<section id="d43674e85" identifier="/us/pl/117/7/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>EXTENSION OF TEMPORARY SUSPENSION OF MEDICARE SEQUESTRATION.</heading><subsection class="firstIndent0 fontsize10" id="ydf1cb0ed-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s1/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Extension</inline>.—</heading><paragraph class="fontsize10" id="ydf1cb0ee-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s1/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Section 3709(a) of division A of the CARES Act (<ref href="/us/usc/t2/s901a">2 U.S.C. 901a note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>March 31, 2021</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>December 31, 2021</quotedText>”.</content></paragraph>
<paragraph class="fontsize10" id="ydf1cb0ef-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s1/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdf1cb0f0-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s901a">2 USC 901a note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective date</inline>.—</heading><content>The amendment made by paragraph (1) shall take effect as if enacted as part of the CARES Act (<ref href="/us/pl/116/136">Public Law 116–136</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydf1cb0f1-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s1/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Offset</inline>.—</heading><chapeau>Section 251A(6)(C) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<ref href="/us/usc/t2/s901a/6/C">2 U.S.C. 901a(6)(C)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ydf1cb0f2-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s1/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in clause (i)—</chapeau><subparagraph class="fontsize10" id="ydf1cb0f3-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s1/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>first 6 months</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>first 5 ½ months</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="ydf1cb0f4-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s1/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>4.0 percent</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2.0 percent</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydf1cb0f5-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s1/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydf1cb0f6-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s1/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in clause (ii)—</chapeau><subparagraph class="fontsize10" id="ydf1cb0f7-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s1/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>second 6 months</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>6-month period beginning on the day after the last day of the period described in clause (i)</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydf1cb0f8-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s1/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>0.0 percent.</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>4.0 percent; and</quotedText>”; and</content></subparagraph>

<paragraph class="fontsize10" id="ydf1cb0f9-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s1/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentUp1 fontsize10" id="ydf1cd80a-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii)</num><content> with respect to the remaining ½ month in which such order is so effective for such fiscal year, the payment reduction shall be 0.0 percent.”</content></subsection>

<section id="d43674e237" identifier="/us/pl/117/7/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>TECHNICAL CORRECTIONS.</heading><subsection class="firstIndent0 fontsize10" id="ydf1d262b-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Rural Health Clinic Payments</inline>.—</heading><paragraph class="fontsize10" id="ydf1d262c-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s2/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Section 1833(f)(3) of the Social Security Act (<ref href="/us/usc/t42/s1395l/f/3">42 U.S.C. 1395l(f)(3)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="ydf1d262d-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>in subparagraph (A)—</chapeau><clause class="fontsize10" id="ydf1d262e-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s2/a/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in clause (i), by <amendingAction type="delete">striking</amendingAction> subclauses (I) and (II) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subclause class="indentUp0 fontsize10" id="ydf1d4d3f-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><chapeau>with respect to a rural health clinic that had a per visit payment amount established for services furnished in 2020—<page identifier="/us/stat/135/252">135 STAT. 252</page></chapeau><item class="fontsize10" id="ydf1d7450-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>the per visit payment amount applicable to such rural health clinic for rural health clinic services furnished in 2020, increased by the percentage increase in the MEI applicable to primary care services furnished as of the first day of 2021; or</content></item>
<item class="fontsize10" id="ydf1d7451-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>the limit described in paragraph (2)(A); and</content></item>
</subclause>
<subclause class="indentUp0 fontsize10" id="ydf1d7452-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><chapeau>with respect to a rural health clinic that did not have a per visit payment amount established for services furnished in 2020—</chapeau><item class="fontsize10" id="ydf1d7453-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>the per visit payment amount applicable to such rural health clinic for rural health clinic services furnished in 2021; or</content></item>
<item class="fontsize10" id="ydf1d7454-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>the limit described in paragraph (2)(A); and”</content></item>
</subclause>
</quotedContent>; and</content></clause>
<clause class="fontsize10" id="ydf1d7455-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s2/a/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>in clause (ii)(I), by <amendingAction type="delete">striking</amendingAction> “<quotedText>under clause (i)(I)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>under subclause (I) or (II) of clause (i), as applicable,</quotedText>”; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ydf1d7456-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> subparagraph (B) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subparagraph class="indentDown2 firstIndent0 fontsize10" id="ydf1d7457-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>A rural health clinic described in this subparagraph is a rural health clinic that—</chapeau><clause class="fontsize10" id="ydf1d7458-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>as of December 31, 2020, was in a hospital with less than 50 beds and after such date such hospital continues to have less than 50 beds (not taking into account any increase in the number of beds pursuant to a waiver under subsection (b)(1)(A) of section 1135 during the emergency period described in subsection (g)(1)(B) of such section); and</content></clause>
<clause class="fontsize10" id="ydf1d7459-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii)</num><subclause class="inline" id="ydf1d745a-e812-11f0-a1e4-69761a48a15a"><num value="I">(I) </num><content>as of December 31, 2020, was enrolled under section 1866(j) (including temporary enrollment during such emergency period for such emergency period); or</content></subclause>
<subclause class="indentUp0 fontsize10" id="ydf1d745b-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>submitted an application for enrollment under section 1866(j) (or a request for such a temporary enrollment for such emergency period) that was received not later than December 31, 2020.”</content></subclause>

</subparagraph>

<paragraph class="fontsize10" id="ydf1d745c-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdf1d745d-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1395">42 USC 1395</ref><i>l</i> note.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective date</inline>.—</heading><content>The amendments made by this subsection shall take effect as if included in the enactment of the Consolidated Appropriations Act, 2021 (<ref href="/us/pl/116/260">Public Law 116–260</ref>).</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="ydf1d745e-e812-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/7/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdf1d745f-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1396r–4">42 USC 1396r–4 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Additional Amount for Certain Hospitals With High Disproportionate Share</inline>.—</heading><content>Effective as if included in the enactment of <ref href="/us/pl/116/260/dCC/tII/s203/a">section 203(a) of title II of division CC of Public Law 116–260</ref>, subsection (g) of section 1923 of the Social Security Act (<ref href="/us/usc/t42/s1396r–4">42 U.S.C. 1396r–4</ref>), as amended by such section, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="fontsize10" id="ydf1d9b70-e812-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Continued application of grandfathered transition rule</inline>.—</heading><content>Notwithstanding paragraph (2) of this subsection (as in effect on October 1, 2021), paragraph (2) of this subsection (as in effect on September 30, 2021, and as applied under section 4721(e) of the Balanced Budget Act of 1997, and amended by section 607 of the Medicare, Medicaid, and SCHIP Balanced Budget Refinement Act of 1999 (<ref href="/us/pl/106/113">Public Law 106–113</ref>)) shall apply in determining whether a payment adjustment for a hospital in a State referenced in section 4721(e) of the <page identifier="/us/stat/135/253">135 STAT. 253</page>
Balanced Budget Act of 1997 during a State fiscal year shall be considered consistent with subsection (c).”</content></paragraph>
