<section id="d3674e98" identifier="/us/pl/118/59/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd4fd4375-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s1">18 USC 1 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Revising Existing Procedures On Reporting via Technology Act</shortTitle>” or the “<shortTitle role="act">REPORT Act</shortTitle>”.</content></section>
<section id="d3674e116" identifier="/us/pl/118/59/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>LIMITED LIABILITY MODERNIZATION.</heading><subsection class="firstIndent0 fontsize10" id="yd4fe06c6-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/59/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Amendments</inline>.—</heading><chapeau><ref href="/us/usc/t18/s2258B">Section 2258B of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd4fe06c7-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/59/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the section heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><b>providers or domain name registrars</b></quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><b>the reporting, storage, and handling of certain visual depictions of apparent child pornography to the National Center for Missing &amp; Exploited Children</b></quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="yd4fe2dd8-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/59/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (b)—</chapeau><subparagraph class="fontsize10" id="yd4fe2dd9-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/59/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the matter preceding paragraph (1), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or charge</quotedText>” after “<quotedText>a claim</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd4fe2dda-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/59/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in paragraph (2)(C), by <amendingAction type="delete">striking</amendingAction> “<quotedText>this section,</quotedText>”; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd4fe2ddb-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/59/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="yd4fef12c-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Limited Liability for NCMEC-Contracted Vendors</inline>.—</heading><paragraph class="fontsize10" id="yd4fef12d-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in paragraph (2), a civil claim or criminal charge may not be brought in any Federal or State court against a vendor contractually retained and designated by NCMEC to support the duties of NCMEC under section 404(b)(1)(K) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<ref href="/us/usc/t34/s11293/b/1/K">34 U.S.C. 11293(b)(1)(K)</ref>).</content></paragraph>
<paragraph class="fontsize10" id="yd4fef12e-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Intentional, reckless, or other misconduct</inline>.—</heading><chapeau>Paragraph (1) shall not apply to a claim or charge if the vendor—</chapeau><subparagraph class="fontsize10" id="yd4fef12f-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>engaged in—</chapeau><clause class="fontsize10" id="yd4fef130-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>intentional misconduct; or</content></clause>
<clause class="fontsize10" id="yd4fef131-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>negligent conduct; or</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yd4fef132-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>acted, or failed to act—</chapeau><clause class="fontsize10" id="yd4fef133-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>with actual malice;</content></clause>
<clause class="fontsize10" id="yd4fef134-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>with reckless disregard to a substantial risk of causing injury without legal justification; or</content></clause>
<clause class="fontsize10" id="yd4fef135-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><chapeau>for a purpose unrelated to the performance of any responsibility or function—</chapeau><subclause class="fontsize10" id="yd4fef136-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>set forth in paragraph (1); or<page identifier="/us/stat/138/1015">138 STAT. 1015</page></content></subclause>
<subclause class="fontsize10" id="yd4fef137-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>pursuant to sections 2258A, 2258C, 2702, or 2703.</content></subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd4fef138-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Vendor cybersecurity requirements</inline>.—</heading><chapeau>With respect to any visual depiction provided pursuant to the duties of NCMEC under section 404(b)(1)(K) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<ref href="/us/usc/t34/s11293/b/1/K">34 U.S.C. 11293(b)(1)(K)</ref>) that is stored or transferred by a vendor contractually retained and designated by NCMEC to support such duties of NCMEC, a vendor shall—</chapeau><subparagraph class="fontsize10" id="yd4fef139-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>secure such visual depiction in a manner that is consistent with the most recent version of the Cybersecurity Framework developed by the National Institute of Standards and Technology, or any successor thereto;</content></subparagraph>
<subparagraph class="fontsize10" id="yd4fef13a-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>minimize the number of employees that may be able to obtain access to such visual depiction;</content></subparagraph>
<subparagraph class="fontsize10" id="yd4fef13b-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>employ end-to-end encryption for data storage and transfer functions, or an equivalent technological standard;</content></subparagraph>
<subparagraph class="fontsize10" id="yd4fef13c-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>undergo an independent annual cybersecurity audit to determine whether such visual depiction is secured as required under subparagraph (A); and</content></subparagraph>
<subparagraph class="fontsize10" id="yd4fef13d-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>promptly address all issues identified by an audit described in subparagraph (D).</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yd4fef13e-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Limited Liability for Reporting Apparent Child Pornography by an Individual Depicted in the Child Pornography as a Minor, or a Representative of Such Individual</inline>.—</heading><paragraph class="fontsize10" id="yd4fef13f-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in paragraph (2), a civil claim or criminal charge may not be brought in any Federal or State court against an individual depicted in child pornography as a minor, or a representative of such individual, arising from a report to the NCMEC CyberTipline by the individual, or the representative of such individual, of information that relates to the child pornography in which the individual is depicted as a minor, including a copy of the child pornography.</content></paragraph>
<paragraph class="fontsize10" id="yd4fef140-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Intentional, reckless, or other misconduct</inline>.—</heading><chapeau>Paragraph (1) shall not apply to a claim or charge if the individual, or the representative of such individual—</chapeau><subparagraph class="fontsize10" id="yd4fef141-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>engaged in—</chapeau><clause class="fontsize10" id="yd4fef142-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>intentional misconduct;</content></clause>
<clause class="fontsize10" id="yd4fef143-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>negligent conduct; or</content></clause>
<clause class="fontsize10" id="yd4fef144-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>any activity which constitutes a violation of section 2251; or</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yd4fef145-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>acted, or failed to act—</chapeau><clause class="fontsize10" id="yd4fef146-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>with actual malice; or</content></clause>
<clause class="fontsize10" id="yd4ff1857-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>with reckless disregard to a substantial risk of causing injury without legal justification.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd4ff1858-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Minimizing access</inline>.—</heading><content>With respect to any child pornography reported to the NCMEC CyberTipline by an individual depicted in the child pornography as a minor, or a representative of such individual, NCMEC shall minimize access to the child pornography and ensure the appropriate deletion of the child pornography, as set forth in section 2258D.</content></paragraph>
<paragraph class="fontsize10" id="yd4ff1859-e80a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><chapeau>For purposes of this subsection, the term ‘<term>representative</term>’, with respect to an individual depicted in child pornography—</chapeau><subparagraph class="fontsize10" id="yd4ff185a-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>means—<page identifier="/us/stat/138/1016">138 STAT. 1016</page></chapeau><clause class="fontsize10" id="yd4ff185b-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the parent or legal guardian of the individual, if the individual is under 18 years of age;</content></clause>
<clause class="fontsize10" id="yd4ff185c-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the legal guardian or other person appointed by a court to represent the individual;</content></clause>
<clause class="fontsize10" id="yd4ff185d-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>a legal representative retained by the individual;</content></clause>
<clause class="fontsize10" id="yd4ff185e-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>a representative of the estate of the individual; or</content></clause>
<clause class="fontsize10" id="yd4ff185f-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>a person who is a mandated reporter under section 226(a)(1) of the Victims of Child Abuse Act of 1990 (<ref href="/us/usc/t34/s20341/a/1">34 U.S.C. 20341(a)(1)</ref>); and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yd4ff1860-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>does not include a person who engaged in any activity which constitutes a violation of section 2251.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="yd4ff1861-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/59/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd4ff1862-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s2258B">18 USC 2258B note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>The amendments made by subsection (a) shall apply with respect to a civil claim or criminal charge that is filed on or after the date of enactment of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd4ff1863-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/59/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Table of Sections Amendment</inline>.—</heading><content>The table of sections for <ref href="/us/usc/t18/ch110">chapter 110 of title 18, United States Code</ref>,<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd4ff1864-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">18 USC</p><p class="leftAlign firstIndent0 fontsize8" id="xd4ff1865-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">prec. 2251.</p></sidenote> <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> the item relating to section 2258B and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><toc>

<section id="d3674e476" identifier="/us/pl/118/59/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>PRESERVATION OF REPORTS TO CYBERTIPLINE RELATED TO ONLINE SEXUAL EXPLOITATION OF CHILDREN.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd4ff3f76-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t18/s2258A/h">Section 2258A(h) of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd4ff3f77-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/59/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>90 days</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>1 year</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="yd4ff3f78-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/59/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="yd4ff6689-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd4ff668a-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Extension of preservation</inline>.—</heading><content>A provider of a report to the CyberTipline under subsection (a)(1) may voluntarily preserve the contents provided in the report (including any comingled content described in paragraph (2)) for longer than 1 year after the submission to the CyberTipline for the purpose of reducing the proliferation of online child sexual exploitation or preventing the online sexual exploitation of children.</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="yd4ff668b-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Method of preservation</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd4ff668c-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>—</heading><content>Not later than 1 year after the date of enactment of this paragraph, a provider of a report to the CyberTipline under subsection (a)(1) shall preserve materials under this subsection in a manner that is consistent with the most recent version of the Cybersecurity Framework developed by the National Institute of Standards and Technology, or any successor thereto.”</content></paragraph>

<section id="d3674e538" identifier="/us/pl/118/59/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>STRENGTHENING OF DUTY TO REPORT APPARENT VIOLATIONS TO CYBERTIPLINE RELATED TO ONLINE EXPLOITATION OF CHILDREN.</heading><subsection class="firstIndent0 fontsize10" id="yd4ffb4ad-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/59/s4/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Amendments</inline>.—</heading><chapeau><ref href="/us/usc/t18/s2258A">Section 2258A of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd4ffb4ae-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/59/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a)(2)(A), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, of section 1591 (if the violation involves a minor), or of 2422(b)</quotedText>” after “<quotedText>child pornography</quotedText>”; and</content></paragraph>
