<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula>
<section id="d43963e85" identifier="/us/pl/117/64/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>REPORT ON USE OF CAMERAS IN MEDICAL FACILITIES OF THE DEPARTMENT OF VETERANS AFFAIRS.</heading><subsection class="firstIndent0 fontsize10" id="y0bbf89af-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Report Required</inline>.—</heading><content>Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs, in collaboration with the Office of Operations, Security, and Preparedness of the Department of Veterans Affairs, the Veterans Health Administration, and the Office of Construction and Facilities Management of the Department, shall submit to the Committees on Veterans’ Affairs of the Senate and the House of Representatives a report analyzing the policies, use, and maintenance of cameras deployed by the Department for patient safety and law enforcement at medical facilities of the Department.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y0bbf89b0-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><chapeau>The report required by subsection (a) shall include the following:</chapeau><paragraph class="fontsize10" id="y0bbf89b1-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0bbf89b2-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p><p class="leftAlign firstIndent0 fontsize8" id="x0bbf89b3-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analysis.</p></sidenote><chapeau>A comprehensive review of the policies and procedures of the Department regarding the use and maintenance of cameras with respect to the following:</chapeau><subparagraph class="fontsize10" id="y0bbf89b4-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>Patient safety, including—</chapeau><clause class="fontsize10" id="y0bbf89b5-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>an analysis of how cameras are used to monitor staff and patients;</content></clause>
<clause class="fontsize10" id="y0bbf89b6-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>an analysis of the specific units within medical facilities in which the use of cameras is prioritized to protect patient safety;</content></clause>
<clause class="fontsize10" id="y0bbf89b7-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/1/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>an analysis of the procedures regarding the positioning of cameras;</content></clause>
<clause class="fontsize10" id="y0bbf89b8-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/1/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>an analysis of the extent to which cameras monitor locations where drugs are stored to ensure that drugs are accounted for, and an assessment of whether this is a widely used practice; and</content></clause>
<clause class="fontsize10" id="y0bbf89b9-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/1/A/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>an analysis of the actions taken to preserve and protect patient privacy.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y0bbf89ba-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>Law enforcement of medical facilities of the Department, including—</chapeau><clause class="fontsize10" id="y0bbf89bb-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>how exterior cameras are used;</content></clause>
<clause class="fontsize10" id="y0bbf89bc-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>how interior cameras are used; and</content></clause>
<clause class="fontsize10" id="y0bbf89bd-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/1/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>an analysis of locations, interior and exterior, in which camera use is prioritized.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y0bbf89be-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0bbf89bf-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x0bbf89c0-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><chapeau>Recommendations of the Secretary to improve patient safety and law enforcement, including—</chapeau><page identifier="/us/stat/135/1487">135 STAT. 1487</page>
<subparagraph class="fontsize10" id="y0bbf89c1-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the placement and maintenance of cameras;</content></subparagraph>
<subparagraph class="fontsize10" id="y0bbf89c2-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0bbf89c3-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Data.</p></sidenote><content>the storage of data from such cameras;</content></subparagraph>
<subparagraph class="fontsize10" id="y0bbf89c4-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the authority of supervisors at medical facilities of the Department to review recordings from cameras;</content></subparagraph>
<subparagraph class="fontsize10" id="y0bbf89c5-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the number of staff required to monitor live footage from cameras at each medical facility of the Department;</content></subparagraph>
<subparagraph class="fontsize10" id="y0bbf89c6-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>the funding necessary to address shortfalls with respect to cameras and the specific uses for such funding;</content></subparagraph>
<subparagraph class="fontsize10" id="y0bbf89c7-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>any additional actions required to preserve and protect patient privacy; and</content></subparagraph>
<subparagraph class="fontsize10" id="y0bbf89c8-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/b/2/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>such other matters the Secretary determines appropriate.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y0bbf89c9-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/64/s1/c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Camera Defined</inline>.—</heading><content>In this section, the term “<term>camera</term>” means any video camera used in a medical facility of the Department of Veterans Affairs for purposes of patient safety or law enforcement, but does not include cameras used solely by the Inspector General of the Department of Veterans Affairs to assist in criminal investigations conducted by the Inspector General.</content></subsection>
