<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8879dc58-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Winnebago Land Transfer Act of 2023.</p></sidenote>
<section id="d2911e85" identifier="/us/pl/118/68/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Winnebago Land Transfer Act of 2023</shortTitle>”.</content></section>
<section id="d2911e95" identifier="/us/pl/118/68/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>LAND TO BE TAKEN INTO TRUST.</heading><subsection class="firstIndent0 fontsize10" id="y887a5189-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/68/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Subject to all valid existing rights, all right, title, and interest (including improvements and appurtenances) of the United States in and to the Federal lands described in subsection (b), those Federal lands—</chapeau><paragraph class="fontsize10" id="y887a518a-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/68/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>are declared to be part of the Winnebago Reservation created by the Treaty between the United States and the Winnebago Tribe in 1865; and</content></paragraph>
<paragraph class="fontsize10" id="y887a518b-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/68/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>shall be held in trust by the United States for the benefit of the Winnebago Tribe of Nebraska subject to the same terms and conditions as those lands described in the Treaty with the Winnebago Tribe, 1865 (<ref href="/us/stat/14/671">14 Stat. 671</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y887a518c-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/68/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Federal Lands Described</inline>.—</heading><chapeau>The Federal lands described in this subsection are the following:</chapeau><paragraph class="fontsize10" id="y887a518d-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/68/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>That portion of Tract No. 119, the description of which is filed in the United States District Court for the Northern District of Iowa (Western Division), Civil Case No. 70–C–3015–W, executed May 11, 1973, said tract being situated in Section 8 and the accretion land thereto, the Southwest Quarter of Section 9, the West Half of Section 16, the East Half of Section 17, Township 86 North, Range 47 West of the Fifth Principal Meridian, Woodbury County, Iowa, lying Easterly of the Nebraska/Iowa State Line and Southerly of the Easterly extension of the North line of the Winnebago Reservation.</content></paragraph>
<paragraph class="fontsize10" id="y887a518e-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/68/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Tract No. 210, as described in Schedule “A” of the “Declaration of Taking, Legal Description of Tract 210 and Judgment on Stipulation and Order of Distribution”, filed in the United States District Court for the Northern District of Iowa (Western Division), Civil Case No. 70–C–3015–W.</content></paragraph>
<paragraph class="fontsize10" id="y887a518f-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/68/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Tract No. 113, as described in the “Judgment on Declaration of Taking and Legal Description of Tract 113”, filed in the United States District Court for the District of Nebraska, Civ. No. 03498.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y887a5190-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/68/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Gaming Prohibition</inline>.—</heading><content>Class II and class III gaming under the Indian Gaming Regulatory Act (<ref href="/us/usc/t25/s2701/etseq">25 U.S.C. 2701 et seq.</ref>) shall not be allowed at any time on the land taken into trust under subsection (a).</content></subsection>
