<section id="d3683e88" identifier="/us/pl/118/74/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x544e4d97-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t41/s101">41 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">All-American Flag Act</shortTitle>”.</content></section>
<section id="d3683e103" identifier="/us/pl/118/74/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>REQUIREMENT FOR AGENCIES TO BUY DOMESTICALLY MADE UNITED STATES FLAGS.</heading><subsection class="firstIndent0 fontsize10" id="y544ee9d8-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/74/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Requirement for Agencies To Buy Domestically Made United States Flags</inline>.—</heading><paragraph class="fontsize10" id="y544ee9d9-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/74/s2/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content><ref href="/us/usc/t41/ch63">Chapter 63 of title 41, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new section:<quotedContent><section class="centered fontsize12" id="y544f37fa-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658164"><num class="fontsize12" value="6310">“§ 6310.</num><heading class="fontsize12"> <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x544f37fb-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t41/s6310">41 USC 6310</ref>.</p></sidenote>Requirement for agencies to buy domestically made United States flags</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="y544f37fc-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Requirement</inline>.—</heading><content>Except as provided in subsections (b) through (d), funds appropriated or otherwise available to an agency may not be used for the procurement of any flag of the United States, unless such flag has been 100 percent manufactured in the United States from articles, materials, or supplies that have been grown or 100 percent produced or manufactured in the United States.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y544f37fd-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Availability Exception</inline>.—</heading><content>Subsection (a) does not apply to the extent that the head of the agency concerned determines that satisfactory quality and sufficient quantity of a flag described in such subsection cannot be procured as and when needed at United States market prices.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y544f37fe-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Exception for Certain Procurements</inline>.—</heading><chapeau>Subsection (a) does not apply to the following:</chapeau><paragraph class="fontsize10" id="y544f37ff-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>Procurements by vessels in foreign waters.</content></paragraph>
<paragraph class="fontsize10" id="y544f3800-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Procurements for resale purposes in any military commissary, military exchange, or nonappropriated fund instrumentality operated by an agency.</content></paragraph>
<paragraph class="fontsize10" id="y544f3801-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>Procurements for amounts less than the simplified acquisition threshold.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y544f3802-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Presidential Waiver</inline>.—</heading><paragraph class="fontsize10" id="y544f3803-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x544f3804-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The President may waive the requirement in subsection (a) if the President determines a waiver is necessary to comply with any trade agreement to which the United States is a party.<page identifier="/us/stat/138/1506">138 STAT. 1506</page></content></paragraph>
<paragraph class="fontsize10" id="y544f3805-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x544f3806-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x544f3807-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Federal Register, publication.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Notice of waiver</inline>.—</heading><content>Not later than 30 days after granting a waiver under paragraph (1), the President shall publish a notice of the waiver in the Federal Register.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y544f3808-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y544f3809-e80a-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Agency</inline>.—</heading><content>The term ‘<term>agency</term>’ has the meaning given the term ‘<term>executive agency</term>’ in section 102 of title 40.</content></paragraph>
<paragraph class="fontsize10" id="y544f380a-e80a-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Simplified acquisition threshold</inline>.—</heading><content>The term ‘<term>simplified acquisition threshold</term>’ has the meaning given that term in section 134.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y544f380e-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/74/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x544f380f-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t41/s6310">41 USC 6310 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content><ref href="/us/usc/t41/s6310">Section 6310 of title 41, United States Code</ref>, as added by subsection (a)(1), shall apply with respect to any contract entered into on or after the date that is 180 days after the date of the enactment of this Act.</content></subsection>
