<section id="d31526e101" identifier="/us/pl/117/90/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21b12c9a-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t9/s1">9 USC 1 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021</shortTitle>”.</content></section>

<section class="centered fontsize12" id="y21b216fe-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658163"><num class="fontsize12" value="401">“§ 401.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21b216ff-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t9/s401">9 USC 401</ref>.</p></sidenote> Definitions</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x21b21700-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  “In this chapter:</chapeau><paragraph class="fontsize10" id="y21b21701-e812-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Predispute arbitration agreement</inline>.—</heading><content>The term ‘<term>predispute arbitration agreement</term>’ means any agreement to arbitrate a dispute that had not yet arisen at the time of the making of the agreement.</content></paragraph>
<paragraph class="fontsize10" id="y21b21702-e812-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Predispute joint-action waiver</inline>.—</heading><content>The term ‘<term>predispute joint-action waiver</term>’ means an agreement, whether or not part of a predispute arbitration agreement, that would prohibit, or waive the right of, one of the parties to the agreement to participate in a joint, class, or collective action in a judicial, arbitral, administrative, or other forum, concerning a dispute that has not yet arisen at the time of the making of the agreement.</content></paragraph>
<paragraph class="fontsize10" id="y21b21703-e812-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Sexual assault dispute</inline>.—</heading><content>The term ‘<term>sexual assault dispute</term>’ means a dispute involving a nonconsensual sexual act or sexual contact, as such terms are defined in section 2246 of title 18 or similar applicable Tribal or State law, including when the victim lacks capacity to consent.</content></paragraph>
<paragraph class="fontsize10" id="y21b21704-e812-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Sexual harassment dispute</inline>.—</heading><content>The term ‘<term>sexual harassment dispute</term>’ means a dispute relating to conduct that is alleged to constitute sexual harassment under applicable Federal, Tribal, or State law.<page identifier="/us/stat/136/27">136 STAT. 27</page></content></paragraph>

<section class="centered fontsize12" id="y21b21705-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658163"><num class="fontsize12" value="402">“§ 402.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21b21706-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t9/s402">9 USC 402</ref>.</p></sidenote> No validity or enforceability</heading><subsection class="firstIndent0 fontsize10" id="y21b21707-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Notwithstanding any other provision of this title, at the election of the person alleging conduct constituting a sexual harassment dispute or sexual assault dispute, or the named representative of a class or in a collective action alleging such conduct, no predispute arbitration agreement or predispute joint-action waiver shall be valid or enforceable with respect to a case which is filed under Federal, Tribal, or State law and relates to the sexual assault dispute or the sexual harassment dispute.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y21b21708-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21b21709-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Contracts.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Determination of Applicability</inline>.—</heading><content>An issue as to whether this chapter applies with respect to a dispute shall be determined under Federal law. The applicability of this chapter to an agreement to arbitrate and the validity and enforceability of an agreement to which this chapter applies shall be determined by a court, rather than an arbitrator, irrespective of whether the party resisting arbitration challenges the arbitration agreement specifically or in conjunction with other terms of the contract containing such agreement, and irrespective of whether the agreement purports to delegate such determinations to an arbitrator.”</content></subsection>

<subparagraph class="fontsize10" id="y21b23e1d-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/90/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>in section 208—</chapeau><clause class="fontsize10" id="y21b23e1e-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/90/s2/b/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in the section heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><b>Chapter 1; residual application</b></quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><b>Application</b></quotedText>”; and</content></clause>
