<section id="d43461e98" identifier="/us/pl/117/71/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xca02c5f6-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s900">2 USC 900 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Protecting Medicare and American Farmers from Sequester Cuts Act</shortTitle>”.</content></section>
<section id="d43461e113" identifier="/us/pl/117/71/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ADJUSTMENTS TO MEDICARE SEQUESTRATION REDUCTIONS.</heading><subsection class="firstIndent0 fontsize10" id="yca031417-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Extension of Temporary Suspension Through March 2022</inline>.—</heading><paragraph class="fontsize10" id="yca031418-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s2/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Section 3709(a) of division A of the CARES Act (<ref href="/us/usc/t2/s901a">2 U.S.C. 901a note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="yca031419-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the subsection header by <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">and Adjustment</headingText></quotedText>” after “<quotedText><headingText class="smallCaps">Suspension</headingText></quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="yca03141a-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>December 31, 2021</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>March 31, 2022</quotedText>”.</content></subparagraph>

<paragraph class="fontsize10" id="yca03141b-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xca03141c-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s901a">2 USC 901a note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective date</inline>.—</heading><content>The amendments made by paragraph (1) shall take effect as if enacted as part of the CARES Act (<ref href="/us/pl/116/136">Public Law 116–136</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yca03141d-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Adjustments to Medicare Program Sequestration Reduction With Respect to Fiscal Years 2022 and 2030</inline>.—</heading><chapeau>Section 251A(6) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<ref href="/us/usc/t2/s901a/6">2 U.S.C. 901a(6)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yca03141e-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subparagraph (C) as subparagraph (E); and</content></paragraph>
<paragraph class="fontsize10" id="yca03141f-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subparagraph (B) the following new subparagraphs:<quotedContent><subparagraph class="fontsize10" id="yca033b30-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xca033b31-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote><content>Notwithstanding the 2 percent limit specified in subparagraph (A) for payments for the Medicare programs specified in section 256(d), the sequestration order of the President under such subparagraph for fiscal year 2022 shall be applied to such payments so that with respect to the period beginning on April 1, 2022, and ending on June 30, 2022, the payment reduction shall be 1.0 percent.</content></subparagraph>
<subparagraph class="fontsize10" id="yca033b32-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xca033b33-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote><chapeau>Notwithstanding the 2 percent limit specified in subparagraph (A) for payments for the Medicare programs specified in section 256(d), the sequestration order of the President under such subparagraph for fiscal year 2030 shall be applied to such payments so that—</chapeau><clause class="fontsize10" id="yca033b34-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>with respect to the first 6 months in which such order is effective for such fiscal year, the payment reduction shall be 2.25 percent; and<page identifier="/us/stat/135/1507">135 STAT. 1507</page></content></clause>

<section id="d43461e252" identifier="/us/pl/117/71/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>EXTENSION OF SUPPORT FOR PHYSICIANS AND OTHER PROFESSIONALS IN ADJUSTING TO MEDICARE PAYMENT CHANGES.</heading><subsection class="firstIndent0 fontsize10" id="yca03d776-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 1848 of the Social Security Act (<ref href="/us/usc/t42/s1395w–4">42 U.S.C. 1395w–4</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yca03d777-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (c)(2)(B)(iv)(V), by <amendingAction type="delete">striking</amendingAction> “<quotedText>2021</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2021 or 2022</quotedText>”; and</content></paragraph>

<clause class="fontsize10" id="yca03d77c-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s3/a/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>for such services furnished on or after January 1, 2021, and before January 1, 2022, by 3.75 percent.</quotedText>” and <amendingAction type="insert">inserting</amendingAction> <quotedContent>“for—<subparagraph class="indentDown1 fontsize10" id="yca03d77d-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>such services furnished on or after January 1, 2021, and before January 1, 2022, by 3.75 percent; and</content></subparagraph>
<subparagraph class="indentDown1 fontsize10" id="yca03d77e-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>such services furnished on or after January 1, 2022, and before January 1, 2023, by 3.0 percent.”</content></subparagraph>

<section id="d43461e634" identifier="/us/pl/117/71/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xca044cc6-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xca044cc7-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading>PAYGO ANNUAL REPORT.</heading><content style="-uslm-lc:I658120">  For the purposes of the annual report issued pursuant to section 5 of the Statutory Pay-As-You-Go Act of 2010 (<ref href="/us/usc/t2/s934">2 U.S.C. 934</ref>) after adjournment of the first session of the 117th Congress, and for determining whether a sequestration order is necessary under such section, the debit for the budget year on the 5-year scorecard, if any, and the 10-year scorecard, if any, shall be deducted from such scorecard in 2022 and added to such scorecard in 2023.</content></section>
<section id="d43461e649" identifier="/us/pl/117/71/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><heading>EXPEDITED PROCEDURES FOR CONSIDERING AN INCREASE IN THE DEBT LIMIT.</heading><subsection class="firstIndent0 fontsize10" id="yca055e38-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><chapeau>In this section, the term “<term>joint resolution</term>” means a joint resolution—</chapeau><paragraph class="fontsize10" id="yca055e39-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xca055e3a-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><content>that is introduced by the Majority Leader of the Senate, or a designee, during the period beginning on the date of enactment of this Act and ending on December 31, 2021;</content></paragraph>
<paragraph class="fontsize10" id="yca055e3b-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>which does not have a preamble;</content></paragraph>
<paragraph class="fontsize10" id="yca055e3c-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the title of which is as follows: “Joint resolution relating to increasing the debt limit.”; and</content></paragraph>
<paragraph class="fontsize10" id="yca055e3d-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the matter after the resolving clause of which is as follows: “That the limitation under <ref href="/us/usc/t31/s3101/b">section 3101(b) of title 31, United States Code</ref>, as most recently increased by <ref href="/us/pl/117/50">Public Law 117–50</ref> (<ref href="/us/usc/t31/s3101">31 U.S.C. 3101 note</ref>), is increased by $＿＿＿＿＿＿＿＿＿.”, the blank space being appropriately filled in with the dollar amount of the increase.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yca055e3e-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Expedited Consideration in Senate</inline>.—</heading><paragraph class="fontsize10" id="yca055e3f-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Placement on calendar</inline>.—</heading><content>Upon introduction in the Senate, the joint resolution shall be placed immediately on the calendar.</content></paragraph>
<paragraph class="fontsize10" id="yca055e40-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Proceeding to consideration</inline>.—</heading><subparagraph class="fontsize10" id="yca055e41-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xca055e42-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding rule XXII of the Standing Rules of the Senate, it is in order, not later than January 15, 2022 (even though a previous motion <page identifier="/us/stat/135/1509">135 STAT. 1509</page>
to the same effect has been disagreed to) to move to proceed to the consideration of the joint resolution.</content></subparagraph>
<subparagraph class="fontsize10" id="yca055e43-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Procedure</inline>.—</heading><chapeau>For a motion to proceed to the consideration of the joint resolution—</chapeau><clause class="fontsize10" id="yca055e44-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>all points of order against the motion are waived;</content></clause>
<clause class="fontsize10" id="yca055e45-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the motion is not debatable;</content></clause>
<clause class="fontsize10" id="yca055e46-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/2/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the motion is not subject to a motion to postpone;</content></clause>

<paragraph class="fontsize10" id="yca055e49-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Floor consideration</inline>.—</heading><subparagraph class="fontsize10" id="yca055e4a-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>If the Senate proceeds to consideration of the joint resolution—</chapeau><clause class="fontsize10" id="yca055e4b-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>all points of order against the joint resolution (and against consideration of the joint resolution) are waived;</content></clause>
<clause class="fontsize10" id="yca055e4c-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xca055e4d-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><content>debate on the joint resolution, and all debatable motions and appeals in connection therewith, shall be limited to not more than 10 hours, which shall be divided equally between the Chairman and Ranking Member of the Committee on Finance;</content></clause>
<clause class="fontsize10" id="yca055e4e-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/3/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>an amendment to the joint resolution is not in order;</content></clause>
<clause class="fontsize10" id="yca055e4f-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/3/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>a motion to postpone or a motion to commit the joint resolution is not in order; and</content></clause>
<clause class="fontsize10" id="yca055e50-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/3/A/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>a motion to proceed to the consideration of other business is not in order.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yca055e51-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Vote on passage</inline>.—</heading><content>The vote on passage shall occur immediately following the conclusion of the debate on the joint resolution and a single quorum call if requested in accordance with the rules of the Senate.</content></subparagraph>
<subparagraph class="fontsize10" id="yca055e52-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Rulings of the chair on procedure</inline>.—</heading><content>Appeals from the decisions of the Chair relating to the application of this paragraph or the rules of the Senate, as the case may be, to the procedure relating to the joint resolution shall be decided without debate.</content></subparagraph>
<subparagraph class="fontsize10" id="yca055e53-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Single measure authorized</inline>.—</heading><content>It shall not be in order to consider more than 1 joint resolution under the procedures under this paragraph.</content></subparagraph>
<subparagraph class="fontsize10" id="yca055e54-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/3/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><heading class="fontsize10"><inline class="smallCaps">Sunset</inline>.—</heading><content>It shall not be in order to consider a joint resolution under the procedures under this paragraph after January 16, 2022.</content></subparagraph>

<paragraph class="fontsize10" id="yca055e55-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Rules of the senate</inline>.—</heading><chapeau>This subsection is enacted by Congress—</chapeau><subparagraph class="fontsize10" id="yca055e56-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>as an exercise of the rulemaking power of the Senate, and as such is deemed a part of the rules of the Senate, but applicable only with respect to the procedure to be followed in the Senate in the case of a joint resolution, and supersede other rules only to the extent that they are inconsistent with such rules; and</content></subparagraph>
<subparagraph class="fontsize10" id="yca055e57-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/71/s8/b/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>with full recognition of the constitutional right of the Senate to change the rules (so far as relating to <page identifier="/us/stat/135/1510">135 STAT. 1510</page>
the procedure of the Senate) at any time, in the same manner, and to the same extent as in the case of any other rule of the Senate.</content></subparagraph>
