<section id="d3971e88" identifier="/us/pl/118/70/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c5c4b0b-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s6901">22 USC 6901 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Promoting a Resolution to the Tibet-China Dispute Act</shortTitle>”.</content></section>
<section id="d3971e103" identifier="/us/pl/118/70/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6c5ce74c-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Congress finds the following:</chapeau><paragraph class="fontsize10" id="y6c5ce74d-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>It has been the long-standing policy of the United States to encourage meaningful and direct dialogue between representatives of the People’s Republic of China and the Dalai Lama, his or her representatives, or democratically elected leaders of the Tibetan community, without preconditions, to seek a settlement that resolves differences.</content></paragraph>
<paragraph class="fontsize10" id="y6c5ce74e-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Nine rounds of dialogue held between 2002 and 2010 between the People’s Republic of China authorities and the 14th Dalai Lama’s representatives failed to produce a settlement that resolved differences, and the two sides have held no formal dialogue since January 2010.</content></paragraph>
<paragraph class="fontsize10" id="y6c5ce74f-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>An obstacle to further dialogue is that the Government of the People’s Republic of China continues to impose conditions on substantive dialogue with the Dalai Lama, including a demand that he say that Tibet has been part of China since ancient times, which the Dalai Lama has refused to do because it is inaccurate.</content></paragraph>
<paragraph class="fontsize10" id="y6c5ce750-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Article 1 of the International Covenant on Civil and Political Rights and Article 1 of the International Covenant on Economic, Social and Cultural Rights provide, “All peoples have the right of self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development.”.</content></paragraph>
<paragraph class="fontsize10" id="y6c5ce751-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>The United States Government has never taken the position that Tibet was a part of China since ancient times.</content></paragraph>
<paragraph class="fontsize10" id="y6c5ce752-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>China signed the International Covenant on Civil and Political Rights on October 5, 1998, and ratified the International Covenant on Economic, Social and Cultural Rights on March 27, 2001.</content></paragraph>
<paragraph class="fontsize10" id="y6c5ce753-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s2/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>Under international law, including United Nations General Assembly Resolution 2625, the right to self-determination is the right of a people to determine its own destiny and the exercise of this right can result in a variety of outcomes <page identifier="/us/stat/138/1488">138 STAT. 1488</page>
ranging from independence, federation, protection, some form of autonomy, or full integration within a State.</content></paragraph>
<paragraph class="fontsize10" id="y6c5ce754-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s2/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>United Nations General Assembly Resolution 1723, adopted on December 20, 1961, called for the “cessation of practices which deprive the Tibetan people of their fundamental human rights and freedoms, including their right to self-determination”.</content></paragraph>
<paragraph class="fontsize10" id="y6c5ce755-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s2/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>Secretary of State Antony Blinken, in a May 26, 2022, speech entitled “The Administration’s Approach to the People’s Republic of China”, said that the rules-based international order’s “founding documents include the UN Charter and the Universal Declaration of Human Rights, which enshrined concepts like self-determination, sovereignty, the peaceful settlement of disputes. These are not Western constructs. They are reflections of the world’s shared aspirations.”.</content></paragraph>
<paragraph class="fontsize10" id="y6c5ce756-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s2/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>The Tibetan Policy Act of 2002 (<ref href="/us/usc/t22/s6901">22 U.S.C. 6901 note</ref>), as amended by the Tibetan Policy and Support Act of 2020 (<ref href="/us/pl/116/260/dFF/tIII/stE">subtitle E of title III of division FF of Public Law 116–260</ref>), in directing the United States Government “to promote the human rights and distinct religious, cultural, linguistic, and historical identity of the Tibetan people” acknowledges that the Tibetan people possess a distinct religious, cultural, linguistic, and historical identity.</content></paragraph>
<paragraph class="fontsize10" id="y6c5d0e67-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s2/11" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><content>Department of State reports on human rights and religious freedom have consistently documented systematic repression by the authorities of the People’s Republic of China against Tibetans as well as acts of defiance and resistance by Tibetan people against the People’s Republic of China policies.</content></paragraph>
<paragraph class="fontsize10" id="y6c5d0e68-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s2/12" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">(12) </num><content>The Tibetan Policy Act of 2002 (<ref href="/us/usc/t22/s6901">22 U.S.C. 6901 note</ref>) specifies that the central objective of the United States Special Coordinator for Tibetan Issues is to promote substantive dialogue between the Government of the People’s Republic of China and the Dalai Lama, his or her representatives, or democratically elected leaders of the Tibetan community.</content></paragraph>

<section id="d3971e187" identifier="/us/pl/118/70/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c5d0e69-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s6901">22 USC 6901 note</ref>.</p></sidenote><heading>STATEMENT OF POLICY.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6c5d5c8a-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  It is the policy of the United States—</chapeau><paragraph class="fontsize10" id="y6c5d5c8b-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>that the Tibetan people are a people with a distinct religious, cultural, linguistic, and historical identity;</content></paragraph>
<paragraph class="fontsize10" id="y6c5d5c8c-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>that the dispute between Tibet and the People’s Republic of China must be resolved in accordance with international law, including the United Nations Charter, by peaceful means, through dialogue without preconditions;</content></paragraph>
<paragraph class="fontsize10" id="y6c5d5c8d-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>that the People’s Republic of China should cease its propagation of disinformation about the history of Tibet, the Tibetan people, and Tibetan institutions, including that of the Dalai Lama;</content></paragraph>
<paragraph class="fontsize10" id="y6c5d5c8e-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s3/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>to encourage the People’s Republic of China to ratify the International Covenant on Civil and Political Rights and uphold all its commitments under the International Covenant on Economic, Social and Cultural Rights; and</content></paragraph>
<paragraph class="fontsize10" id="y6c5d5c8f-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s3/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><chapeau>in accordance with the Tibetan Policy and Support Act of 2020—</chapeau><subparagraph class="fontsize10" id="y6c5d5c90-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s3/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to promote substantive dialogue without pre-conditions, between the Government of the People’s Republic of China and the Dalai Lama, his or her representatives, <page identifier="/us/stat/138/1489">138 STAT. 1489</page>
or democratically elected leaders of the Tibetan community, or explore activities to improve prospects for dialogue, that leads to a negotiated agreement on Tibet;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c5d5c91-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s3/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to coordinate with other governments in multilateral efforts towards the goal of a negotiated agreement on Tibet; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6c5d5c92-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s3/5/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>to encourage the Government of the People’s Republic of China to address the aspirations of the Tibetan people with regard to their distinct historical, cultural, religious, and linguistic identity.</content></subparagraph>
</paragraph>
</section>
<section id="d3971e245" identifier="/us/pl/118/70/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>SENSE OF CONGRESS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6c5d83a3-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y6c5d83a4-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s4/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>claims made by officials of the People’s Republic of China and the Chinese Communist Party that Tibet has been a part of China since ancient times are historically inaccurate;</content></paragraph>
<paragraph class="fontsize10" id="y6c5d83a5-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s4/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the current policies of the People’s Republic of China are systematically suppressing the ability of the Tibetan people to preserve their religion, culture, language, history, way of life, and environment;</content></paragraph>
<paragraph class="fontsize10" id="y6c5d83a6-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s4/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the Government of the People’s Republic of China is failing to meet the expectations of the United States to engage in meaningful dialogue with the Dalai Lama or his representatives or to reach a negotiated resolution that includes the aspirations of the Tibetan people; and</content></paragraph>
<paragraph class="fontsize10" id="y6c5d83a7-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s4/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>United States public diplomacy efforts should counter disinformation about Tibet from the Government of the People’s Republic of China and the Chinese Communist Party, including disinformation about the history of Tibet, the Tibetan people, and Tibetan institutions, including that of the Dalai Lama.</content></paragraph>

<section id="d3971e272" identifier="/us/pl/118/70/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>MODIFICATIONS TO THE TIBETAN POLICY ACT OF 2002.</heading><subsection class="firstIndent0 fontsize10" id="y6c5df8d8-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s5/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Tibet Negotiations</inline>.—</heading><chapeau>Section 613(b) of the Tibetan Policy Act of 2002 (<ref href="/us/usc/t22/s6901">22 U.S.C. 6901 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y6c5df8d9-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (2), by <amendingAction type="delete">striking</amendingAction> “<quotedText>; and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> a semicolon;</content></paragraph>
<paragraph class="fontsize10" id="y6c5df8da-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (3), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y6c5df8db-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s5/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="indentUp0 fontsize10" id="y6c5e1fec-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>efforts to counter disinformation about Tibet from the Government of the People’s Republic of China and the Chinese Communist Party, including disinformation about the history of Tibet, the Tibetan people, and Tibetan institutions, including that of the Dalai Lama.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y6c5e1fed-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s5/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">United States Special Coordinator for Tibetan Issues</inline>.—</heading><chapeau>Section 621(d) of the Tibetan Policy Act of 2002 (<ref href="/us/usc/t22/s6901">22 U.S.C. 6901 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y6c5e1fee-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (6), (7), and (8) as paragraphs (7), (8), and (9), respectively; and</content></paragraph>
<paragraph class="fontsize10" id="y6c5e1fef-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (5) the following new paragraph:<quotedContent><paragraph class="indentUp0 fontsize10" id="y6c5e1ff0-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>work with relevant bureaus of the Department of State and the United States Agency for International Development to ensure that United States Government statements and documents counter, as appropriate, disinformation about Tibet from the Government of the People’s Republic of China and the Chinese Communist Party, including disinformation about the <page identifier="/us/stat/138/1490">138 STAT. 1490</page>
history of Tibet, the Tibetan people, and Tibetan institutions, including that of the Dalai Lama;”</content></paragraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y6c5e1ff1-e80a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/70/s5/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><content>The Tibetan Policy Act of 2002 (<ref href="/us/usc/t22/s6901">22 U.S.C. 6901 note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new section:<quotedContent><section class="centered fontsize12" id="y6c5e4602-e80a-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658143"><num class="fontsize12" value="622">“SEC. 622. </num><heading class="fontsize12">DEFINITION.</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “For purposes of this Act, the term ‘<term>Tibet</term>’ refers to the following areas:</chapeau><paragraph class="fontsize10" id="y6c5e4603-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>The Tibet Autonomous Region.</content></paragraph>

<subparagraph class="fontsize10" id="y6c5e6d16-e80a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Golog (Guoluo) Tibetan Autonomous Prefecture, Malho (Huangnan) Tibetan Autonomous Prefecture, Tsojang (Haibei) Tibetan Autonomous Prefecture, Tsolho (Hainan) Tibetan Autonomous Prefecture, Tsonub (Haixi) Mongolian and Tibetan Autonomous Prefecture, and Yulshul (Yushu) Tibetan Autonomous Prefecture, located in Qinghai Province.</content></subparagraph>

<section id="d3971e437" identifier="/us/pl/118/70/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>AVAILABILITY OF AMOUNTS TO COUNTER DISINFORMATION ABOUT TIBET.</heading><content style="-uslm-lc:I658120">  Amounts authorized to be appropriated or otherwise made available under section 346 of the Tibetan Policy and Support Act of 2020 (<ref href="/us/pl/116/260/dFF/tIII/stE">subtitle E of title III of division FF of Public Law 116–260</ref>) are authorized to be made available to counter disinformation about Tibet from the Government of the People’s Republic of China and the Chinese Communist Party, including <page identifier="/us/stat/138/1491">138 STAT. 1491</page>
disinformation about the history of Tibet, the Tibetan people, and Tibetan institutions, including that of the Dalai Lama.</content></section>
