<section id="d45101e90" identifier="/us/pl/117/46/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xafc325d7-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s2651">22 USC 2651 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Helping American Victims Afflicted by Neurological Attacks Act of 2021</shortTitle>” or the “<shortTitle role="act">HAVANA Act of 2021</shortTitle>”.</content></section>
<section id="d45101e108" identifier="/us/pl/117/46/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xafc34ce8-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t50/s3519b">50 USC 3519b note</ref>.</p></sidenote><heading>AUTHORITY TO PAY PERSONNEL OF CENTRAL INTELLIGENCE AGENCY FOR CERTAIN INJURIES TO THE BRAIN.</heading><subsection class="firstIndent0 fontsize10" id="yafc45e59-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yafc45e5a-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees</inline>.—</heading><chapeau>The term “<term>appropriate congressional committees</term>” mean—</chapeau><subparagraph class="fontsize10" id="yafc45e5b-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the congressional intelligence committees (as that term is defined in section 3 of the National Security Act of 1947 (<ref href="/us/usc/t50/s3003">50 U.S.C. 3003</ref>));</content></subparagraph>
<subparagraph class="fontsize10" id="yafc45e5c-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of the Senate; and</content></subparagraph>
<subparagraph class="fontsize10" id="yafc45e5d-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the Committee on Homeland Security and the Committee on Appropriations of the House of Representatives.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yafc45e5e-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Covered dependent</inline>.—</heading><content>The term “<term>covered dependent</term>” has the meaning given such term in subsection (d)(1) of section 19 of the Central Intelligence Agency Act of 1949 (<ref href="/us/usc/t50/s3519">50 U.S.C. 3519</ref>), as added by subsection (b).</content></paragraph>
<paragraph class="fontsize10" id="yafc45e5f-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Covered employee</inline>.—</heading><content>The term “<term>covered employee</term>” has the meaning given such term in section 19A(a) of the Central Intelligence Agency Act of 1949 (<ref href="/us/usc/t50/s3519b/a">50 U.S.C. 3519b(a)</ref>).</content></paragraph>
<paragraph class="fontsize10" id="yafc45e60-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/a/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Covered individual</inline>.—</heading><content>The term “<term>covered individual</term>” has the meaning given such term in section 19A(a) of the Central Intelligence Agency Act of 1949 (<ref href="/us/usc/t50/s3519b/a">50 U.S.C. 3519b(a)</ref>).</content></paragraph>
<paragraph class="fontsize10" id="yafc45e61-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/a/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Qualifying injury</inline>.—</heading><content>The term “<term>qualifying injury</term>” has the meaning given such term in subsection (d)(1) of section 19 of the Central Intelligence Agency Act of 1949 (<ref href="/us/usc/t50/s3519">50 U.S.C. 3519</ref>), as added by subsection (b).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yafc45e62-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Payment Authorized</inline>.—</heading><content>Section 19A of the Central Intelligence Agency Act of 1949 (<ref href="/us/usc/t50/s3519b">50 U.S.C. 3519b</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="yafc4ac83-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Authority To Make Payments for Qualifying Injuries to the Brain</inline>.—</heading><page identifier="/us/stat/135/392">135 STAT. 392</page>
<paragraph class="fontsize10" id="yafc4ac84-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this subsection:</chapeau><subparagraph class="fontsize10" id="yafc4ac85-e813-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Covered dependent</inline>.—</heading><content>The term ‘<term>covered dependent</term>’ has the meaning given such term in subsection (a), except that the assigned duty station need not be in a foreign country.</content></subparagraph>
<subparagraph class="fontsize10" id="yafc4ac86-e813-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Qualifying injury</inline>.—</heading><content>The term ‘<term>qualifying injury</term>’ has the meaning given such term in subsection (a), except that the assigned duty station need not be in a foreign country.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yafc4ac87-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Authority</inline>.—</heading><content>Notwithstanding any other provision of law but subject to paragraph (3), the Director may provide payment to a covered dependent, a covered employee, and a covered individual for a qualifying injury to the brain.</content></paragraph>
<paragraph class="fontsize10" id="yafc4ac88-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Limitations</inline>.—</heading><subparagraph class="fontsize10" id="yafc4ac89-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Appropriations required</inline>.—</heading><content>Payment under paragraph (2) in a fiscal year may only be made using amounts appropriated in advance specifically for payments under such paragraph in such fiscal year.</content></subparagraph>
<subparagraph class="fontsize10" id="yafc4ac8a-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Matter of payments</inline>.—</heading><content>Payments under paragraph (2) using amounts appropriated for such purpose shall be made on a first come, first serve, or pro rata basis.</content></subparagraph>
<subparagraph class="fontsize10" id="yafc4ac8b-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Amounts of payments</inline>.—</heading><content>The total amount of funding obligated for payments under paragraph (2) may not exceed the amount specifically appropriated for providing payments under such paragraph during its period of availability.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yafc4ac8c-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Regulations</inline>.—</heading><subparagraph class="fontsize10" id="yafc4ac8d-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Director shall prescribe regulations to carry out this subsection.</content></subparagraph>
<subparagraph class="fontsize10" id="yafc4ac8e-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><content>The regulations prescribed under subparagraph (A) shall include regulations detailing fair and equitable criteria for payment under paragraph (2).”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="yafc4ac8f-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xafc4ac90-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t50/s3519b">50 USC 3519b note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>Payment under subsection (d) of such section, as added by subsection (b) of this section, may be made available for a qualifying injury to the brain that occurs before, on, or after the date of the enactment of this Act as the Director of the Central Intelligence Agency considers appropriate.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yafc4ac91-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><paragraph class="fontsize10" id="yafc4ac92-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Report on use of authority</inline>.—</heading><subparagraph class="fontsize10" id="yafc4ac93-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 365 days after the date of the enactment of this Act, the Director of the Central Intelligence Agency shall submit to the appropriate congressional committees a report on the use of the authority provided by section 19A(d) of such Act, as added by subsection (b) of this section.</content></subparagraph>
<subparagraph class="fontsize10" id="yafc4ac94-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>The report submitted under subparagraph (A) shall include the following:</chapeau><clause class="fontsize10" id="yafc4ac95-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/d/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xafc4ac96-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Budget.</p><p class="leftAlign firstIndent0 fontsize8" id="xafc4ac97-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Spend plan.</p></sidenote><content>A budget or spend plan for the use of the authority described in subparagraph (A) for the subsequent fiscal year.</content></clause>
<clause class="fontsize10" id="yafc4ac98-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/d/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>Information relating to the use of the authority described in subparagraph (A) for the preceding year, including the following:</chapeau><subclause class="fontsize10" id="yafc4ac99-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/d/1/B/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>The total amount expended.<page identifier="/us/stat/135/393">135 STAT. 393</page></content></subclause>
<subclause class="fontsize10" id="yafc4ac9a-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/d/1/B/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>The number of covered dependents, covered employees, and covered individuals for whom payments were made.</content></subclause>
<subclause class="fontsize10" id="yafc4ac9b-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/d/1/B/ii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>The amounts that were provided to each person described in subclause (II).</content></subclause>
</clause>
<clause class="fontsize10" id="yafc4ac9c-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/d/1/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xafc4ac9d-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>An assessment of whether additional authorities are required to ensure that covered dependents, covered employees, and covered individuals can receive payments for qualifying injuries, such as a qualifying injury to the back or heart.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yafc4ac9e-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/d/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xafc4ac9f-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Classified information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Form</inline>.—</heading><content>The report submitted under subparagraph (A) shall be submitted in classified form.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yafc4aca0-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Report on estimated costs for fiscal year 2023</inline>.—</heading><content>Not later than March 1, 2022, the Director shall submit to the appropriate congressional committees a report detailing an estimate of the obligation that the Director expects to incur in providing payment under section 19A(d) of such Act, as added by subsection (b) of this section, in fiscal year 2023.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yafc4aca1-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xafc4aca2-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="xafc4aca3-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t50/s3519b">50 USC 3519b note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Regulations</inline>.—</heading><paragraph class="fontsize10" id="yafc4aca4-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s2/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act, the Director shall prescribe regulations required under section 19A(d)(4)(A) of such Act, as added by subsection (b) of this section.</content></paragraph>

<paragraph class="fontsize10" id="yafc6335e-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Authority</inline>.—</heading><content>Notwithstanding any other provision of law but subject to paragraph (3), the Secretary of State or other agency head with an employee may provide payment to a covered dependent, a dependent of a former employee, a covered employee, a former employee, and a covered individual for a qualifying injury to the brain.</content></paragraph>
<paragraph class="fontsize10" id="yafc6335f-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Limitations</inline>.—</heading><page identifier="/us/stat/135/395">135 STAT. 395</page>
<subparagraph class="fontsize10" id="yafc65a70-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Appropriations required</inline>.—</heading><content>Payment under paragraph (2) in a fiscal year may only be made using amounts appropriated in advance specifically for payments under such paragraph in such fiscal year.</content></subparagraph>
<subparagraph class="fontsize10" id="yafc65a71-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Matter of payments</inline>.—</heading><content>Payments under paragraph (2) using amounts appropriated for such purpose shall be made on a first come, first serve, or pro rata basis.</content></subparagraph>
<subparagraph class="fontsize10" id="yafc65a72-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Amounts of payments</inline>.—</heading><content>The total amount of funding obligated for payments under paragraph (2) may not exceed the amount specifically appropriated for providing payments under such paragraph during its period of availability.</content></subparagraph>

<paragraph class="fontsize10" id="yafc65a73-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Regulations</inline>.—</heading><subparagraph class="fontsize10" id="yafc65a74-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary or other agency head described in paragraph (2) that provides payment under such paragraph shall prescribe regulations to carry out this subsection.</content></subparagraph>
<subparagraph class="fontsize10" id="yafc65a75-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><content>The regulations prescribed under subparagraph (A) shall include regulations detailing fair and equitable criteria for payment under paragraph (2).”</content></subparagraph>

<subparagraph class="fontsize10" id="yafc65a79-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s3/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>Each report submitted under subparagraph (A) shall include the following:</chapeau><clause class="fontsize10" id="yafc65a7a-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s3/c/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xafc65a7b-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Budget.</p><p class="leftAlign firstIndent0 fontsize8" id="xafc65a7c-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Spend plan.</p></sidenote><content>A budget or spend plan for the use of the authority described in subparagraph (A) for the subsequent fiscal year.</content></clause>
<clause class="fontsize10" id="yafc65a7d-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s3/c/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>Information relating to the use of the authority described in subparagraph (A) for the preceding year, including the following:</chapeau><subclause class="fontsize10" id="yafc65a7e-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s3/c/1/B/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>The total amount expended.</content></subclause>
<subclause class="fontsize10" id="yafc65a7f-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s3/c/1/B/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>The number of covered dependents, covered employees, and covered individuals for whom payments were made.</content></subclause>
<subclause class="fontsize10" id="yafc65a80-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s3/c/1/B/ii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>The amounts that were provided to each person described in subclause (II).</content></subclause>

<clause class="fontsize10" id="yafc65a81-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s3/c/1/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xafc65a82-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>An assessment of whether additional authorities are required to ensure that covered dependents, covered employees, and covered individuals can receive payments for qualifying injuries, such as a qualifying injury to the back or heart.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yafc65a83-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s3/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xafc65a84-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Classified information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Form</inline>.—</heading><content>The report submitted under subparagraph (A) shall be submitted in classified form.</content></subparagraph>

<paragraph class="fontsize10" id="yafc65a85-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Reports on estimated costs for fiscal year 2023</inline>.—</heading><content>Not later than March 1, 2022, the Secretary of State and each other agency head that makes a payment under subsection <page identifier="/us/stat/135/396">135 STAT. 396</page>
(i) of section 901 of title IX of division J of the Further Consolidated Appropriations Act, 2020 (<ref href="/us/usc/t22/s2680b">22 U.S.C. 2680b</ref>), as added by subsection (b) of this section, shall submit to the appropriate congressional committees a report detailing an estimate of the obligation that the Director expects to incur in providing payment under such subsection (i) in fiscal year 2023.</content></paragraph>

<paragraph class="fontsize10" id="yafc65a8a-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/46/s3/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Notice to congress</inline>.—</heading><content>Not later than 210 days after the date of the enactment of this Act, the Secretary of State and the agency heads described in paragraph (1) shall submit to the appropriate congressional committees the regulations prescribed in accordance with paragraph (1).</content></paragraph>
