<section id="d54702e102" identifier="/us/pl/117/61/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Protecting America’s First Responders Act of 2021</shortTitle>”.</content></section>
<section id="d54702e112" identifier="/us/pl/117/61/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PAYMENT OF DEATH AND DISABILITY BENEFITS UNDER PUBLIC SAFETY OFFICERS’ DEATH BENEFITS PROGRAM.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x21e195c7-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 1201 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10281">34 U.S.C. 10281</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y21e195c8-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a), in the matter preceding paragraph (1)—</chapeau><subparagraph class="fontsize10" id="y21e195c9-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>the Bureau shall pay</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y21e195ca-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, and calculated in accordance with subsection (i), shall be payable by the Bureau</quotedText>” after “<quotedText>subsection (h)</quotedText>”.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y21e195cb-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (b)—</chapeau><subparagraph class="fontsize10" id="y21e195cc-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>the Bureau shall pay the same benefit</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>a benefit shall be payable</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y21e195cd-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>that is payable under subsection (a) with respect to the date on which the catastrophic injury occurred,</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>in the same amount that would be payable, as of the date such injury was sustained (including</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y21e195ce-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s2/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, and calculated in accordance with subsection (i)), if such determination were a determination under subsection (a)</quotedText>” before “<quotedText>: <proviso>Provided, That</proviso></quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y21e195cf-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s2/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>necessary:</quotedText>” and all that follows and <amendingAction type="insert">inserting</amendingAction> “<quotedText>necessary.</quotedText>”;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y21e195d0-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in subsection (c), by <amendingAction type="delete">striking</amendingAction> “<quotedText>$3,000</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>$6,000, adjusted in accordance with subsection (h),</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y21e195d1-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>in subsection (h), by <amendingAction type="delete">striking</amendingAction> “<quotedText>subsection (a)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>subsections (a) and (b) and the level of the interim benefit payable immediately before such October 1 under subsection (c)</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y21e195d2-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (i) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y21e1bce3-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>The amount payable under subsections (a) and (b), with respect to the death or permanent and total disability of a public safety officer, shall be the greater of—<page identifier="/us/stat/135/1475">135 STAT. 1475</page></chapeau><paragraph class="fontsize10" id="y21e1bce4-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the amount payable under the relevant subsection as of the date of death or of the catastrophic injury of the public safety officer; or</content></paragraph>
<paragraph class="fontsize10" id="y21e1bce5-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>in any case in which the claim filed thereunder has been pending for more than 365 days at the time of final determination by the Bureau, the amount that would be payable under the relevant subsection if the death or the catastrophic injury of the public safety officer had occurred on the date on which the Bureau makes such final determination.”</content></paragraph>

<paragraph class="fontsize10" id="y21e1bce6-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>in subsection (m), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, (b),</quotedText>” after “<quotedText>subsection (a)</quotedText>”.</content></paragraph>

<section id="d54702e264" identifier="/us/pl/117/61/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>DEFINITIONS WITH RESPECT TO PUBLIC SAFETY OFFICERS’ DEATH BENEFITS PROGRAM.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x21e28037-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 1204 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10284">34 U.S.C. 10284</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y21e28038-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (1), (2), (3), (4), (5), (6), (7), (8), and (9) as paragraphs (4), (5), (6), (7), (8), (9), (10), (13), and (14), respectively;</content></paragraph>
<paragraph class="fontsize10" id="y21e28039-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraph (4), as so redesignated, and <amendingAction type="insert">inserting</amendingAction>:<quotedContent><paragraph class="indentUp0 fontsize10" id="y21e2a74a-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><chapeau>‘catastrophic injury’ means an injury, the direct and proximate result of which is to permanently render an individual functionally incapable (including through a directly and proximately resulting neurocognitive disorder), based on the state of medicine on the date on which the claim is determined by the Bureau, of performing work, including sedentary work: Provided, That, if it appears that a claimant may be functionally capable of performing work—</chapeau><subparagraph class="fontsize10" id="y21e2a74b-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>the Bureau shall disregard work where any compensation provided is de minimis, nominal, honorary, or mere reimbursement of incidental expenses, such as—</chapeau><clause class="fontsize10" id="y21e2a74c-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>work that involves ordinary or simple tasks, that because of the claimed disability, the claimant cannot perform without significantly more supervision, accommodation, or assistance than is typically provided to an individual without the claimed disability doing similar work;</content></clause>
<clause class="fontsize10" id="y21e2ce5d-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>work that involves minimal duties that make few or no demands on the claimant and are of little or no economic value to the employer; or</content></clause>
<clause class="fontsize10" id="y21e2ce5e-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>work that is performed primarily for therapeutic purposes and aids the claimant in the physical or mental recovery from the claimed disability; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y21e2ce5f-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>the claimant shall be presumed, absent clear and convincing medical evidence to the contrary as determined by the Bureau, to be functionally incapable of performing such work if the direct and proximate result of the injury renders the claimant—</chapeau><clause class="fontsize10" id="y21e2ce60-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>blind;</content></clause>
<clause class="fontsize10" id="y21e2ce61-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>parapalegic; or</content></clause>
<clause class="fontsize10" id="y21e2ce62-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>quadriplegic;”</content></clause>
</subparagraph>
</paragraph>
</quotedContent>;</content></paragraph>
<paragraph class="fontsize10" id="y21e2ce63-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in paragraph (6), as so redesignated, by <amendingAction type="delete">striking</amendingAction> “<quotedText>at the time of the public safety officer’s fatal or catastrophic injury</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>at the time of the public safety officer’s death or fatal injury (in connection with any claim predicated upon such death or injury) or the date of the public safety officer’s <page identifier="/us/stat/135/1476">135 STAT. 1476</page>
catastrophic injury or of the final determination by the Bureau of any claim predicated upon such catastrophic injury</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y21e2ce64-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s3/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>in paragraph (7), as so redesignated, by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, including an individual who, as such a member, engages in scene security or traffic management as the primary or only duty of the individual during emergency response</quotedText>” before the semicolon;</content></paragraph>
<paragraph class="fontsize10" id="y21e2ce65-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s3/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>in paragraph (9), as so redesignated by <amendingAction type="delete">striking</amendingAction> “<quotedText>delinquency).,</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>delinquency),</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y21e2ce66-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s3/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>in paragraph (13), as so redesignated, by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, and includes (as may be prescribed by regulation hereunder) a legally organized volunteer fire department that is a nonprofit entity and provides services without regard to any particular relationship (such as a subscription) a member of the public may have with such a department</quotedText>” before the semicolon;</content></paragraph>
<paragraph class="fontsize10" id="y21e2ce67-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s3/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><chapeau>in paragraph (14), as so redesignated,—</chapeau><subparagraph class="fontsize10" id="y21e2ce68-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s3/7/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> subparagraph (A) and <amendingAction type="insert">inserting</amendingAction>:<quotedContent><subparagraph class="indentUp0 fontsize10" id="y21e2ce69-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21e2ce6a-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="x21e2ce6b-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Certification.</p></sidenote><chapeau>an individual serving a public agency in an official capacity, with or without compensation, as a law enforcement officer, as a firefighter, or as a chaplain: Provided, That (notwithstanding section 1205(b)(2) or (3)) the Bureau shall, absent clear and convincing evidence to the contrary as determined by the Bureau, deem the actions outside of jurisdiction taken by any such law enforcement officer or firefighter, to have been taken while serving such public agency in such capacity, in any case in which the principal legal officer of such public agency, and the head of such agency, together, certify that such actions—</chapeau><clause class="fontsize10" id="y21e2ce6c-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>were not unreasonable;</content></clause>
<clause class="fontsize10" id="y21e2ce6d-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>would have been within the authority and line of duty of such law enforcement officer or such firefighter to take, had they been taken in a jurisdiction where such law enforcement officer or firefighter was authorized to act, in the ordinary course, in an official capacity; and</content></clause>
<clause class="fontsize10" id="y21e2ce6e-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>would have resulted in the payment of full line-of-duty death or disability benefits (as applicable), if any such benefits typically were payable by (or with respect to or on behalf of) such public agency, as of the date the actions were taken;”</content></clause>
</subparagraph>
</quotedContent>;</content></subparagraph>
<subparagraph class="fontsize10" id="y21e2f57f-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s3/7/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subparagraphs (B), (C), (D), and (E) as subparagraphs (C), (D), (E), and (F), respectively;</content></subparagraph>
<subparagraph class="fontsize10" id="y21e2f580-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s3/7/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subparagraph (A), the following new subparagraph:<quotedContent><subparagraph class="indentUp0 fontsize10" id="y21e2f581-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>a candidate officer who is engaging in an activity or exercise that itself is a formal or required part of the program in which the candidate officer is enrolled or admitted, as provided in this section;”</content></subparagraph>
</quotedContent>; and</content></subparagraph>

jurisdiction taken by any such member to have been thus authorized or licensed, in any case in which the principal legal officer of such agency or entity, and the head of such agency or entity, together, certify that such actions—</chapeau><clause class="fontsize10" id="y21e2f586-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>were not unreasonable;</content></clause>
<clause class="fontsize10" id="y21e2f587-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>would have been within the authority and line of duty of such member to take, had they been taken in a jurisdiction where such member was authorized or licensed by law and by a pertinent agency or entity to act, in the ordinary course; and</content></clause>
<clause class="fontsize10" id="y21e2f588-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>would have resulted in the payment of full line-of-duty death or disability benefits (as applicable), if any such benefits typically were payable by (or with respect to or on behalf of) such applicable agency or entity, as of the date the action was taken;”</content></clause>

<paragraph class="fontsize10" id="y21e2f589-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s3/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>by <amendingAction type="insert">inserting</amendingAction> before paragraph (4), as so redesignated, the following new paragraphs:<quotedContent><paragraph class="indentUp0 fontsize10" id="y21e36aba-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>‘action outside of jurisdiction’ means an action, not in the course of any compensated employment involving either the performance of public safety activity or the provision of security services, by a law enforcement officer, firefighter, or member of a rescue squad or ambulance crew that—</chapeau><subparagraph class="fontsize10" id="y21e36abb-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>was taken in a jurisdiction where—</chapeau><clause class="fontsize10" id="y21e36abc-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the law enforcement officer or firefighter then was not authorized to act, in the ordinary course, in an official capacity; or</content></clause>
<clause class="fontsize10" id="y21e36abd-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the member of a rescue squad or ambulance crew then was not authorized or licensed to act, in the ordinary course, by law or by the applicable agency or entity;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y21e36abe-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>then would have been within the authority and line of duty of—</chapeau><clause class="fontsize10" id="y21e36abf-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a law enforcement officer or a firefighter to take, who was authorized to act, in the ordinary course, in an official capacity, in the jurisdiction where the action was taken; or</content></clause>
<clause class="fontsize10" id="y21e36ac0-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a member of a rescue squad or ambulance crew to take, who was authorized or licensed by law and by a pertinent agency or entity to act, in the ordinary course, in the jurisdiction where the action was taken; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y21e36ac1-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>was, in an emergency situation that presented an imminent and significant danger or threat to human life or of serious bodily harm to any individual, taken—</chapeau><clause class="fontsize10" id="y21e36ac2-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>by a law enforcement officer—</chapeau><subclause class="fontsize10" id="y21e36ac3-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>to prevent, halt, or respond to the immediate consequences of a crime (including an incident of juvenile delinquency); or</content></subclause>
<subclause class="fontsize10" id="y21e36ac4-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>while engaging in a rescue activity or in the provision of emergency medical services;</content></subclause>
</clause>
<clause class="fontsize10" id="y21e36ac5-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>by a firefighter—</chapeau><subclause class="fontsize10" id="y21e36ac6-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>while engaging in fire suppression; or</content></subclause>
<subclause class="fontsize10" id="y21e36ac7-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>while engaging in a rescue activity or in the provision of emergency medical services; or<page identifier="/us/stat/135/1478">135 STAT. 1478</page></content></subclause>
</clause>
<clause class="fontsize10" id="y21e36ac8-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>by a member of a rescue squad or ambulance crew, while engaging in a rescue activity or in the provision of emergency medical services;</content></clause>
</subparagraph>
</paragraph>
<paragraph class="indentUp0 fontsize10" id="y21e36ac9-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>‘candidate officer’ means an individual who is enrolled or admitted, as a cadet or trainee, in a formal and officially established program of instruction or of training (such as a police or fire academy) that is specifically intended to result upon completion, in the—</chapeau><subparagraph class="fontsize10" id="y21e36aca-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>commissioning of such individual as a law enforcement officer;</content></subparagraph>
<subparagraph class="fontsize10" id="y21e36acb-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>conferral upon such individual of official authority to engage in fire suppression (as an officer or employee of a public fire department or as an officially recognized or designated member of a legally organized volunteer fire department); or</content></subparagraph>
<subparagraph class="fontsize10" id="y21e36acc-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>granting to such individual official authorization or license to engage in a rescue activity, or in the provision of emergency medical services, as a member of a rescue squad, or as a member of an ambulance crew that is (or is a part of) the agency or entity that is sponsoring the individual’s enrollment or admission;</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 fontsize10" id="y21e36acd-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>‘blind’ means an individual who has central visual acuity of 20/200 or less in the better eye with the use of a correcting lens or whose eye is accompanied by a limitation in the fields of vision such that the widest diameter of the visual field subtends an angle no greater than 20 degrees;”</content></paragraph>

<paragraph class="fontsize10" id="y21e36ace-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s3/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>in the matter following paragraph (10), as so redesignated, by <amendingAction type="insert">inserting</amendingAction> the following new paragraphs:<quotedContent><paragraph class="indentUp0 fontsize10" id="y21e391df-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">“(11) </num><content>‘neurocognitive disorder’ means a disorder that is characterized by a clinically significant decline in cognitive functioning and may include symptoms and signs such as disturbances in memory, executive functioning (that is, higher-level cognitive processes, such as, regulating attention, planning, inhibiting responses, decision-making), visual-spatial functioning, language, speech, perception, insight, judgment, or an insensitivity to social standards; and</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="y21e391e0-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">“(12) </num><chapeau>‘sedentary work’ means work that—</chapeau><subparagraph class="fontsize10" id="y21e391e1-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>involves lifting articles weighing no more than 10 pounds at a time or occasionally lifting or carrying articles such as docket files, ledgers, or small tools; and</content></subparagraph>
<subparagraph class="fontsize10" id="y21e391e2-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>despite involving sitting on a regular basis, may require walking or standing on an occasional basis.”</content></subparagraph>

<section id="d54702e649" identifier="/us/pl/117/61/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DUE DILIGENCE IN PAYING BENEFIT CLAIMS UNDER PUBLIC SAFETY OFFICERS’ DEATH BENEFITS PROGRAM.</heading><content class="firstIndent0 fontsize10" id="x21e3b8f3-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 1206(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10288/b">34 U.S.C. 10288(b)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>the Bureau may not</quotedText>” and all that follows and <amendingAction type="insert">inserting</amendingAction> the following: <quotedContent>“the Bureau—<paragraph class="fontsize10" id="y21e3b8f4-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21e3b8f5-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Subpoenas.</p></sidenote><chapeau>may use available investigative tools, including subpoenas, to—</chapeau><subparagraph class="fontsize10" id="y21e3b8f6-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>adjudicate or to expedite the processing of the benefit claim, if the Bureau deems such use to be necessary to adjudicate or conducive to expediting the adjudication of such claim; and<page identifier="/us/stat/135/1479">135 STAT. 1479</page></content></subparagraph>
<subparagraph class="fontsize10" id="y21e3b8f7-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>obtain information or documentation from third parties, including public agencies, if the Bureau deems such use to be necessary to adjudicate or conducive to expediting the adjudication of a claim; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y21e3b8f8-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>may not abandon the benefit claim unless the Bureau has used investigative tools, including subpoenas, to obtain the information or documentation deemed necessary to adjudicate such claim by the Bureau under subparagraph (1)(B).”</content></paragraph>

<section id="d54702e698" identifier="/us/pl/117/61/s5" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>EDUCATIONAL ASSISTANCE TO DEPENDENTS OF CERTAIN PUBLIC SAFETY OFFICERS.</heading><content style="-uslm-lc:I658120">  Section 1216(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10306/b">34 U.S.C. 10306(b)</ref>) <amendingAction type="amend">is amended</amendingAction>, in the first sentence, by <amendingAction type="delete">striking</amendingAction> “<quotedText>may</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>shall (unless prospective assistance has been provided)</quotedText>”.</content></section>
<section id="d54702e717" identifier="/us/pl/117/61/s6" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>TECHNICAL CORRECTION.</heading><content style="-uslm-lc:I658120">   Section 1205(e)(3)(B) of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10285/e/3/B">34 U.S.C. 10285(e)(3)(B)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>subparagraph (B)(ix)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>subparagraph (I)</quotedText>”.</content></section>
<section id="d54702e736" identifier="/us/pl/117/61/s7" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>SUBPOENA POWER.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x21e40719-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 806 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10225">34 U.S.C. 10225</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y21e4071a-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s7/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>Attorney General, the</quotedText>” before the “<quotedText>Bureau of Justice Assistance</quotedText>”;</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y21e4a360-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><paragraph class="fontsize10" id="y21e4a361-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Certain injuries</inline>.—</heading><content>The amendments made to paragraphs (2) and (7) of section 1204 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10284">34 U.S.C. 10284</ref>) shall apply with respect to injuries occurring on or after January 1, 2008.</content></paragraph>
<paragraph class="fontsize10" id="y21e4a362-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Matters pending</inline>.—</heading><content>Except as provided in paragraph (1), the amendments made by this Act shall apply to any matter pending, before the Bureau or otherwise, on the date of enactment of this Act, or filed (consistent with pre-existing effective dates) or accruing after that date.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y21e4a363-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Effective Date for WTC Responders</inline>.—</heading><paragraph class="fontsize10" id="y21e4a364-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21e4a365-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Certain new claims</inline>.—</heading><chapeau>Not later than two years after the effective date of this Act, a WTC responder may file a claim, under section 1201(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10281/b">34 U.S.C. 10281(b)</ref>), that is predicated on a personal injury sustained in the line <page identifier="/us/stat/135/1480">135 STAT. 1480</page>
of duty by such responder as a result of the September 11, 2001, attacks, where—</chapeau><subparagraph class="fontsize10" id="y21e4a366-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>no claim under such section 1201(b) so predicated has previously been filed; or</content></subparagraph>
<subparagraph class="fontsize10" id="y21e4a367-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a claim under such section 1201(b) so predicated had previously been denied, in a final agency determination, on the basis (in whole or in part) that the claimant was not totally disabled.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y21e4a368-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21e4a369-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x21e4a36a-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Claims for a deceased wtc responder</inline>.—</heading><chapeau>Not later than two years after the effective date of this Act, a claim may be filed, constructively under section 1201(a) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10281/a">34 U.S.C. 10281(a)</ref>), where a WTC responder who otherwise could have filed a claim pursuant to paragraph (1) has died before such effective date (or dies not later than 365 days after such effective date), or where a WTC responder has filed such a claim but dies while it is pending before the Bureau: Provided, That—</chapeau><subparagraph class="fontsize10" id="y21e4a36b-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>no claim under such section 1201(a) otherwise shall have been filed, or determined, in a final agency determination; and</content></subparagraph>
<subparagraph class="fontsize10" id="y21e4a36c-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>if it is determined, in a final agency determination, that a claim under such paragraph (1) would have been payable had the WTC responder not died, then the WTC responder shall irrebutably be presumed (solely for purposes of determining to whom benefits otherwise pursuant to such paragraph (1) may be payable under the claim filed constructively under such section 1201(a)) to have died as the direct and proximate result of the injury on which the claim under such paragraph (1) would have been predicated.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y21e4a36d-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21e4a36e-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Difference in benefit pay</inline>.—</heading><chapeau>In the event that a claim under section 1201(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10281/b">34 U.S.C. 10281(b)</ref>) and predicated on an injury sustained in the line of duty by a WTC responder as a result of the September 11, 2001, attacks was approved, in a final agency determination, before the effective date of this Act, the Bureau shall, upon application filed (not later than three years after such effective date of this Act) by the payee (or payees) indicated in subparagraphs (A) or (B), pay a bonus in the amount of the difference (if any) between the amount that was paid pursuant to such determination and the amount that would have been payable had the amendments made by this Act, other than those indicated in subsection (b)(1), been in effect on the date of such determination—</chapeau><subparagraph class="fontsize10" id="y21e4a36f-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/c/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21e4a370-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>to the WTC responder, if living on the date the application is determined, in a final agency determination; or</content></subparagraph>
<subparagraph class="fontsize10" id="y21e4a371-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/c/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>if the WTC responder is not living on the date indicated in subparagraph (A), to the individual (or individuals), if living on such date, to whom benefits would have been payable on such date under section 1201(a) of such title I (<ref href="/us/usc/t34/s10281/a">34 U.S.C. 10281(a)</ref>) had the application been, instead, a claim under such section 1201(a).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y21e4a372-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s8/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21e4a373-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Special limited rule of construction</inline>.—</heading><content>A claim filed pursuant to paragraph (1) or (2) shall be determined as though the date of catastrophic injury of the public safety officer were <page identifier="/us/stat/135/1481">135 STAT. 1481</page>
the date of enactment of this Act, for purposes of determining the amount that may be payable.</content></paragraph>

<section id="d54702e957" identifier="/us/pl/117/61/s9" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21e4ca84-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading>SAFEGUARDING AMERICA’S FIRST RESPONDERS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x21e4f195-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 3 of Safeguarding America’s First Responders Act of 2020 (<ref href="/us/pl/116/157">Public Law 116-157</ref>)<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x21e4f196-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10281">34 USC 10281 note</ref>.</p></sidenote> <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y21e4f197-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/61/s9/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a)(1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>between January 1, 2020, and December 31, 2021</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>during the period beginning on January 1, 2020, and ending on the termination date</quotedText>” and</content></paragraph>
