<section id="d54323e92" identifier="/us/pl/117/67/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Hire Veteran Health Heroes Act of 2021</shortTitle>”.</content></section>
<section id="d54323e102" identifier="/us/pl/117/67/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>IDENTIFICATION AND REFERRAL OF MEMBERS OF THE ARMED FORCES WITH A HEALTH CARE OCCUPATION FOR POTENTIAL EMPLOYMENT WITH THE DEPARTMENT OF VETERANS AFFAIRS DURING SEPARATION FROM THE ARMED FORCES.</heading><content class="firstIndent0 fontsize10" id="xf558d3d0-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 207 of the VA Choice and Quality Employment Act of 2017 (<ref href="/us/pl/115/46">Public Law 115–46</ref>; <ref href="/us/usc/t38/s7401">38 U.S.C. 7401 note</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="centered fontsize12" id="yf55921f1-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="207">“SEC. 207. </num><heading class="fontsize12">IDENTIFICATION AND REFERRAL OF MEMBERS OF THE ARMED FORCES WITH A HEALTH CARE OCCUPATION FOR POTENTIAL EMPLOYMENT WITH THE DEPARTMENT OF VETERANS AFFAIRS DURING SEPARATION FROM THE ARMED FORCES.</heading><subsection class="firstIndent0 fontsize10" id="yf55921f2-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf55921f3-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary of Veterans Affairs, in consultation with the Secretary of Defense, shall establish a program to identify and refer members of the Armed Forces with a health care occupation for employment with the Department of Veterans Affairs during the separation of such members from the Armed Forces.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf55921f4-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Referral of Interested Individuals</inline>.—</heading><paragraph class="fontsize10" id="yf55921f5-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>If a member of the Armed Forces identified under subsection (a) expresses an interest in working in a health care occupation within the Department of Veterans Affairs, the Secretary of Veterans Affairs shall refer the member to a recruiter of the Department for consideration of open positions in the specialty and geography of interest to the member.</content></paragraph>
<paragraph class="fontsize10" id="yf55921f6-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Timing</inline>.—</heading><content>Any referral of a member of the Armed Forces conducted under paragraph (1) shall be made not earlier than one year before the separation of the member from the Armed Forces.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yf55921f7-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>Any identification of a member of the Armed Forces under subsection (a) or referral of such member under subsection (b) shall not be construed as a guarantee of <page identifier="/us/stat/135/1492">135 STAT. 1492</page>
employment of such member with the Department of Veterans Affairs.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf55921f8-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><content>Not later than each of one year and two years after the date of the enactment of the Hire Veteran Health Heroes Act of 2021, the Secretary of Veterans Affairs shall submit to the appropriate committees of Congress a report on the program established under subsection (a).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf55921f9-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yf55921fa-e812-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate committees of congress</inline>.—</heading><chapeau>The term ‘<term>appropriate committees of Congress</term>’ means—</chapeau><subparagraph class="fontsize10" id="yf55921fb-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Committee on Armed Services and the Committee on Veterans’ Affairs of the Senate; and</content></subparagraph>
<subparagraph class="fontsize10" id="yf55921fc-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the Committee on Armed Services and the Committee on Veterans’ Affairs of the House of Representatives.</content></subparagraph>

<paragraph class="fontsize10" id="yf55921fd-e812-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Health care occupation</inline>.—</heading><content>The term ‘<term>health care occupation</term>’ means an occupation for which an individual may be appointed for employment with the Department of Veterans Affairs under <ref href="/us/usc/t38/s7401">section 7401 of title 38, United States Code</ref>.”</content></paragraph>
