<section id="d1185e88" identifier="/us/pl/118/95/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa2dda64f-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s101">38 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Veteran Improvement Commercial Driver License Act of 2023</shortTitle>”.</content></section>
<section id="d1185e103" identifier="/us/pl/118/95/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>MODIFICATION OF RULES FOR APPROVAL OF COMMERCIAL DRIVER EDUCATION PROGRAMS FOR PURPOSES OF VETERANS EDUCATIONAL ASSISTANCE.</heading><subsection class="firstIndent0 fontsize10" id="ya2de4290-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/95/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><ref href="/us/usc/t38/s3680A/e">Section 3680A(e) of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ya2de4291-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/95/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (1) through (3) as subparagraphs (A) though (C), respectively;</content></paragraph>
<paragraph class="fontsize10" id="ya2de4292-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/95/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in the matter before subparagraph (A), as redesignated by paragraph (1), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(1)</quotedText>” before “<quotedText>The Secretary</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="ya2de4293-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/95/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in paragraph (1)(B), as redesignated by paragraph (1), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>except as provided in paragraph (2),</quotedText>” before “<quotedText>the course</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="ya2de4294-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/95/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph (2):<quotedContent><paragraph class="indentDown1 firstIndent0 fontsize10" id="ya2de69a5-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2)</num><subparagraph class="inline" id="ya2de90b6-e809-11f0-a1e4-69761a48a15a"><num value="A">(A) </num><chapeau>Subject to this paragraph, a commercial driver education program is exempt from paragraph (1)(B) for a branch of an educational institution if the commercial driver education program offered at the branch by the educational institution—</chapeau><clause class="fontsize10" id="ya2de90b7-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is appropriately licensed; and</content></clause>
<clause class="fontsize10" id="ya2de90b8-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>uses the same curriculum as a commercial driver education program offered by the educational institution at another location that is approved for purposes of this chapter by a State approving agency or the Secretary when acting in the role of a State approving agency.</content></clause>
</subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="ya2de90b9-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B)</num><clause class="inline" id="ya2de90ba-e809-11f0-a1e4-69761a48a15a"><num value="i">(i) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa2de90bb-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote>In order for a commercial driver education program of an educational institution offered at a branch described in paragraph (1)(B) to be exempt under subparagraph (A) of this paragraph, the educational institution shall submit to the Secretary each year that paragraph (1)(B) would otherwise apply a report that demonstrates that the curriculum at the new branch is the same as the curriculum at the primary location.</content></clause>
<clause class="indentUp0 firstIndent0 fontsize10" id="ya2de90bc-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>Reporting under clause (i) shall be submitted in accordance with such requirements as the Secretary shall establish in consultation with the State approving agencies.<page identifier="/us/stat/138/1568">138 STAT. 1568</page></content></clause>
</subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="ya2de90bd-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C)</num><clause class="inline" id="ya2de90be-e809-11f0-a1e4-69761a48a15a"><num value="i">(i) </num><content>The Secretary may withhold an exemption under subparagraph (A) for any educational institution or branch of an educational institution as the Secretary considers appropriate.</content></clause>
<clause class="indentUp0 firstIndent0 fontsize10" id="ya2de90bf-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>In making any determination under clause (i), the Secretary may consult with the Secretary of Transportation on the performance of a provider of a commercial driver program, including the status of the provider within the Training Provider Registry of the Federal Motor Carrier Safety Administration when appropriate.”</content></clause>

<subsection class="firstIndent0 fontsize10" id="ya2de90c0-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/95/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><paragraph class="fontsize10" id="ya2de90c1-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/95/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa2de90c2-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xa2de90c3-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3680A">38 USC 3680A note</ref>.</p></sidenote><inline class="smallCaps">Establishment of requirements</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall establish requirements under section 3680A(e)(2)(B)(ii) of such title, as added by subsection (a).</content></paragraph>
<paragraph class="fontsize10" id="ya2de90c4-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/95/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa2de90c5-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p><p class="leftAlign firstIndent0 fontsize8" id="xa2de90c6-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3680A">38 USC 3680A note</ref>.</p></sidenote><inline class="smallCaps">Applicability</inline>.—</heading><content>The amendments made by subsection (a) shall apply to commercial driver education programs on and after the date that is 180 days after the date on which the Secretary establishes the requirements under paragraph (1) of this subsection.</content></paragraph>
