph (1) of subsection (b) participate in the pilot program; and</content></subparagraph>
<subparagraph class="fontsize10" id="y8b21c0c7-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>not more than 10 entities described in paragraph (2) of that subsection participate in the program;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y8b21c0c8-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>provide for the participation of those entities on a voluntary basis;</content></paragraph>
<paragraph class="fontsize10" id="y8b21c0c9-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>continue the program for a period of not less than one year after the date on which the Secretary publishes the Federal Register notice required by subsection (a)(2); and</content></paragraph>
<paragraph class="fontsize10" id="y8b21c0ca-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8b21c0cb-e809-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Termination date.</p></sidenote>terminate the pilot program not more than 5 years after that date.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8b21c0cc-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8b21c0cd-e809-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Report Required</inline>.—</heading><content>Not later than 180 days after the termination of the pilot program under subsection (c)(4), the Secretary shall submit to the appropriate congressional committees a report on the findings of, and any recommendations arising from, the pilot program concerning the participation in CTPAT of entities described in subsection (b), including an assessment of participation by those entities.</content></subsection>
</section>
<section id="d1432e286" identifier="/us/pl/118/98/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>REPORT ON EFFECTIVENESS OF CTPAT.</heading><subsection class="firstIndent0 fontsize10" id="y8b220eee-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not later than one year after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the appropriate congressional committees a report assessing the effectiveness of CTPAT.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8b220eef-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8b220ef0-e809-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Analyses.</p></sidenote><inline class="smallCaps">Elements</inline>.—</heading><chapeau>The report required by subsection (a) shall include the following:</chapeau><paragraph class="fontsize10" id="y8b220ef1-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>An analysis of—</chapeau><subparagraph class="fontsize10" id="y8b220ef2-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s4/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>security incidents in the cargo supply chain during the 5-year period preceding submission of the report that involved criminal activity, including drug trafficking, human smuggling, commercial fraud, or terrorist activity; and</content></subparagraph>
<subparagraph class="fontsize10" id="y8b220ef3-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s4/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>whether those incidents involved participants in CTPAT or entities not participating in CTPAT.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y8b220ef4-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>An analysis of causes for the suspension or removal of entities from participating in CTPAT as a result of security incidents during that 5-year period.</content></paragraph>
<paragraph class="fontsize10" id="y8b220ef5-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s4/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>An analysis of the number of active CTPAT participants involved in one or more security incidents while maintaining their status as participants.</content></paragraph>
<paragraph class="fontsize10" id="y8b220ef6-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/98/s4/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8b220ef7-e809-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x8b220ef8-e809-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote>Recommendations to the Commissioner of U.S. Customs and Border Protection for improvements to CTPAT to improve <page identifier="/us/stat/138/1577">138 STAT. 1577</page>
prevention of security incidents in the cargo supply chain involving participants in CTPAT.</content></paragraph>
</subsection>
</section>
<section id="d1432e351" identifier="/us/pl/118/98/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>NO ADDITIONAL FUNDS AUTHORIZED.</heading><content style="-uslm-lc:I658120">  No additional funds are authorized to be appropriated for the purpose of carrying out this Act.</content></section>
