<section id="d3491e98" identifier="/us/pl/118/78/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x36a5392f-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s1">18 USC 1 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Foreign Extortion Prevention Technical Corrections Act</shortTitle>”.</content></section>
<section id="d3491e113" identifier="/us/pl/118/78/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>TECHNICAL CORRECTION TO 2024 NDAA.</heading><subsection class="firstIndent0 fontsize10" id="y36a5d570-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/78/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Repeal of Previous Version of FEPA</inline>.—</heading><content>Section 5101 of the National Defense Authorization Act for Fiscal Year 2024 (<ref href="/us/pl/118/31">Public Law 118–31</ref>)<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x36a5d571-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s201">18 USC 201</ref>.</p></sidenote> is <amendingAction type="repeal">repealed</amendingAction>, and each provision of law amended by that section <amendingAction type="amend">is amended</amendingAction> to read as it read on the day before the date of enactment of that Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y36a5d572-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/78/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition of Demand for Bribe</inline>.—</heading><paragraph class="fontsize10" id="y36a5d573-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/78/s2/b/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content><ref href="/us/usc/t18/ch63">Chapter 63 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y36a698c4-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658164"><num class="fontsize12" value="1352">“§ 1352.</num><heading class="fontsize12"> Demands by foreign officials for bribes<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x36a698c5-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s1352">18 USC 1352</ref>.</p></sidenote></heading><subsection class="indentDown1 firstIndent0 fontsize10" id="y36a698c6-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y36a698c7-e80a-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Foreign official</inline>.—</heading><chapeau>The term ‘<term>foreign official</term>’ means—</chapeau><subparagraph class="fontsize10" id="y36a698c8-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A)</num><clause class="inline" id="y36a698c9-e80a-11f0-bc57-ad3ac4b1618c"><num value="i">(i) </num><content>any official or employee of a foreign government or any department, agency, or instrumentality thereof; or</content></clause>
<clause class="indentUp0 fontsize10" id="y36a698ca-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>any senior foreign political figure, as defined in <ref href="/us/cfr/t31/s1010.605">section 1010.605 of title 31, Code of Federal Regulations</ref>, or any successor regulation;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y36a698cb-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>any official or employee of a public international organization;</content></subparagraph>
<subparagraph class="fontsize10" id="y36a698cc-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>any person acting in an official capacity for or on behalf of—</chapeau><clause class="fontsize10" id="y36a698cd-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a government, department, agency, or instrumentality described in subparagraph (A)(i); or</content></clause>
<clause class="fontsize10" id="y36a698ce-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a public international organization.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y36a698cf-e80a-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Public international organization</inline>.—</heading><chapeau>The term ‘<term>public international organization</term>’ means—</chapeau><subparagraph class="fontsize10" id="y36a698d0-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>an organization that is designated by Executive order pursuant to section 1 of the International Organizations Immunities Act (<ref href="/us/usc/t22/s288">22 U.S.C. 288</ref>); or</content></subparagraph>
<subparagraph class="fontsize10" id="y36a698d1-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x36a698d2-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p></sidenote><content>any other international organization that is designated by the President by Executive order for the purposes of this section, effective as of the date of publication of the order in the Federal Register.<page identifier="/us/stat/138/1513">138 STAT. 1513</page></content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y36a698d3-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition of Demand for a Bribe</inline>.—</heading><paragraph class="fontsize10" id="y36a698d4-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Offense</inline>.—</heading><chapeau>It shall be unlawful for any foreign official or person selected to be a foreign official to corruptly demand, seek, receive, accept, or agree to receive or accept, directly or indirectly, anything of value personally or for any other person or nongovernmental entity, by making use of the mails or any means or instrumentality of interstate commerce—</chapeau><subparagraph class="fontsize10" id="y36a6bfe5-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>from—</chapeau><clause class="fontsize10" id="y36a6bfe6-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x36a6bfe7-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote><content>any person (as defined in section 104A of the Foreign Corrupt Practices Act of 1977 (<ref href="/us/usc/t15/s78dd–3">15 U.S.C. 78dd–3</ref>), except that that definition shall be applied without regard to whether the person is an offender) while the foreign official or person selected to be a foreign official, or a person acting on behalf of the foreign official or person selected to be a foreign official, is in the territory of the United States;</content></clause>
<clause class="fontsize10" id="y36a6bfe8-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>an issuer (as defined in section 3(a) of the Securities Exchange Act of 1934 (<ref href="/us/usc/t15/s78c/a">15 U.S.C. 78c(a)</ref>)), or any officer, director, employee, or agent of an issuer or any stockholder thereof acting on behalf of the issuer; or</content></clause>
<clause class="fontsize10" id="y36a6bfe9-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>a domestic concern (as defined in section 104 of the Foreign Corrupt Practices Act of 1977 (<ref href="/us/usc/t15/s78dd–2">15 U.S.C. 78dd–2</ref>)), or any officer, director, employee, or agent of a domestic concern or any stockholder thereof acting on behalf of the domestic concern; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y36a6bfea-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>in return for—</chapeau><clause class="fontsize10" id="y36a6bfeb-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>being influenced in the performance of any act or decision of the foreign official or person selected to be a foreign official in the official capacity of the foreign official or person selected to be a foreign official;</content></clause>
<clause class="fontsize10" id="y36a6bfec-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>being induced to do or omit to do any act in violation of the lawful duty of the foreign official or person selected to be a foreign official;</content></clause>
<clause class="fontsize10" id="y36a6bfed-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>conferring any improper advantage; or</content></clause>
<clause class="fontsize10" id="y36a6bfee-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>using the influence of the foreign official or person selected to be a foreign official with a foreign government or instrumentality thereof to affect or influence any act or decision of that government or instrumentality,</content></clause>
<continuation class="firstIndent1 fontsize10" id="x36a6bfef-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124">in connection with obtaining or retaining business for or with, or directing business to, any person.</continuation></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y36a6bff0-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Penalties</inline>.—</heading><content>Any person who violates paragraph (1) shall be fined not more than $250,000 or 3 times the monetary equivalent of the thing of value, imprisoned for not more than 15 years, or both.</content></paragraph>
<paragraph class="fontsize10" id="y36a6bff1-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Jurisdiction</inline>.—</heading><content>An offense under paragraph (1) shall be subject to extraterritorial Federal jurisdiction.</content></paragraph>
<paragraph class="fontsize10" id="y36a6bff2-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x36a6bff3-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x36a6bff4-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="x36a6bff5-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting. </p></sidenote><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this section, and annually thereafter, the Attorney General, in consultation with the Secretary of State as relevant, shall submit to the Committee on the Judiciary and the Committee on Foreign Relations of the Senate and the Committee on the Judiciary and the Committee on Foreign Affairs of the House of Representatives, and post on the publicly available website of the Department of Justice, a report—</chapeau><page identifier="/us/stat/138/1514">138 STAT. 1514</page>
<subparagraph class="fontsize10" id="y36a6bff6-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>focusing, in part, on demands by foreign officials for bribes from entities domiciled or incorporated in the United States, and the efforts of foreign governments to prosecute such cases;</content></subparagraph>
<subparagraph class="fontsize10" id="y36a6bff7-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>addressing United States diplomatic efforts to protect entities domiciled or incorporated in the United States from foreign bribery, and the effectiveness of those efforts in protecting such entities;</content></subparagraph>
<subparagraph class="fontsize10" id="y36a6bff8-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x36a6bff9-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Summary.</p><p class="leftAlign firstIndent0 fontsize8" id="x36a6bffa-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><content>summarizing major actions taken under this section in the previous year, including enforcement actions taken and penalties imposed;</content></subparagraph>
<subparagraph class="fontsize10" id="y36a6bffb-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>evaluating the effectiveness of the Department of Justice in enforcing this section; and</content></subparagraph>
<subparagraph class="fontsize10" id="y36a6bffc-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>detailing what resources or legislative action the Department of Justice needs to ensure adequate enforcement of this section.<sidenote><p>Evaluation.</p></sidenote></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y36a6bffd-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Rule of construction</inline>.—</heading><content>This subsection shall not be construed as encompassing conduct that would violate section 30A of the Securities Exchange Act of 1934 (<ref href="/us/usc/t15/s78dd–1">15 U.S.C. 78dd–1</ref>) or section 104 or 104A of the Foreign Corrupt Practices Act of 1977 (<ref href="/us/usc/t15/s78dd–2">15 U.S.C. 78dd–2</ref>; <ref href="/us/usc/t15/s78dd–3">15 U.S.C. 78dd–3</ref>) whether pursuant to a theory of direct liability, conspiracy, complicity, or otherwise.”</content></paragraph>
